Box 1179 54375-State Route 25 Southold,NY 11971 (cor.Main Rd. &Youngs Ave.) y Southold, NY 11971 Y� Telephone: 631765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: November 13, 2018 Re: Local Waterfront Coastal Consistency Review for BARBARA HAZARD SCTM# 1000-103-2-1.2 Jeffrey Patanjo on behalf of BARBARA HAZARD requests a Wetland Permit to install a 4'x70' fixed dock using thru-flow decking and supported with 8" diameter piles; install a 30"x16' aluminum ramp; install a 6'x20' floating dock using un-treated decking, supported by four(4) 10" diameter piles, and the use of cross-braces to support the floating dock a minimum of 30" off bottom at all times; clear and establish a 4' wide by 125' long pedestrian path that leads to the proposed docking facility; and to perform limited tree limbing within the 100' buffer area, and as per covenants and restrictions established on the property. Located: 1575 Harbor Lane, Cutchogue. SCTM# 1000-103-2-1.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction § 275-11. Construction and operation standards. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The dock 'structure is proposed within a New York State Significant Coastal and Fish and Widlife Habitat Area/ NYSDEC Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures. Non- disturbance buffers. Daces N ms.w�. y �y t OBINS ISLAND [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The continued expansion/construction of dock structures within a Significant Fish and Wildlife Habitat/Critical Environmental Area may reduce public use and degrade the ecological quality of the area through introduction of contaminants, disruption of marine life habits etc.... Correspondingly, physical and functional loss to wildlife has been found to occur through the loss and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and introduction of harmful contaminants. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. This information was not discussed in the application. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility,on public interest in public lands under water. The applicant will gain access via a proposed 4' wide path to public trust waters. Note, that the proposed dock is a structure, encroaches into the non-disturbance buffer and does not comply with Clauses 5a and 5f of the filed Covenant and Restrictions (L D100012953 P 114). In the event the dock is approved, the section of elevated pier between the Tidal Wetland line and Top of Bank would need to be removed. The limbing of trees in the non-disturbance buffer complies with the document and is recommended as CONSISTENT. The toping of trees is not permitted. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
