Main Rd. &Youngs Ave.) ' Southold, NY 11971 Telephone: 631 765-1938 • �O Irou LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: November 13, 2018 Re: Local Waterfront Coastal Consistency Review for FOROSICH FAMILY IRREVOCABLE TRUST SCTM# 1000-79-4-4.1 Jeffrey Patanjo on behalf of FOROSICH FAMILY IRREVOCABLE TRUST requests a Wetland Permit to remove existing timber bulkhead and construct 50 linear feet of new vinyl bulkhead landward of existing; remove existing 6'x20' floating dock and install a 4'x5' timber platform; a 30"x12' aluminum ramp; and a 6'x20' floating dock in new landward location of existing; install new 5' wide non-treated walkway along the landward edge of new bulkhead; and to remove approximately 15 cubic yards of fill from the landward side of bulkhead prior to its relocation. Located: 1405 Anchor Lane, Southold. SCTM# 1000-79-4-4.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the,LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions to replace the bulkhead, construct a 5' wide walkway and remove 15 cubic yards of soil are CONSISTENT with the LWRP policies. A Wetland Permit(1652) was issued for the bulkhead in 1983. A permit for the dock was not issued at the time. The file references Association approval. It is my recommendation that the proposal to replace the dock is INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. , 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. In the event the action is approved the following is recommended to further Policy 6. 1. Require turbidity controls in compliance with Chapter 275. The 5' wide easement extends over this parcel. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
