Main Rd. &Youngs Ave.) Telephone: 631765-1938 Southold, NY 11971 �p LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: November 13, 2018 Re: Local Waterfront Coastal Consistency Review for PASQUALE & EMILY IANNUCCI SCTM# 1000-71-2-27 Jeffrey Patanjo on behalf of PASQUALE & EMILY IANNUCCI requests a Wetland Permit to remove existing timber bulkhead and construct 25 linear feet of new vinyl bulkhead landward of existing; construct a new 5' vinyl return; remove existing 5'x22' floating dock and install a 4'x5' cantilevered timber platform; a 30"x12' aluminum ramp; and a 6'x20' floating dock in new landward location of existing; install a new 5' wide non-treated wood walkway along the landward edge of new bulkhead; included in the work is the removal of approximately 15 cubic yards of fill from landward side of bulkhead prior to its relocation. Located: Property Off Anchor Lane, Southold. SCTM# 1000-71-2-27. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Although it is recognized that the proposed actions are presented as new construction, permits for the existing bulkhead and dock structures could not be located within Town records. They were constructed without Board review and a Wetland Permit. The construction of a non-treated wood walkway along the landward edge of new bulkhead and removal of approximately 15 cubic yards of fill from landward side of bulkhead prior to its relocation is recommended as CONSISTENT. In the event the action is approved the following is recommended to further Policy 6. 1. Require turbidity controls in compliance with Chapter 275. The 5' wide easement is not shown to extend over this parcel. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2.
