disposal landward of the AHWL along Town of Southold property and Fishers Island Ordinance

The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP
provided that the Board considers the following:
1. The area proposed to receive dredge spoil (sand) is NOT located within a NYSDOS
Significant Fish and Wildlife Habitat Area.
2. The area is located within a NY,SDEC Critical Environmental Area and there is a
concern about the loss of littoral, cobble shoreline habitat through the burying of
the area with sand.
3. There is also a concern that post project the dune will not be planted or stabilized
with vegetation and that wind and waves could cause the dune to erode and
migrate further landward.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

CCAF for proposed actions that are subject to the Town of Southold Waterfront
Consistency Review Law. This assessment is intended to supplement other
information used by a Town of Southold agency in making a determination of
consistency. *Except for minor exempt actions including Building Permits and other
ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review

ENVIRONMENTAL QUESTIONNAIRE
This is intended to supplement ENG Form 4345, Application for Department of the
Army Permit, or the Joint Application for Permit used in the State of New York. Please
provide complete answers to all questions below which are relevant to your project.
Any answers may be continued on separate-sheets) of paper to be-attached to this
form.
PRIVACY ACT STATEMENT
The purpose of this form is to provide the Corps of Engineers with basic information
regarding your project This information will be used to facilitate evaluation of your
permit application and for public dissemination as required by regulation. Failure to
provide complete information may result in your application being declared
incomplete for processing, thereby delaying processing of your application.
GENERAL-APPLICABLE TO ALL PROJECTS
1. Explain the need for, and purpose of, the proposed work. Dredging must be undertaken to
provide for essential transportation ferry service in and out of Silver Eel Cove. This is the
only ferry on the island. Maintenance dredge to -12-FT Apparent Low Water Line 4,600(+/-
)CY of sand including 1-FT overdredge allowance, over 15,500(+/-)SF by mechanical means,
waterward of the Apparent High Water Line for onsite, upland disposal, landward of the
Apparent High Water Line.
2. Provide the names and addresses of property owners adjacent to your work site (if
not shown on the application form or project drawings. FI Garbage & Refuse District,

3. Indicate of your drawings the dewatering area (if applicable) and disposal site for
the dredged material(except landfill sites). Submit a sufficient number of photographs
of the dewatering and disposal sites as applicable so as to provide a clear indication
of existing conditions. For ten-year maintenance dredging permits, indicate the
dewatering/disposal sites for future dredging events, if known. The dredge material
will be dewatered on the armor bank south of the jetty and then spread along the
adjacent shore for final placement.
4. Describe the method of dredging(i.e. clamshell, dragline, etc.) and the expected
duration of dredging.
Dredging will be done by mechanical means.
5. Indicate the physical nature of the material to be dredged(i.e. sand, silt, clay, etc.)
and provide estimated percentages of the various constituents if available. For beach
nourishment projects, grain size analysis data is required. The material to be dredged
will be sand.
6. Describe the method of dredged material containment (i.e. hay bales, embankment,
bulkhead, etc.) and whether return flow from the dewatering/disposal site would reenter
any waterway. Also indicate if there would be any barge overflow.
MOORING FACILITIES
Answer the following if your project includes the construction or rehabilitation of
recreational mooring facilities.
9. It is generally recommended that any fixed piers and walk ramps be limited to four
feet in width, and that floats be-limited to eight feet in width and rest at least two feet
above the waterway bottom at mean low water. Terminal floats at private, non-
commercial facilities should be limited to 29 feet in length. If you do not believe your
proposal can meet with these recommendations, please provide the reason(s).

2. Using your plan view, show to scale the location(s), position(s) and size(s) (including
length, beam and draft) of vessel(s) to be moored at the proposed facility, including
those of transient vessel(s) if known.
3. For commercial mooring sites such as marinas, indicate the capacity of the facility
and indicate on the plan view the location(s) of any proposed fueling and/or sewage
pumpout facilities. If pumpout facilities are not planned, please discuss the rationale
below and indicate the distance to the nearest available pumpout station.
4. Indicate on your plan view the distance to adjacent marine structures, if any are
proximate and show the locations and dimensions of such structures.
5. Discuss the need for wave protection at the proposed facility. Please be advised that
if a permit is issued, you would be required to recognize that the mooring facility may
be subject to wave action from wakes of passing vessels, whose operations would not
be required to be modified. Issuance of a permit would not relieve you of ensuring the
integrity of the authorized structure(s) and the United States would not be held
responsible for damages to the structure(s) and vesse/(s) moored thereto from wakes
from passing vessels.

BULKHEADING/BANK STABILIZA TION/FILLING ACTIVITIES
Answer the following if your project inclues construction of bullfheading(also retaining
walls and seawalls) with backfill, filling of waters/wetlands, or any other bank
stabilization fills such as riprap, revetments, gabions, etc.
1. Indicate the total volume of fill (including backfill behind a structure such as a
bulkhead) as well as the volume of fill to be placed into waters of the United States. The
amount of fill in waters of the United States can be determined by calculating the
amount of fill to be placed below the plane of spring high tide in tidal areas and below
ordinary high water in non-tidal areas.

NARRATIVE STATEMENT & SUPPLEMENTAL INFORMATION
FISHERS ISLAND FERRY DISTRICT
SILVER EEL COVE,FISHERS ISLAND
MAINTENANCE DREDGING
AUGUST 2018
GENERAL
The project is at parcel 1000-012-1-10, owned by the Fishers Island Ferry District located
along the west shore of Silver Eel Cove on Fishers Island. The site is flat to gently sloped, sandy,
gravel earthen materials,vegetated with grass,brush,scrubby ground cover,and no trees. The ferry
terminal facility has existed and been operated at this site for essential transportation to and from
the mainland since the U. S. Army closed Fort Wright in the 1950's. The frontage of the property
is approximately 500 feet along the shore abutted by the U. S. Coast Guard station to the north and
the Fishers Island Development Corporation to the east. North of the U. S. Coast Guard station is
the shoreline, the site of this work. The waterfront consists of a rock revetment-lined shore with a
shore normal jetty along the channel.
The objective of this project is to dredge for current operations and access to the terminal
dock facilities. Attached are application drawings prepared for this project. This project is basically
a reinstatement of previous Town of Southold Permits 7490,7490C, and 9019 to a point similar to
the original approval and a modification to NYS DEC Permit 1-4738-00396, 1-7438-00001, and 1-
4738-00014, and U. S. Army Corps of Engineers Permit Nos. NAN-2011-00224-ESQ and NAN-
2017-00511-ERO with the exception of the very minor modifications to the upland disposal area
which will now be for dune enhancement along the shoreline.
This supplemental narrative has been prepared in accordance with the requirements of Town
of Southold, Ordinance No. 6, 2004, and the Waterfront Revitalization Program related to docks
and shorefront improvements. In addition, various coastal policies under the New York State
Coastal,Management Act are addressed herein for review by the New York State Department of
State and Department of Environmental Conservation.,
DESCRIPTION OF WORK
This project is to conduct maintenance dredging to-12 FT below Apparent Low Water Line,
4,600+/- CY of sand, including 1-FT overdredge allowance, over 15,500+/- SF by mechanical
means waterward of the Apparent High-Water Line for onsite, upland disposal landward of the
Apparent High Water Line.
MOORING FACILITIES AND DOCK MODIFICATIONS
In accordance with the U. S. Army Corps of Engineers Environmental Questionnaire, the
following additional information is provided.

I. There is one change proposed to the previously permitted ferry landing facilities as shown
c on the attached drawings, and that is the new dolphins at the east end of the main ramp sli
which were reconstructed earlier this summer. p
2. The application drawings show areas for ferry berthing to the extent possible at various
facilities around the site possible without interfering with the necessary navigation to the
other docks in Silver Eel Cove.
3. The site is the Fishers Island Ferry Terminal; there are no repair or storage services at the
site. There are pump-out facilities and fueling at the Fishers Island Ferry Terminal in New
London. It is believed that no new or additional pump-out facilities are necessary at the
Fishers Island Ferry Terminal, and the Town of Southold and the NYS DOS have agreed to
that in past and present permits.
4. Adjacent marine structures including piers, docks, wharves, bulkheads and moorings are
shown on the attached application drawings.
5. Wave protection is not considered to be necessary at this site. Because of the existing jetty
protection, there is no fetch except for waves which can be generated from strong northwest
storms. _ Nor'easters and strong northwesterly winds can generate significant waves;
however, it has been agreed that no new wave attenuator for the Silver Eel Cove Terminal
is justified to protect these facilities. This facility has operated at this site since the mid-
1950's. Wave protection is provided to the shoreline facilities at the site by the jetty
emanating from the west.shore at the cove entrance to the north and no further changes to
the jetty are considered necessary at this time.
6. There is no bulkheading or bank stabilization associated with this project; revetment and
non-vegetated buffer improvements were already existing and are to be improved as a part
of this project.The only filling will be placement of dredged sand on the shoreline above
the Apparent High Water Line to create a sand dune.
DREDGING
This protection of infrastructure includes a significant dredging component. The following
are some of the considerations that are pertinent to discussions about justification for not charging
a fee for dredging bottom sediments under the purview of Town of Southold codes and various
Boards discretion. During the early phase of development of this project, extensive coordination
was conducted within the Fishers Island community to determine the feasibility of upland disposal
for dredge sediments. It is agreed that the dredged sand will be used to develop a dune along the
shoreline of the terminal property. The dredging itself will be to maintain a clear, open passageway
for arriving and departing ferries.
It is envisioned that the dredging will be accomplished utilizing the following general
sequence and methodology:
➢ The marine contractor will arrive by water with barge-mounted crane and push boat or tug
and work boats and/or possibly a separate dredge scow.

➢ The existing dolphin structures will be disassembled only to the extent necessary for
dredging and project phasing. Piles, timbers and decking which cannot be re-used will be
collected in containers and removed from the site in accordance with applicable local laws
and ordinances.
➢ The dredging process will need to begin to work around existing entryway dolphin facilities
which are to remain for replacement in a later stage of the project. The contractor may have
to dredge his way into the site from north to south in order to take the most advantage of the
new water depths, as well as tides, to complete the project with maximum efficiency. In all
likelihood the dredge will sit at the nearshore edge of the jetty and lift the bucket over the
jetty and place sand on the shore just north of the Coast Guard Station.
In order to minimize the amount of material to be dredged and yet provide a reasonable
buffer to avoid maintenance dredging possibilities in the near future, maintenance of the -12 foot
dredging program has been continued. The materials to be dredged are categorized primarily as
fine-grained sand. It is estimated that almost 95% of the project is sand.
A dredge sediment sample plan was prepared and coordinated early on with the U. S. Army
Corps of Engineers and the NY State Department of Environmental Conservation since both of
these agencies must approve the upland disposal. Samples were collected in accordance with the
sampling plan and with instructions received from the NYS DEC earlier this summer. Those
samples were tested in accordance with the sample plan and it was determined that upland disposal
onsite is approvable.
LOCAL WATERFRONT REVITALIZATION POLICIES
The Town of Southold, LWRP policies that are applicable to the Fishers Island Ferry
Terminal operation are a local refinement of the Long Island Sound Regional Coastal Management
Program policies that apply throughout Long Island Sound under the Coastal-Zone Management
program administered by the NYS Department of State. The dredging issues are covered in the
document referenced above. The site is in Silver Eel Cove on Fishers Island and is characterized as
Developed Coast. The developed coast policies are applicable as follows:
➢ Policy 1 is to foster a pattern of development that enhances community character and
preserves natural resources to the maximum extent and minimizes adverse impacts on the
environment;
➢ Policy 2 is to preserve historic resources; and
➢ Policy 3 is to enhance and protect scenic resources and visual quality.
The docks are all permitted, consistent with waterfront development in coastal areas on
Fishers Island. The project is to dredge the areas indicated to maintain maximum access consistent
with other adjacent dock facilities and characteristics for the visual and scenic considerations in the
cove. The encroachment has been minimized as much as possible to be consistent with DEC
policies. The existing structures are as low profile as possible, consistent with the safe and efficient
use of the waters and consistent with the tidal range of this site and the special requirements of the
ferry operations.

NATURAL COAST POLICIES
The Natural Coastal Policies are 4 through 8 and require consideration as follows:
➢ Policy 4—Minimize loss of life, structures and natural resources from flooding and erosion;
➢ Policy 5—Protect and improve water quality;
➢ Policy 6—Protect and restore the quality and function of the eco-system;
➢ Policy 7—Protect and improve air quality; and
➢ Policy 8 —Minimize environmental degradation primarily from solid waste and hazardous
substances.
The terminal facility has existed in the current configuration for decades. As such it provides
adequate height to clear environmental resources of concern, and the materials to be utilized are
consistent with Town of Southold's Local Law#6 regarding environmental quality. There will be
no adverse impacts on air quality as a result of dredging these terminal facilities.
PUBLIC COAST POLICIES
Policy 9 sets forth a priority to provide for public access and recreational use of coastal
waters,public lands and public resources of the Town. This project maintains essential transporting
facilities and will provide waterfront access in the form of the "park" for Island families and so is
consistent with this policy.
WORMNG COAST POLICIES
The policies of this section relate to the following:
➢ Policy 10 — Protection of the Town's water-dependent uses and promoting new water-
dependent uses in suitable locations;
➢ Policy 11 —Promoting sustainable use of living marine resources;
➢ Policy 12—Protect agricultural lands; and
➢ Policy 13 —Promote appropriate use and development of energy and mineral resources.
While most of the Working Coast Policies are not applicable to this site or this type of
project, Policy 10, promoting water-dependent uses and the citing of water-dependent uses in
appropriate areas,is applicable, and the proposed project makes the most beneficial use of the land,
dock facilities, and access to open waters of Long Island Sound.
This project has been laid out with specific reference to and review of the Waterfront
Revitalization Program policies and is considered to be consistent.
In summary, the terminal facilities are typical of essential water transportation facilities
throughout the region and all along coastal New England. The structures are all authorized and
have been minimized in size, height, and structure so as to be consistent with other facilities of a
similar nature and the minimum necessary components to accommodate safe and efficient ferry
operations and emergency services from this site. This dredge project does not interfere with public
access or use of Public Trust Waters and Lands of the State, it does not interfere with navigation,
and it will not create soil or sedimentation. Dredging will not create erosion problems and will not
adversely affect environmental resources in the area after its completion and should allow

vegetation growth along the shoreline by tidal wetlands plants or dune vegetation if other conditions
are conducive to such growth.
There is almost no vegetation on the gravelly,rocky intertidal zone bottom sediments along
the shore, and the benthic habitat is stressed due to persistent wave activity. While the entry channel
bottom will be disrupted during dredging, it is anticipated, based on our experience on other
projects, that benthic dwellers including mollusks and crustaceans will re-establish the area within
the year following the dredging, but the benthos will probably return to its current levels of
productivity and diversity. Thus it is anticipated that there will be no long-term loss of valuable
marine and wetland habitat and no water quality degradation as a result of this project.
No natural protective features or processes will be adversely impacted as a result of the
proposed dredging work. This project is consistent with zoning policies and ordinances for the
Town. There will be no development of the upland related to this ferry terminal facility that will
create point sources of pollution or drainage. The dune and riparian buffer established vegetated
buffer along the shore will continue to help filter rainfall runoff.
RE UIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW NO. 6 2004
The permittee acknowledges that the validity of this permit is subject to the approval
of other governmental or municipal authorities.
The permittee does, by the acceptance of this permit, assume all responsibility for
operations undertaken pursuant to this permit, and shall take all precautions for the prevention
of injuries to persons and property resulting from such operations. By such acceptance, the
permittee also agrees to indemnify and save harmless the Town of Southold and its officers.
The permittee gives consent to the Town and its officers,employees and agents to enter
upon the premises where such operations are being conducted to make such inspections to
determine whether said operations are being conducted in conformity with the permit.
The permittee will notify the Trustees in writing one week prior to initiation of any and
all operations.
The permittee will notify the Trustees in writing upon completion of operations such
that the site can be inspected for issuance for a certificate of compliance.
In response to Subsection 2a and the General Rules for Standards of Residential and
Commercial Docks, the following additional information is offered.
I. Permit modifications for the work are being applied for through the US ACOE,
NYS DEC, and a coastal zone consistency determination by the NYS DOS.
2. There are no planned changes to the dock facilities as a part of this project;
otherwise the configuration requested is the same as in prior Town of Southold
Permits.

3. Upon receipt of the permit for this project, appropriate permit numbers and a
Town permit placard will be affixed to the most cove side face of the innermost
dolphin for identification from the water.
4. There are no new physical permanent structures.
5. Public access ability will be retained to the extent that it currently exists. New
access is being encouraged through the park area development.
NEW YORK STATE COASTAL MANAGEMENT PROGRAM
These application documents include a copy of the Federal Consistency Assessment Form
utilized for the New York State Coastal Management Program under the jurisdiction of the New York
State Department of State. The following policies have been identified as pertinent to this application
and the reason for consistency associated with this project is outlined in each respective case.
Policy 2—Water Dependent Uses—This project is to restore access to a fully functional water-
dependent use, an essential transportation facility at this site in support of all island activities and
emergency response.
Policy 5—Use of Existing Developed Shorefront —There is developed shoreline on this site
which has been dredged several times. This project utilizes existing shorefront which has been
altered by the long-standing and well-used facilities. The project will be to accomplish maintenance
dredging to make the terminal facility safe and reliably usable in most weather conditions.
Policy 7 — Significant Fish & Wildlife Habitat —Protection of significant fish and wildlife
habitat has been considered in the development of this project layout. Submerged Aquatic Vegetation
is nonexistent except on piles,primarily where rockweed grows, and will not be affected. There is an
expected environmental benefit to the project because of the new dune to be created.
Policy 8 —Protection &Preservation of Habitat—Protection and preservation of habitat has
also been considered in this project, and the dredging is being kept to its minimal configuration and
consistent with standards of the industry and restrictions set forth in the Wetlands Law,No. 6,2004
set forth by the Town of Southold and standards of the NYS DEC. The dune to be developed will be
4-to 5-feet high and right along the upper intertidal zone along the rocky shore.
Policy 11 —Minimize Damage to Natural Resources—The entryway facilities exist,laid out
in such a way so as to minimize damage to natural resources as identified in Policy 7 above. The
existing dolphin facilities have existed for decades. The dredging is proposed to maintain access for
current and future ferry activities while minimizing adverse impacts such as bottom sediment re-
suspension due to repeated propeller contact or thrust induced erosion which is currently experienced.
Policy 14 — No Measurable Increase in Flooding — This project consists of maintenance
dredging which in no way adversely affects water flow and circulation or flooding potential of the
area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound,Fishers
Island Sound, and Block Island Sound, and the ferry terminal structures will have no adverse
influence on those levels.

Policy 15 — No New Dredging — Only maintenance dredging is proposed in this project.
Storm wave disrupted bottom sediments have accumulated in Silver Eel Cove entry channel for
decades but have been most noticeable in the past five years. The bottom depths are such that
dredging is required to maintain viable access. Repeated shallow water benthic studies in similar
sandy marina sediments have documented stressed populations of crustaceans and mollusks which
inhabit these sediments and that they re-colonize and re-populate within a year or so of the dredging
work. Increasing the water depth will tend to diminish the re-suspension impacts on the habitat and
these colonies of creatures, and so it is felt that the one-time disturbance, occurring in accordance—
with seasonal shellfish spawning restrictions will ultimately provide a reasonable balance between
environmental concerns and the Coastal Zone Policies to foster ferry operations. The past Town
Permits 8125 and 8125C did not allow for dredge disposal in NY waters. This, combined with the
NYS DOS position of not allowing dredged sediments to be disposed of in Long Island Sound, has
made it necessary to dispose of them at an upland location and,in this case,a beneficial dune creation
opportunity exists onsite. All anticipated conditions of the DEC,USACOE (NY and New England
Region) and Town permits have been met under this proposal.

19—Impact on Public Access—Public access will not be jeopardized or impeded as a result
of this project. As a matter of fact,there is almost no public access usage of the Public Trust Lands
or Waters at this site;thus,public access to the State's lands and waters will not be adversely affected
by the project and will be improved by the park development at the site.
Policy 20—Public Trust Compatibility with Existing Adjoining Properties and Land Uses —
Public Trust compatibility with existing adjoining properties and land uses have also been considered
in this project. Several nearby properties have small docking facilities, and this dredging will not
interfere with existing or the likely configuration of future facilities on immediately adjoining
properties or the logical allocation of littoral development rights within Silver Eel Cove.
Policy 21 —Water Dependent Recreation—This project is consistent with water-dependent
opportunities policies set forth in this section. This is a high priority water dependent transportation
site.
Policy 24 —Scenic Resources, Impairment or Loss — This policy is designed to prevent,
impairment or loss of scenic resources. This ferry terminal has hosted transportation access and other
high priority opportunities for the better part of a hundred years. The proposed maintenance dredging
will not represent a new encroachment or structure which would create a loss of scenic resources.
Policy 25 — Enhance Overall Scenic Quality — The existing ferry terminal facilities are
consistent with the scenic quality of the area and will not diminish scenic resources as described in
Policy 24 above. They will not be changed in this project. -
Policy 44 — Preserve and Protect Tidal Wetlands — The creation of the dune should allow
opportunities for the growth of tidal vegetation, but that has not thus far occurred in this area
naturally. No changes to the shore are proposed that might adversely affect tidal wetlands growth
nearby; in fact, the dune to be created should be a benefit to the ecosystem and visual characteristic
of the site.

SUMMARY
This project proposes maintenance dredging in an existing,longstanding transportation facility
for community-wide access;the dredging is maintenance in nature,not new. We have worked closely
with the Town of Southold and the NYS DEC in support of this project. A dredging suitability
determination has been made by the NYS DEC Marine Habitat Protection Bureau for upland onsite
disposal.
This project complies with applicable standards of the New York State Coastal Management
Act,NYS/DEC Tidal Wetland Regulations and criteria for approval,the Town of Southold Waterfront
Revitalization Program and Local Ordinance No. 6, 2004, and its approval is respectfully requested.
