Bulkhead Permits by Gary, Inc. on behalf of HARRY BASHIAN & HAYKUHI BASHIAN requests a
Wetland Permit and a Coastal Erosion Permit to replace all existing 41' long, 41.5' long and 61.5'
long navy bulkheading in-place with new navy bulkheading using vinyl sheathing; along the 61.5'
long bulkhead section, install (1) one 61.5' row of toe armor stone using a minimum of>18"x18"x18"
and (1) one ton stones with geotextile filter fabric placed underneath; replace existing 12'x26.4',
12'x26.4' and 15.5'x61.5' sections of"U" shaped decking with new decking in-place using untreated
lumber and supported by 30 new 10"x20' pressure treated timber piles; under the ±20'x61.5' deck
area add approximately 125 cubic yards of clean beach sand backfill from an authorized upland
source; and for the existing 26.4'x36.3' two-story dwelling. Located: 58425 North Road, Greenport.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the below listed Policy Standard and therefore is
INCONSISTENT with LWRP.
A Board of Trustees Wetlands Permit was issued in 1985 for 63' of retaining walls plus (2) 40'
returns. A Building Permit(11479-z)was issued in 1982 for the principal structure and deck.
The current deck is not compliant with the Building Permit which shows a 10'wide deck on
the seaward side (Figure 1).
The principal structure and deck are as-built and did not receive a Board of Trustee
Wetlands Permit or Coastal Erosion Hazard Area permit.

The proposal to replace the existing as built 12'x26.4', 12'x26.4' and 16.5'x61.6' sections of
"U" shaped deck does not comply with the existing Building Permit, the purpose of the
Coastal Erosion Hazard Area and the LWRP policies.
4.1. Minimize losses of human life and structures from flooding and erosion hazards.
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
1. Avoid development other than water-dependent uses in coastal hazard areas.
Locate new development which is not water-dependent as far away from coastal
hazard areas as practical.
b. Avoid hazards by siting structures to maximize the distance from Coastal
Erosion Hazard Areas.
The proposed as built deck is residential and therefore is not a
"water dependent use". The structure is located entirely within the
Coastal Erosion Hazard Area (CEHA). Note the surveys do not
depict the CEHA.
Further the, structure is also located within the FEMA "VE" velocity
hazard flood zone designation. Structures located within these
areas are subject to repetitive loss from storm events.
It is recommended that the Board require that the deck area be
redesigned to comply with the original building permit and purpose
of the CERA and FEMA Flood Zones to avoid and minimize repetitive
structure damage and loss within these vulnerable, high wave
energy areas.

6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
According to Town records, the principal structure and deck structure
were constructed without obtaining Board of Trustee review or regulatory
permits.
9.3. Preserve the public interest in and use of lands and waters held in public trust by the state and
the Town of Southold.
The reconstruction of structures and/or seaward advancement on and over public trust
lands (beach) below the average high water mark is unsupported by this policy.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town.of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of,-Southold -agency in

**Emergency Permit Request**
Project Description: Applicant Haykuhi Bashian owns the project site 58425 North Road
Greenport,NY 11944.Please forward all mail to 5 Bayview Drive,Plainview NY 11809.
The existing storm damaged 41', 41.5' &61.5' navy bulkhead sections are proposed to be
removed &replaced in same place. Also proposed is replacement is existing U shaped 12'x26.4',
12'x26.4', & 15.5'x61.5' with untreated timer supported by(30)10"x20' pressure treated timber
piles. Included in this proposal is 20'x61.5'+area under decking for approx. 125 cyds of clean
beach sand backfill from an authorized upland source. In additional, proposed is 61.5' of toe
armor stones.Each stone will be a minimum of MIN> 18"xl8"x18" and 1 ton in weight with
geotextile filter fabric placed underneath.
The existing 26.4'x36.3' two story dwelling is included in this proposal.
All equipment and all material for this project will be brought in via upland by a licensed and
insured contractor. This project is for bulkhead stabilization.
Please advise, this is an emergency repair to protect the upland dwelling due to recent storm
damage. The proposed backfill is needed to replenish the sand that washed away during the
storm.
The existing structures are both NYSDEC &Town of Southold approved. See NYSDEC
permit#1-473 8-00662/0000 1-0 and#1-4738-00662/00003 for additional information.
This project is minor in nature and offers no community concern. This project is located on the
Long Island Sound, in Suffolk County, Town of Southold.
