Located: 3400 Deep Hole Drive, Mattituck. SCTM# 1000-115- 17-11 The proposed action has been reviewed to Chapter 268,Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided the dock standards are met to further Policies 6 and 9. Note that the creek is very narrow and shallow in this location. This recommendation was made in consideration of a previously issued permit for a similar dock structure in the same location. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Therefore,consistent with Policy 3,the proposed dock would be in harmony with the visual quality of the surrounding developed shorelines of Deep Hole Creek. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes 0 No ❑ Not Applicable 4 � LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR FHV,LLC 3400 DEEP HOLE DRIVE MATTITUCK,NY SCTM#1000-115-17-11 Policy 6 The proposed dock is intended to provide a fixed point of safe,elevated structural access over the existing vegetated marsh to allow for access to the water and private dockage of small watercraft in Deep Hole Creek. The property was historically improved with a fixed dock structure in the same location as the proposed dock, which was permitted by the Board of Trustees pursuant to Permit No. 1741 in 1983,but readily available aerial photography indicates that the prior structure has not been present in more than 10 years. However,similarly configured fixed "T"-shaped docks have more recently been permitted by the Board on the surrounding properties,including the adjoining northerly property(Permit No. 7718, issued in 2012)and the property located to the southeast across Deep Hole Creek(Permit No. 7671,issued in 2011). The subject dock would thus be constructed amongst these surrounding docks,consistent both with their specifically approved configurations and the general"construction and operation standards" for docks set forth by Section 275-11(C)(2). Specifically,the structure would extend 8 feet seaward of mean lower low water,approximately half of the allowable one-third extension into the approximately 47'wide waterway at MLLW; and would be situated more than 15 feet from the side property lines. To minimize and mitigate any potential impact of the project on the adjacent vegetated tidal marsh and surface water quality,the proposed catwalk has been designed with the minimal scope necessary;and would be elevated a minimum of 4 feet above the grade of marsh and constructed with open-grate decking. Therefore,consistent with Policy 6,the dock would not cause a"fragmentation of ecological communities;"result in the physical loss,degradation, or functional loss of ecological components; or otherwise significantly adversely impact the adjacent vegetated tidal wetlands or surface waters of Deep Hole Creek. -SEE ATTACHED NARRATIVE- Attach additional sheets if necessary Policy 7.
