STEPHANIE TEICHER requests a Wetland Permit to remove the existing bluff stairs and construct
a new 51'5" long set of bluff stairs beginning at proposed masonry pad consisting of a 1'10"x4' top
step to a 4'x3' top landing to 11'7"x4' steps to a 4'x8' upper middle landing to 11'7"x4' steps to a
4'x8' lower middle landing to 11'7"x4' steps to a 4'x4' landing seaward of retaining wall with 8'4"x4'
steps to area between bulkhead and retaining wall; and for the existing 8.33'x4' set of steps to
beach off bulkhead to remain; remove 223sq.ft. of existing brick patio and replace with lawn; install
a 7'x8' masonry pad for utilities; for the as-built±805sq.ft. seaward side deck, remove 40sq.ft.
bump-out section of decking and construct new 68sq.ft. area of decking to southerly side of existing
deck for a total of 833sq.ft. of seaward side decking, and to replace all of the existing decking;
replace all decking on existing 40'x24.92' main deck; replace all decking on existing 6.5'x22.8'
second-floor deck; replace decking on existing 6.5'x22.8' first floor deck and replace existing
1'x20.5' steps; replace existing 6'x6' access steps to main deck with new steps; for the existing
three (3) 1.33'x4.5' benches at lower retaining wall to remain; existing 3.75' diameter concrete table
at bulkhead to remain; relocate existing 19sq.ft. storage bin; existing lighting fixtures and hose bib
to remain; remove 488sq.ft. of existing wood deck/boardwalk in between bulkhead and retaining
wall, and revegetate 220sq.ft. with Cape American beach grass and 269sq.ft. of sand; construct a
99sq.ft. wood deck to connect to the new bluff stairs and to the steps to beach; reconfigure existing
stepping stone path continuing along the waterside of the deck along the new planting area to the
new platform comprised of 2'x4' stepping stones from northerly steps to connect to adjoining deck
steps; and a proposed on-grade 68sq.ft. masonry pad situated 5' from top-of bluff which will be at
level grade at beginning of down slope to tie into a two-step riser and small 12sq.ft. landing to
maintain elevation. Located: 6825 Nassau Point Road, Cutchogue. SCTM# 1000-111-15-8.2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the
LWRP.

Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures from
flooding and erosion hazards are recommended.specifically
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
3. Move existing development and structures as far away from flooding and erosion
hazards as practical. Maintaining existing development and structures in hazard areas
may be warranted for.
a. structures which functionally require a location on the coast or in coastal
waters.
The as built structures are located in very close proximity to the top of bluff, do not
functionally require a location on the coast and are not water dependent.
5. Manage development in floodplains outside of coastal hazard areas so as to reduce
adverse environmental effects, minimize the need for future structural flood protection
measures, or expansion of existing protection measures and to meet federal flood
insurance program standards.
The area between the bulkheads is located in the VE (velocity hazard) Flood Zone. VE
zones are defined as areas with special flood hazards associated with high-velocity
waters generated by tidal surges and hurricane wave wash. Accessory structures
located within these areas have the potential to suffer high rate of loss and pose hazards
to life and property during storm surge events and should be minimized in area and
placement.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
According to Town records, the structures or portions thereof were
constructed without obtaining Board of Trustee review and a regulatory permit.
The applicant does not provide the setback to the top of bluff.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

In order to proceed with the application, please clarify your project description submitted on June 20, 2018 and email
below.
In email,you state a 746.4sq.ft. deck prior to adding the 40sq.ft. addition. Your 6/20/18 submission states an 805sq.ft.
as-built deck prior to the 40sq.ft. addition. Please clarify.
Your 6/20/18 submission states that the owner will be replacing the decking on a main deck, and adjacent lower and
upper decks north of the main deck, and replace the access steps for both the main deck and adjacent deck with added
planting. Please specify dimensions for each deck, and access steps.
Your 6/20/18 submission states that the owner will be adding 269sq.ft. of sand? Is that correct or did you mean cubic
feet of sand? Also, what are the sizes of the three wood benches, concrete table, and steps to beach off bulkhead?
Proposed masonry pad for placement of refuse containers—what is the dimension and location of the proposed pad?

A major portion of the deck off the, main house was approved with the
construction of the house in 1982.
The approved deck extended 19.811. from the house toward the bluff and is
746.4 SF.. Sometime afterward, but before the present owner purchased in
2013, the dleck was extended towaird the bluff by 5.2 ft., fora total deck of
805 SF.+/-. At some time thereafter, a 40 SF section of deck was added to
the seaward side. This portion of the deck will be removed in accordance
the Town Board of Trustees letter to the Zoning Board of Appeails. We
propose to add 68 SF to Southern side of existing deck to provide ease of
passage. In addition, the decking would be replaced on the main deck and
the adjacent lower,and upper deck:, north of the main deck and replace the
access steps for both the main deck. and adjacent deck with added
planting.
EXISTING AS-BUILT LOWER DECKS/ BOARDWALKS/STORAGE BINS
Between the bulkhead and retaining wall presently exists a series of two
boardwalks connecting two decks with benches, concrete table storage
bin, lighting fixtures as well as a hose bib. We propose to relocate 19SF

PROPOSI=D MASONRY PAD
The proposed pad would accommodate the placement of refuse containers
and be ground level.
PROPOSEED GRADE: LEVEL STEPPING STONE PATH and MASONARY PAD
The existing stepping stone path would be reconfigured to accommodate
the proposed southern deck expansion with the new planting area and
continue along the waterside of thea deck along the new planting area to the
proposed new platform. The proposed stepping path would comprise
approx. 2'x 2' square stones set in crushed stone base with approx. 6"
separations, seeded for grass be iveen and surrounding. In addition, we
propose 2'x4' stepping stones from northerly steps to connect to adjoining
deck steps and proposed on grade 68 SF masonry pad 5 feet from top of
bank. This pad would be at level grade at beginning of down slope to tie
into a two step riser and small (1:23F) landing to maintain required
elevation above grade for DEC.
