SCTM# 1000103-3-15 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions to remove a portion of the roof and exterior walls along the southwest corner of existing 1,820.7sq.ft. two-story dwelling; construct a 443.2sq.ft. addition with attached 5'6"x8'0" exterior front porch onto dwelling; reframe areas of existing roof to accommodate new addition; raise the roof over portion of dwelling for a second-floor addition are CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. The as built structure 16'x32' pool (to remain) is recommended as INCONSISTENT. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 9. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the structures or portions thereof were constructed without obtaining Board of Trustee review and a regulatory permit. The following is recommended. L The setback to the pool is not depicted. Clarify the setbacks. ii. Verify pool de-watering dry well and outdoor shower drainage. iii. Due to proximity to surface waters, consider requiring an Innovative/Alternative Sanitary System. iv. Require that the on-site trees adjacent to the waterbody remain. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR MATTHEW MIRONOV& BARBARA LICHTENBERG-MIRONOV 2900 BEEBE DRIVE CUTCHOGUE, NY SCTM#1000-103-3-15 Policy 6 Consistent with Policy 6, the project will contribute to the protection and restoration of the adjacent bank and tidal wetland ecosystem. The project will have minimal impact on the existing structural footprint and lot coverage over the portion of the property situated within 100 feet of the top of the bank, i.e., the Chapter 275 jurisdictional area. Specifically, the proposed sunroom will be constructed in place of an existing sunroom and within the footprint of the existing portion of deck beneath it, which is to be removed. The remaining portion of deck will be replaced in-place; and the on-grade masonry swimming pool patio will be replaced in-place except for the addition of 360 sf of new patio on the landward side of the existing pool. This additional patio surface will be partially offset by the removal of the most seaward 26 sf of existing patio, which will increase the wetland setback to the patio. Except for the installation of a stoop and outdoor shower over the proposed patio extension, the balance of the proposed additions and alteration to the existing dwelling will occur over(dormer and roof replacement) or on the landward side (new porch and 1-story additions) of the existing dwelling. Therefore, there will be no additional encroachment on the top of bank or adjacent tidal wetlands/waters; there will be no increase in Town-defined lot coverage on the waterside of the dwelling; and the existing minimum wetland setback will be increased. Nevertheless, additional mitigation measures have been included in the project design to offset any potential impacts of the proposed construction activities and improve existing site conditions to create a net environmental benefit upon project completion. For example, a drainage system of leaders, gutters, and drywells will be installed to capture and recharge roof runoff and backwash from the outdoor shower; and although a portion of the proposed impervious driveway will be located within Chapter 275 jurisdiction, it too will be equipped with catch basins to control associated runoff. A 5' wide nonturf buffer to be planted with native vegetation in place of existing lawn will be established adjacent to the top of bank, which can serve both as a sink and filter for stormwater runoff and contaminants. And temporary runoff and disturbance during construction will be contained with a project-limiting fence. Additionally, outside Chapter 275 jurisdiction, a proposed upgraded sanitary system will provide benefits to groundwater and ultimately surface water quality through the improved treatment of septic waste. Therefore, the project will alter the existing developed condition of the property within Chapter 275 jurisdiction only minimally and will have a beneficial effect on the environmental conditions of the site and thus the adjacent bank and wetland ecosystem. Based on elevation, all proposed additions and alterations are located landward of the tidal wetland jurisdiction of the New York State Department of Environmental Conservation. See attached.
