Samuels & Steelman Architects on behalf of JUSTIN & ELIZABETH MIRRO request a
Wetland Permit to demolish existing one-story dwelling, decks, detached garage, and
abandon existing sanitary system; construct new two-story dwelling with attached four car
garage with a footprint of 4,227sq.ft. (approx. 6,700 total sq.ft.); construct an attached
45sq.ft. covered porch, attached 135sq.ft. covered porch, and attached 525sq.ft. covered
porch onto dwelling; construct 190sq.ft. of open decks with exterior stairs attached to
dwelling; install a new sanitary system; construct a one-story, non-habitable 748sq.ft. pool
house with a 713sq.ft. covered porch (included in terrace area); construct a 50'x22' gunite
swimming pool with infinity edge totaling 1,443sq.ft.; construct an 8'x10' (80sq.ft.) spa;
install 4' high pool enclosure fencing; install 2,839sq.ft. of stone terracing at grade; maintain
existing 175 linear feet of timber tie border between lawn and non-turf buffer, and increase
the height by approximately 18" at filled areas; construct approximately 121 linear feet of
new timber retaining wall at south edge of property; install approximately 3,635 cubic yards
of clean fill; install new topsoil and landscaping, including an irrigation system; install a new
gravel driveway; reconstruct existing 27sq.ft. cantilevered platform off bulkhead with
21 sq.ft. stairs to beach in new location; install gutters to leaders to drywells to contain
roof/stormwater runoff; provide 15 closed loop geothermal wells; install a line of silt fencing
around construction area; and perpetually maintain the existing approximately 2,272 square
foot area of non-turf buffer along the bluff face between timber border tie and bulkhead.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the below Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 4. Minimize loss of life, structures, and natural resources from flooding and
erosion.
Policy 4.1. "Minimize losses of human life and structures from flooding and
erosion hazards." The following management measures to minimize losses of
human life and structures from flooding and erosion hazards are recommended:
specifically
A. Minimize potential loss and damage by locating development and
structures away from flooding and erosion hazards.
3. Move existing development and structures as far away from
flooding and erosion hazards as practical. Maintaining existing
development and structures in hazard areas may be warranted for-
a. structures which functionally require a location on the coast or in
coastal waters.
The parcel is located within the FEMA Flood Zones VE and AO and
is known to flood during storm events (See below photo).
VE zones are areas subject to inundation by the 1-percent-annual-
chance flood event with additional hazards due to storm-induced
velocity wave action.
AO zones are areas subject to inundation by 1-percent-annual-
chance shallow flooding where average depths are between one
and three feet.
The proposed residential structures do not require a location on the
coast. The pool house is located 35' to the bulkhead and 50.9' to
high water. The pool is proposed at 50.9' to the bulkhead. Chapter
275 Wetlands and Shorelines requires a 100' setback for all
structures from the natural protective feature (beach in this
instance).
It is recommended that the structures are relocated to achieve
a greater setback and to avoid the FEMA flood zones to the
greatest extent practicable to avoid future loss.

In the event the action is approved: The installation of an Innovative and
Alternative Onsite Wastewater Treatment System is recommended to further
Policies 5 and 6. r
It is recommended that the non-turf buffer is vegetated with native, salt tolerant
vegetation.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the
proposed action.

MIRRO RESIDENCE
2455 Nassau Point Road, Cutchogue
Demolish existing one story frame residence, decks, and detached garage, and abandon
existing sanitary system.
Construct new two story frame Residence, with flood-compliant crawl space and four-car
garage, approximately 6,700 square feet, with footprint of 4,227 sf;
with three attached covered porches of: 45 sf, 135 sf, 525 sf, totaling 705 sf;
with open decks and exterior stairs attached to residence, totaling 190 sf;
One story, non-habitable Pool House of 748 sf;
with covered porch (included in terrace area) of 713 sf ;
50 ft x 22 ft gunite swimming pool with infinity edge, totaling 1,443 sf;
8 ft x 10 ft spa, totaling 80 sf;
Stone terrace at grade, of 2,839sf;
Reconstruct wood stairs from top of bulkhead to beach in new location;
4 ft high pool enclosure fence (bulkhead acts as portion of pool enclosure);
Raise height of existing timber retaining wall approximately 18";
Construct timber retaining wall at south edge of property, approximately 121 If;
Provide clean fill contoured per SITE PLAN, approximately 3,635 cy;
Provide new topsoil and landscaping;
Maintain existing non-turf buffer between bulkhead and retaining wall;
Provide new gravel driveway;
Provide new sanitary system per SCDHS;
Provide leaders/gutters connected to new drywells to contain roof/stormwater runoff.
