Re: LWRP Coastal Consistency Review for KATHY HALBREICH
SCTM# 1000-138-2-12
Michael Kimack on behalf of KATHY HALBREICH requests a Wetland Permit to remove existing
5'5"x6'0" wood dock and two (2) 4"x6" wood pilings; construct a 3'x8' (24sq.ft.) walkway using thru-
flow decking leading to a two (2) step wood staircase to a proposed 6'0"x8'0" wood frame fixed
dock using thru-flow decking and four (4) 6" diameter pilings to secure the dock. Located: 5100
Skunk Lane, Cutchogue. SCTM# 1000-138-2-12
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP provided the following is determined:
1. The low water depths at 1.25' MHW are concerning.
2. The vessel has not been identified. What is the draft?
_ 3. It has not been proven that the action meets the 1/3 rule with a vessel in this narrow area of
the creek. Can boats pass at low tide.
Note the dock is entirely located on a parcel owned by the applicant.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
