En-Consultants on behalf of VANSTON BEAR, LLC, c/o ANDREW BECK, MEMBER requests a
Wetland Permit to remove and replace in-place approximately 1,032 linear feet of existing timber
bulkhead forming boat basin and channel jetties with vinyl bulkhead; a Ten (10) Year Maintenance
Permit to dredge approximately 7,800sq.ft. area of channel/mouth of basin to a maximum depth of
four feet below mean lower low water; place approximately 500 cubic yards of approximately 1,400
cubic yards resultant sand spoil as backfill around replacement bulkheading; place approximately
600 cubic yards spoil in designated ±9,100sq.ft. on-site disposal area above spring high water to
south of channel; and place approximately 300 cubic yards spoil in designated ±5,800sq.ft. spoil
site on beach above spring high water on two adjoining properties to north, including unopened
"West Bay Road" (Town of Southold) and Harbor Cove Property Owners Association (SCTM#
1000-111-10-12); and remove and replace in-place 3.5'x36' and 5'x81' fixed timber docks located
inside boat basin during bulkhead replacement. Located: 5250 Vanston Road, Cutchogue. SCTM#

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP, provided that:
1. The Board places seasonal restriction on operations prohibiting work between March
15 to August 31 to protect protected species that could be using the area (NYSDEC
Environmental Mapper). This area is within the NYS DEC Cutchogue Harbor beach
Piping Plover nesting area.
2. The Board verifies that the material is suitable for beach nourishment and graded to
mimic natural conditions. _
3. Furthermore, it is recommended that Board verify if the applicant has obtained a
NYSDEC Article 25 permit and consider the NYSDEC conditions outlined in a past
permit(DEC PERMIT NUMBER 1-4738-00444100006) for a similar dredging action
which expired in 1999, specifically; "Due to the documented occurrence of New York
State listed endangered/threatened species at this site, no work which involves the
operation of machinery, redistribution of sand or other physical disturbance shall be
permitted during the period from March 15 to August 31 inclusive." It is
recommended that the Board determines if the same restriction would still apply and
if so that the applicant submit the start and end date of the proposed maintenance
dredging.
4. Turbidity controls are required in accordance with Chapter 275.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nifg_ icant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local

Policy 6
The project consists of two primary elements, 1)the in-place replacement of the existing bulkheading and
jetty structures that form the boat basin and channel to Cutchogue Harbor; and 2)the maintenance
dredging of the channel/mouth of basin. All of the proposed work was previously authorized by the
Board of Trustees pursuant to Wetland Permit No. 8600, which was issued to the prior property owner in
May 2015. Although that permit was transferred to the applicant in March 2017 and would have
remained valid today if it had been extended at the same time,the permit was inadvertently allowed to
expire. Therefore,with the exception of one change to the proposed spoil placement as described below,
all of the same work is again proposed herein. Specifically, as previously described,the proposed
bulkhead replacement and maintenance dredging together will have the effect of restoring and
maintaining the navigability and use of this historically existing boat basin and channel. The proposed
maximum dredge depth is four feet below mean lower low water,and access to the dredge site will gained
both through the upland portion of the property and by barge from Cutchogue Harbor. The dredging will
be done by land based excavator and barge mounted clamshell bucket crane. Of the approximately 1,400
cubic yards of sand spoil, approximately 1,100 cy will be retained on site, with approximately 500 cubic
yards used as backfill around the replacement bulkheading and approximately 600 cy placed in a
designated spoil site located well landward of spring high water to the south of the channel. The one
change from the prior application is the proposed placement of approximately 300 cy of material on the
beach to the north of the channel, as was requested in 2015 by the neighboring land owner,Harbor Cove
Property Owners Association. A silt curtain will be deployed during maintenance dredging to control the
ephemeral turbidity typically associated with dredging activities,and spoil placed in the designated spoil
disposal areas will be contained by staked haybales during the dewatering period to prevent reentry of
material into the waterway. Therefore,the ordinary and routine in-place replacement of the existing
treated timber bulkheading with vinyl sheathing and maintenance dredging will be consistent with Policy
6.
