The proposed action is located within a NEW YORK STATE DEPARTMENT OF
ENVIRONMENTAL CONSERVATION CRITICAL ENVIRONMENTAL AREA AND PECONIC
ESTUARY PROGRAM CRITICAL HABITAT.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposal to extend the existing dock structure is INCONSISTENT with the denoted
following Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6.1 Protect and restore ecological quality throughout the Town of Southold.
• The existing dock received a Wetland Permit 5898 in 2004 and was modified in 2008 to
current configuration. A condition in the permit required the flaot to be reduced to 6' x
20'.
• The exisintg dock measures 58 ' feet in length currently and has a Mean Lower Low
Water ranging from 2.13' to 2.26'.
• Water depth in 2004 at the end of the dock was shown as 2.6' MLW.
• Higher tidal periods would result in deeper and sufficient water depth: The proposal to
extend the dock in public waters to 104' (55% enlargement) is unsubstantiated.
• The pier line shown uses a dock that I could not locate a permit for on SCTM# 1000-70-
6-28 (to the west). This dock should not be considered.
• A representative vessel is not shown.
• The application does not discuss the potential impacts to natural resources and water
quality.
• The construction method has not been identified.

Policy 6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction

The 5' wide x 24' long floating dock does not comply with Chapter 275
regulations. Floats. Floats shall not be larger than 6' wide and 20' long except
on Fishers Island; or of equal square footage as determined by the Trustees;
Policy 9.4. Assure public access to public trust lands and navigable waters.
E. Provide access to, and reasonable recreational use of, navigable waters
and public trust lands under water.
The applicant currently enjoys access to the water via and existing dock
structure. The seaward extension will further extend into public waters
resulting in a net decrease in public access to public underwater lands
and the nearshore area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A posed action will be evaluated as to its sianilicant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing, both suppor ing :seed non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
