The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal to extend the existing dock structure is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 6.1 Protect and restore ecological quality throughout the Town of Southold. • The existing dock received a Wetland Permit 5898 in 2004 and was modified in 2008 to current configuration. A condition in the permit required the flaot to be reduced to 6' x 20'. • The exisintg dock measures 58 ' feet in length currently and has a Mean Lower Low Water ranging from 2.13' to 2.26'. • Water depth in 2004 at the end of the dock was shown as 2.6' MLW. • Higher tidal periods would result in deeper and sufficient water depth: The proposal to extend the dock in public waters to 104' (55% enlargement) is unsubstantiated. • The pier line shown uses a dock that I could not locate a permit for on SCTM# 1000-70- 6-28 (to the west). This dock should not be considered. • A representative vessel is not shown. • The application does not discuss the potential impacts to natural resources and water quality. • The construction method has not been identified. The seaward extension will further extend into public waters resulting in a net decrease in public access to public underwater lands and the nearshore area.
