Jeffrey Patanjo on behalf of THOMAS & CARYN MAZZARELLI request a Wetland Permit to
remove storm damaged dock; in same location as existing construct a proposed 4'x35' fixed dock
supported with 8" diameter piles using untreated decking; install a 30"x14' aluminum ramp; install a
6'x20'floating dock using untreated decking and supported with four(4) 10" diameter piles with
cross braces to keep the float a minimum of 30" off sand bottom at all times. Located: 650 Oak
Avenue, Southold. SCTM# 1000-77-1-2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore,
INCONSISTENT with the LWRP. The following needs to be addressed.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws
and regulations for all Andros Patent and other lands under their jurisdiction
9. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
A permit(1121) for the dock was issued in 1976. The deck that appears to be
included as a part of the dock never received a permit. The total distance of the dock
is unknown when considering the "deck".
§ 275-11. Construction and operation standards.
The applicant must demonstrate that the following dock standards pursuant to § 275-11.
Construction and operation standards have been met.
(d) Review and approval of dock applications. Before issuing a permit for a dock structure,
the Trustees shall consider whether the dock will have any of the following harmful
effects:
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities,
The application does not correctly show the dock line with proposed vessel
or discuss the 113 rule.
(5] Whether the dock will cause degradation of surface water quality and natural
resources,
Water depths are shallow in the area and may not be conducive to the
operation of vessels capable of disturbing bottom-sediments and increased
turbidity.
(11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway,or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts, and
[12] Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service.
9.3 Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use,
structure, or facility on public interest in public lands under water.
The applicant enjoys access to public waters via an existing dock. The seaward
extension of the dock results in a net decrease or impedance of public access to
underwater lands and waters.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal at-ea(which includes all of Southold ToM M .
3. if any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be expDlainM in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions,it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website•(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all
local libraries and the 'Town Clerk's office.

Project Description
Project includes the removal of existing storm damaged pier and replacement with new 4' wide x
35' long fixed pier supported with 8" diameter piles and un-treated decking, installation of 30"
wide x 14' long aluminum ramp and installation of 6' wide x 20' long floating dock with un-
treated decking supported with 4— 1-" diameter piles with cross braces to hold float off sand
bottom a minimum of 30" at all times.
