SCTM# 1000-35-5-35 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS items `B"which states: B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inplace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, but not limited to, groins,jetties, bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and Block Island Sound(excluding all creeks); Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. The project is nevertheless consistent with Policy 4,as it proposes the construction of vinyl bulkheading in the same location as the existing timber bulkheading for the purpose of maintaining the property's historical method of protection against erosion and flooding. The existing,developed site has been improved with and supported by a bulkhead since prior to 1977,and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead the subject property would be exposed to erosion and flooding. Attach additional sheets if necessary Policy 5. The proposed incidental dredging within 8 feet of the newly constructed bulkhead will not adversely impact water quality because the spoil will consist of sandy/silty soils derived primarily from lost upland material;and the localized,ephemeral effects of turbidity will be contained by a silt curtain deployed during the bulkhead replacement and dredging activities. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR ANTHONY & ANGELA GERACI 600 SNUG HARBOR ROAD GREENPORT, NY SCTM#1000-35-5-35 Policy 6 Pursuant to Southold Town Code §268-5 ("Review of Actions") and the corresponding definitions of"action" and "minor action" by §286-3 ("Definitions"), the proposed in-place reconstruction of the previously permitted bulkhead and other existing structures (see Wetlands Perrmit 5508) should be determined to be exempt from LWRP consistency review. Nevertheless, the project will effectively maintain the previously permitted site conditions without any change in or significant adverse impact on the adjacent tidal waters or wetlands except that the treated timber bulkheading will be removed and replaced with untreated vinyl sheathing, and the existing dock platform will be reconstructed with untreated decking; and the previously required 10'wide non-turf buffer will be maintained along the landward side of the reconstructed bulkhead. The localized, ephemeral effects of the proposed incidental dredging to' recover lost upland material (to be retained on site as backfill) will be contained by a silt curtain deployed during the bulkhead replacement and dredging activities.
