WALLACE requests a Wetland Permit to remove existing docking facility and construct a proposed 3'x30' fixed dock using thru-flow decking to begin 2' seaward of Average High Water Mark; a 3'x17' metal ramp; and a 6'x20' floating wood dock. Located: 150 Briarwood Lane (Dominant); 425 & 350 Briarwood Lane, at End of 20'Wide Right-of-Way, Cutchogue (Servient). SCTM# 1000-136-1-3 (Dominant); 1000-136-1-1 & 1000-136-1-5 (Servient). The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The dock was built without the benefit of Board of Trustee review and permits. The following permits were issued for a dock, however, the existing dock is a different configuration. Permit#3716 issued in 1989 - Register 5' x7' dock Permit#3783 issued in 1989 - Construct 4' x 42' catwalk, Xx 15' ramp, a 5' x 30' float and 23 pilings (Expired) § 275-11. Construction and operation standards. (c) Regulations for the placement and configuration of docking facilities. [1] Residential docks. [Amended 10-11-2005 by L.L. No. 17-20051 [a] Only one catwalk may be permitted per residential lot. Only one mooring or dock may be permitted per residential lot. Upon a showing of special need due to low water level and hazard to property, the Trustees may permit both a mooring and a dock for the same residential property. [Amended 12-18-2007 by L.L. No. 23-2007 Two docks occur on the parcel and therefore, the proposal does not meet this code section. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; The application does not show the dock line with proposed vessel, discuss the 1/3 rule or show water depths. [5] Whether the dock will cause degradation of surface water quality and natural resources, [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. Not provided. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
