Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. It is unusual to place a buffer in a wetland. The purpose of a buffer is to "buffer" the natural protective feature from adverse impacts from development, sediment, pet waste and nutrients. Buffers are also provide flood mitigation and erosion control. 1. The buffer width at 30' ignores the value and extent of wetlands on the property historically referred to as the "flooded area" (see Figure 1). 2. The non-disturbance buffer proposal will not work. The activity proposed would be disturbance in itself. 3. The method of"removal" is not identified and should be clarified.
