Located: 980 Oak Avenue, Southold. SCTM# 1000-77-1-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy- Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with LWRP. Note that the configurations or lengths of dock structures on adjacent parcels 77.-1-9 (none), 77.-1-8 (994) and 77.-1-7 (958) do not comply with Board permits and should not be considered in any decision. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. § 275-11. Construction and operation standards. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; The application does not correctly show the dock line with proposed dock and vessel on a plan. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig_ ficant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer crust be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. And due to mean high water reaching the bulkheads and thick intertidal marsh grasses growing adjacent to the bulkheading along the surrounding shoreline,the existing environmental conditions do not accommodate public pedestrian pass and repass along the shoreline. Therefore, consistent with Policy 9,the proposed dock would create no changes to or have any adverse impacts on existing navigational conditions or otherwise affect the public and recreational use of Goose Creek. Attach additional sheets if necessary WORKING COAST POLICIES LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR TEAMC99A PROPERTIES, LLC 980 OAK AVENUE SOUTHOLD, NY SCTM#1000-77-1-6 Policy 6 The proposed dock is to be located along a historically developed shoreline amongst numerous Trustees-permitted dock structures, including the adjacent dock to the northeast,which was authorized by Wetlands Permit No. 8430, issued in 2014 and later amended in 2016. The proposed dock is designed with the same structural scope and dimensions seaward of the bulkhead as that dock and the same approved 57'seaward extension into Goose Creek. The dock would thus be positioned in line with the neighboring dock and substantially less than the one- third width of the more than 1,000'wide waterway, as well as more than 15 feet from the laterally extended properly line. And in order to protect the vegetated intertidal marsh beneath it,the catwalk will be elevated 4 feet above the grade of marsh and will be constructed with untreated, open-grate decking. The proposed dock would thus create no changes to or have any adverse impacts on existing navigational conditions or otherwise affect the public and recreational use of Goose Creek; and it would not create a "fragmentation of ecological communities"along the developed shoreline nor result in the physical loss, degradation, or functional loss of ecological components, or otherwise adversely impact the adjacent vegetated tidal wetlands or surface waters of Goose Creek. The project would be consistent in all ways with the "construction and operation standards"for docks set forth by Town Code Section 275-11(C)(2). j i I r i I i t V Policy 10.
