Main Rd. &Youngs Ave.) N • �Q Telephone: 631 765-1938 Southold, NY 11971 COU LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, Assistant Town Planning Director LWRP Coordinator Date: December 6, 2018 Re: LWRP Coastal Consistency Review for MICHAEL MUTSAKIS & EVELYN CAPASSAKIS SCTM# 1000-51-4-16.1 Costello Marine Contracting Corp. on behalf of MICHAEL MUTSAKIS & EVELYN CAPASSAKIS requests a Wetland Permit and a Coastal Erosion Permit to construct a 36' west return onto bulkhead; install 30' of 1,000 to 2,000 pound rock landward of and along the west section of existing bulkhead; fill and regrade face of bluff with approximately 150 cubic yards of clean trucked-in fill; install jute matting down face of bluff in eroded area; and re-vegetate slope with Cape American beach grass. Located: 20985 Soundview Avenue, Southold. SCTM# 1000-51-4-16.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. To further Policy 6, it is recommended that the Board condition that all rocks are trucked in to the site. No rocks located on the beach shall be used in construction. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town of Southold LWRP CONSISTENCY ASSESSMENT FORM LOV 0 2018 Southold Town A. INSTRUCTIONS Planning Board L All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(wluch,includes all of Southold Town). 3: If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. The waterfront properties in this area have endured severe erosion with most properties protected with rock armored, bulkheads and retaining walls Ourproposal is reasonable and consistent with the area. During this past winter's storms the bluff eroded. Our proposal is necessary maintenance needed to prevent further erosion and to maintain the integrity of the bluff. Our proposal is necessary maintenance of the bluff. We will revegetate the bare areas of the bluff to hold the soil and give a more uniform appearance to the area. If the bluff is allowed to further erode the staircase's integrity will be compromised limiting the property owners'ability to access the water. Once the bluff is stabilized, the property owners will gain access to the water and be able to resume their normal water-dependent activities such as kayaking.
