RESOLUTION:
WHEREAS, 27550 Main Road (Route 25), Cutchogue, is on the Town of
Southold's Register of Historic Places, and
WHEREAS, as set forth in Chapter 170 of the Town Law(Landmarks
Preservation Code)of the Town of Southold, all proposals
for material change/alteration must be reviewed and granted
a Certificate of Appropriateness by the Southold Town
Landmarks Preservation Commission prior to the issuance
of a Building Permit, and
WHEREAS, an application has been submitted to make alterations to an
historic building as shown on materials dated September 26,
2006, and
WHEREAS, a public hearing held on October 30, 2006 for the purpose of
considering approval of the-proposal has been concluded,
and
WHEREAS, the Cutchogue-New Suffolk Free Library did not agree to
change the.style of the entrance dormer-as required by the
Commission, additional discussions were held resulting in
the Library agreeing to the recommended dormer on
November 3rd, and
WHEREAS, plans submitted on November 9th showed an unapproved
raised vent along the ridge of the original church building
required additional review-and discussion, and ,

WHEREAS, final plans dated November 14, 2006 reflecting all approved
changes were submitted on November 17, 2006, and
WHEREAS, it appears that the project requires no further review, and
WHEREAS, the Commission has made the following findings offact
concerning,the property and the proposal:
• Constructed in 1862 and added toin1986, the building
retains sufficient integrity to reflect its architectural and
historical significance.
• The purpose of-the.proposal is to create additional
interior space and strengthen the overall structural
integrity of the building.
• The Commissioners made two site visits to the library
and has given as much guidance as possible to the
applicant in-order-for him/them to have a complete
understanding as to what is needed to make the project
approvable.
• The Commissioners are guided by the principle, outlined
in paragraph 170-8 of'the Code, that any alteration to
existing landmarks shall be compatible with-its-historic
design, architecture and appearance, as well as with the
surrounding district. The Commissioners gave careful,
thoughtful, and informed evaluation of the facades as
required-by paragraph,170-263 of the Code.
• In a letter dated September.27, 2006, the Commissioners
listed in detail its concerns with the proposed exterior
changes. The library's Building,Committee,agreed to
accept the Commission's recommendations and-the
architect has revised the plans for the project to reflect
these changes.
• The major recommendation focused on the proposed
arched-dormer over the library's main entrance. As
proposed, it was not compatible with the building's
character and would have had,a substantial adverse.
effect on the historical and architectural significance of
the listed landmark.
• The Commissioners were shown.f nal plans dated.
.November 14, 2006 reflecting an alternate shed-roof
dormer design at its meeting on November 21, 2006
which they indicated was satisfactory.

NOW THEREFORE BE IT RESOLVED that the Southold Town Landmarks
Preservation Commission determines that the revised
drawings dated November 14, 2006 as presented do meet
the-criteria for approval under Chapter 170 of the Town
Code.

We appreciate your interest in helping preserve the historic homes and
buildings in Southold Town. As the owner of a registered Town landmark, you no
doubt agree that they contribute significantly to our architectural heritage and
unique quality of life here on Long Island's historic North Fork.
The mission of the Town's Landmark Preservation Commission, as
outlined in our local preservation law, is to identify and protect landmarks like
your own and insure that alterations to them maintain the architectural integrity of
the exterior of the building as well as being compatible with the general
neighborhood. The local law also covers the demolition or moving of a registered
landmark. Using the code as a guide helps us make decisions in a fair and

The Commission strives to be user-friendly. To that end, a commissioner
will be appointed to guide you through the process of obtaining a Certificate of
Appropriateness (C of A) that is required before a Building Permit can be issued.
The commissioner will contact you soon after your application is received in the
Building Department. He or she will be able to answer your questions and assist
you in executing the forms in this packet and in completing the other require-
ments in the C of A process. Once you have the approved C of A, take it to the
Building Department to complete the Building Permit process.

DRAWINGS and/or SKETCHES: Please submit one (1)set of measured drawings or sketches.
The set should include: Site plan; elevations of all sides that are affected; existing and proposed
floor plans at%" scale; door and window schedule; sample(s) or photo(s) of exterior hardware,
lighting, shutters, etc.; roofing and siding specifications and samples; paint samples/chips (only
when requested).
NOTICE OF DISAPPROVAL from the Building Inspector dated within the last sixty(60)days,
together with copies of permit application and correspondence on file with the Building
Department.
_APPLICATION: Typed or neatly written, signed by the property owner or representative and
notarized. If you have a representative, please provide a signed consent form stating that he/she
is authorized to sign and submit this application.
FLAG OR STAKE outside corners of new construction areas for on-site inspections and provide
photos, as necessary, to identify all areas where new construction or renovation will occur.
FEE SCHEDULE: You will be advised if an application fee is required. If so, a check in the
amount required should be made payable to"Southold Town Clerk" and should accompany the
application for the Certificate of Appropriateness.
LANDMARKS PRESERVATION COMMISSION REVIEW: A Commissioner will be assigned to
assist you with completing the requirements for the C of A. The Commissioner will contact you
soon after you receive the Notice of Disapproval from the Building Department. After the
Landmarks Preservation Commission has reviewed the application and set the date for a public
hearing, we will confirm the date, time and place of the hearing.Also provided will be a letter with
the Town's legal notice (a yellow sign)that must be posted; an area map showing the
surrounding lots (circled)that will require a certified letter from you announcing the public hearing;
and Affidavit Forms for your use in the final notice steps.
ANY CHANGES MADE AFTER THE APPLICATION/S SUBMITTED MUST BE PLACED IN
WRITING. REVISED DRAWINGS CLARIFYING THE CHANGES ALSO MUST BE
SUBMITTED. Changes may also require an amended Notice of Disapproval and certain other
documents.

The proposed additions and alterations to an existinglibrary ibrary building on this non-conforming 32,670
ware foot lot in the Residential R-40 District is not permitted pursuant to Article XXIV Section 100-
242A, which states;
"Nothing in this article shall be deemed to prevent the remodeling, reconstruction or
enlargement of a non-conforming building containing a conforming use,provided that such
action does not create any new non-conformance or increase the degree of non-conformance
with regard to the regulations pertaining to such buildings_"
Article III Section 100-244 states that nonconforming lots measuring between 20,000 and 39,999
square feet in total size require a rear yard setback of 40 feet. Currently, the library building is noted as
being+/- 19 feet. The proposed construction maintains that setback.
Pursuant to the ZBA's interpretation in Walz (#5309), such additions and alterations will thus
constitute an increase in the degree of nonconformance.
Furthermore the proposed construction is not permitted without review and approval by the Southold
Town Landmarks Preservation Commission,because the property is listed on either the Southold
Town New York State and/or the National Registers of Historic Places and requires review by the
Southold Town Landmarks Preservation Commission.
If the requirements of the town code,pertaining to Landmarks (Local Law No. 22) are met, a
Certificate of Appropriateness (C of A) will be issued. The C of A is required before a BuildingPermit
will be approved. Information about the requirements for app13Lng for a C of A is available at the
information counter in the Building Department.

Dear Ray,
Thank you for taking the time to present the plans for the Cutchogue-New Suffolk Free
Library project to the Southold Town Landmarks Preservation Commission. It is obvious
to all of us that you devoted considerable time and expertise to solving the challenges that
a landmark project can present.
With that said, there are some aspects of the project that trouble us and we would like you
to reconsider them. Our concerns arise from our obligation to maintain the character,
scale, and simplicity of the landmark structure.
We believe that the attempt to re-use the stone from the foundation to create a four-foot
wide base will negatively impact the simple planes of the facade. Additionally, the Main
Road facade, stairs and rails, will be adversely affected. If using the stone as a veneer is
out of the question,we would suggest exposing the new concrete foundation,possibly
using tinted concrete with Stamperete forms, etc. We will have to approve the material,
so please indicate it on your plans. In this case, substituting a material is preferable to
creating the new base structure. Hopefully, the original stone will find another use in the
proj ect.
We would also like you to consider moving both the mechanical systems and egress
staircase from the South to the North side of the church, again to maintain the simplicity
and scale of the facade. We have determined that this will not violate any zoning rules
and will not require any additional approvals from the Southold Town Zoning Board of
Appeals.
Thirdly,we would like you to consider simplifying or deleting the dormers that will be
visible from Cases Lane. The dormer over the entrance is stylistically inconsistent with
the landmark structure. Its location next to the proposed perpendicular dormer creates a
very choppy roof plane, dramatically different in scale from the original.

The Commission was concerned about the discrepancies between the plans,models and
presentation, but we understand that this was probably a result of the project's evolution.
We also missed having a roof plan. Once we receive the final plan addressing our
concerns,we can move ahead with scheduling a date for a hearing.
In the meantime, if you have any questions,please contact Damon Rallis (765-1802) in
the Southold Town Building Department and he will put you in touch with Barbara
Schnitzler, AIA; your commission representative.

Members of the Commission:
The Board of Trustees of the Cutchogue-New Suffolk Free Library requests the Landmark
Preservation Committee to issue a Certificate of Appropriateness for the renovations to the
Library in accord with the design as originally submitted(with the exception of those changes
previously agreed to by the Board of Trustees and the Commission).
This request reflects the position of the Board of Trustees and is made to keep faith with what is
perceived to be the prevailing opinion of the Cutchogue and New Suffolk communities. The
design was implicitly endorsed by the residents of Cutchogue and New Suffolk when they
approved funding for the renovation by an overwhelming(though not universal)majority.
From the first day of planning,the Board of Trustees has been conscious of and sensitive to the
landmark status of the building that houses the Library. We recognize and value the historic
character of neighboring properties. It has been and remains our goal to meet the Library's need
for additional space in a manner that is not only compatible with, but which enhances the historic
architectural and cultural heritage of the area. We have striven for a renovation which is similar
to and complements the design, architecture, and appearance of the existing building. In our
opinion,the original design achieves these ends. Based on the referendum vote and on the
majority of comments by patrons and visitors to the Library before and since the vote,we believe
the consensus of community opinion agrees with us that we have achieved these goals. We were
disappointed and somewhat surprised that the Commission of Landmark Preservation did not
agree. We appreciate that the Commission has taken the time to meet with us in an effort to
minimize areas of disagreement, and indeed,voice its preference for an alternative design.
Time constraints imposed by a rapidly approaching winter,which could delay the start of
construction, and an application deadline,which if missed would cost the Library the benefit of
substantial state grant monies, initially prompted the Board to agree to the alternative"shed type"
entrance dormer preferred by the Commission. It was hoped that by doing so,the process of
obtaining a Certificate of Appropriateness would be expedited. Before doing so,however, it was
thought prudent and proper to further explore the sense of the community. Two portraits were
mounted in the Library foyer depicting the entrance dormer as originally designed and as it would
appear with a shed roof. Comments were invited.

Although admittedly not a scientific sampling of community opinion,the results,we think,are
telling. Of the 33 written comments(see attached),fully 28 clearly preferred the original design.
Only three firmly favored a shed dormer. Should this be dispositive of the issue? Perhaps not,
but it merits consideration and should be weighed in the balance. While many of the comments
reflect careful,thoughtful, and informed evaluations,they are at end just opinions,just as the
position of the Board of Trustees is an opinion,just as the preference of the Commission is an
opinion.
We recognize the duty of the Commission is not always an easy one; sometimes, it is a difficult
and a delicate one. It would be easy if the design was,to all,clearly incompatible with the
landmark building or was overtly hostile to neighboring properties.This is not the case here. The
comments attached suggest a depth of considered opinion in the community,which confirms that
this is not the case.
Because your decision must always turn on subjective views,your task is difficult when the issue
is close. When it is very close, as we believe it is here, it is a delicate task,as well. When
reasonable men and women disagree,finding the right balance is a delicate task. We believe the
measured opinion of the community merits consideration, and in this case, should be sufficient to
tip the balance in favor of the applicant's request for a Certificate of Appropriateness based on a
design including the entrance dormer as originally proposed.
