NOW THEREFORE BE IT RESOLVED, that the Southold Town Landmarks Preservation Commission determines that the proposal as outlined in plans dated March 21, 2012 meet the criteria for approval under Section 56-7 (b) of the Southold Town Code. BE IT FURTHER RESOLVED, that the Commission unanimously approves the request for a Certificate of Appropriateness. Please note that any deviation from the approved plans referenced above may require further review from the commission. The two issues we discussed are remedied thus: 1. The ceiling height in the converted attic (as new second floor)is now 7'-0" for more than 50%of the floor area. This was achieved (without lessening the roof slope from 2:12 ratio)by elevating the existing ridge height by 8". It is still well below the maximum allowed height of 35'-0". Also, the minimum height of the interior walls is now 5'-0". ' 2. The east elevation window at the 2nd story level is clarified as meeting the opening requirements for egress, and an operable door has been provided in the screened enclosure at the upper Level, also for egress reasons. hope these modifications satisfy the requirements for compliance. Please let me know if you have any additional comments. PROPERTY FACTS/DESCRIPTION: The applicants' 13,875 sq. ft. lot has 130 feet along-Village Lane, 118.20 feet along the northerly property line, 140.45 feet along the southerly side property line, and 90 feet at the rear line. The lot is improved with a one-story frame house and accessory garage building, as shown on the June 5, 2001 survey prepared by Peconic Surveyors, P.C., amended May 4, 2004. BASIS OF APPLICATION: Building Department's September 10, 2004 Notice of Disapproval, citing Section 100-33 in its denial of a building permit application concerning construction of a proposed swimming (lap) pool. The reason stated in the disapproval is for a side yard location, rather than a rear yard location. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 16, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 12 ft. by 55 ft. lap pool along the side of the existing dwelling, in the northerly side yard. The pool is proposed at least 40 feet from the front property line and seven (7) feet from the side lot line, as shown on the survey prepared by Peconic Surveyors, P.C. amended December 16, 2004. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The appli'cant's home is centered on the lot. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The rear yard of the property contains an accessory garage and a sanitary system. 3. The amount of relief requested to locate a lap pool structure in a side yard at least 10 feet from the side property line is the maximum relief the board would approve. 4. The difficulty has not been self-created and is related to the location of the existing sanitary system in the rear yard and garage in the rear yard. To move these structures would be very costly and would require other types of variance applications before agencies. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory lap pool structure,while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. The Impact of Alternative Energy on the Landmark Commission: The job of the Landmark Commission in this era of green technology and design remains the same as it always has been: manage change within our community while protecting historic character. As a commission we must consider the following issues: 1. .New technology must be incorporated into historic buildings to keep them viable. . 2. New technology can be incorporated into historic buildings sensitively. 3. The Landmark Commission must be prepared to address Certificate of Appropriateness applications dealing with new technologies on a case by case basis. Characteristic Style: Alternative energy: Current preservation philosophy revolves around the concept that the greenest r building is the one already built, it embraces the ides of embodied energy. Every effort should be made to use the buildings existing materials, repair and restoration rather than replacement of structure and windows. A restored old window when properly weatherstripped and with an appropriately installed storm window is just as efficient as a new window. Along with the green building concept the Landmark Commission will consider proposed sustainable energy systems such as solar or wind power. Solar Panels: The Landmark Commission will ask property owners to consider alternative locations, such as locating panels on the lot rather than the building, at an ancillary building, or on less prominent roof slopes tan that associated with the main elevations. Their installation should not cause damage or loss to historic materials, and should be entirely reversible: These systems are technologically evolving rapidly and a smaller and much less intrusive system may be on the market in a relatively short time. The landmark Commission will consider these systems on a case by case basis. r r Wind Turbines: Most large wind turbine systems are installed as a free standing structure and are not considered an alteration to a designated structure. However a locally designated scenic viewshed or historic building setting may be impacted. We may ask for alternative locations or the project to be downsized to remove the most egregious visual impacts. The Landmark Commission will consider the installations on a case by case basis. The last major objection of the Commission related to the proposed new dormer windows and how they complimented the Craftsman style of the existing house; the commission felt that the massing and particular language of the dormers fell short of following the language of the style. In response, I have revised the massing and particular form of the proposed dormers: 1.On both the north and south facing roof slopes, the dormers are now symmetrical to the existing central gables. 2. On the south side, they are massed as two horizontal volumes of awning windows which project forward from a blank midsection that encloses the upper stair hall volume (into which the top of the existing gable would die). The projections will be treated with extended eaves and exposed rafter tails, while the middle section, set back from the two side sections, will be treated simply with cedar siding and no roof overhang. In this way, the forms will read as two shed-type dormer windows symmetrically placed about the central gabled porch, rather than as a long dormer that is only partially fenestrated (this was the specific concern of the LPC over the last design). 3. On the north side, a single smaller dormer is placed on center with the first story gable to provide a clerestory window for the proposed second floor bathroom. It will be detailed in similar fashion, with extended eaves and exposed rafter tails. I hope that you will agree that the new design succeeds in more appropriately following the language and formalism of the existing house.
