RESOLUTION:
WHEREAS, 195 Village Lane, Orient, NY is on the Town of Southold,
New York State and National Registers of Historic Places,
and
WHEREAS, as set forth in Section 56-7 (b) of the Town Law(Landmarks
Preservation Code) of the Town of Southold, all proposals
for material change/alteration must be reviewed and granted
a Certificate of Appropriateness by the Southold Town
Landmarks Preservation Commission prior to the issuance
of a Building Permit, and
WHEREAS, an application has been submitted'to make alterations to an
existing single family dwelling as shown on plans and related
materials last dated March 21, 2012 and
WHEREAS Commissioners made multiple site visits to inspect the
proposed project, and
WHEREAS, a public hearing for the purpose of considering approval of
the proposal was held on October 18, 2011 and
WHEREAS, it appears that the project requires no further review.
NOW THEREFORE BE IT RESOLVED, that the Southold Town Landmarks
Preservation Commission determines that the proposal as outlined in plans dated
March 21, 2012 meet the criteria for approval under Section 56-7 (b) of the
Southold Town Code.
BE IT FURTHER RESOLVED, that the Commission unanimously approves the
request for a Certificate of Appropriateness.
Please note that any deviation from the approved plans referenced above
may require further review from the commission.

Dear Mr. Verity:
After a review of my drawings submitted earlier this year, we met to discuss two
issues that I feel are now remedied in a revised design that I have enclosed
herewith. The two issues we discussed are remedied thus:
1. The ceiling height in the converted attic (as new second floor)is
now 7'-0" for more than 50%of the floor area. This was
achieved (without lessening the roof slope from 2:12 ratio)by
elevating the existing ridge height by 8". It is still well below
the maximum allowed height of 35'-0". Also, the minimum
height of the interior walls is now 5'-0". '
2. The east elevation window at the 2nd story level is clarified as
meeting the opening requirements for egress, and an operable
door has been provided in the screened enclosure at the upper
Level, also for egress reasons.
hope these modifications satisfy the requirements for compliance. Please let me
know if you have any additional comments. I would like to move on to the
Landmarks Committee approval process and then to apply for a formal building
permit so the Owner can proceed with the work. Thanks for your help.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property,under consideration in this application and
determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County,
Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating that this
application,is considered a matter for local determination as there appears to be no significant county-wide or inter-community
impact.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 13,875 sq.ft. lot in the Residential R-40 District
with 130 ft.of frontage on Village Lane, 140.45 feet on the southerly side yard, and 118.20 feet on the northerly side yard. It is
improved with a single-family, one-story dwelling, 413 square foot accessory garage, and 600 square foot lap pool, as,shown
on the December 1,2008 survey prepared by Peconic Surveyors, P.C.
BASIS OF APPLICATION: Requests for Variances under Section 280-124, based on the Building Inspector's January 14,2009
revised Notice of Disapproval conceming a proposed rear screen porch addition to the existing dwelling,which construction will
result in a rear yard setba6k at less than the code required minimum of 35 feet and,lot coverage exceeding the code limitation
of 20%.
RELIEF REQUESTED: The applicant proposes�to add 140 square foot ground floor and second-story covered screened porch
construction measuring 5 feet x 28.4 feet. The proposed screened porch addition has a 31 ft. rear yard setback at the nearest
point where the code requi`�es 35 feet. This new construction will increase the current non-conforming lot coverage from 21.6%
to 22.7%,as shown on t4plot plan by Bruce McGregor Goble,Architect,dated September 30,,2008.
ADDITIONAL INFORMATION: The subject property is listed on either the Southold Town„ New York State and/or National
Registers of Historic Places and,as such,•the proposed additions and alterations are not permitted without review and approval
by,the Southold Town Landmarks Preservation Commission and the issuance of a certificate of Appropriateness before a
Building Permit will be approved.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the
Board makes the following-findings:
1. Town Law 4267-b(3)(b)(31(1). Grant of these variances will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The applicants' rear yard is completely enclosed by mature evergreen
plantings and is not visible from any adjoining properties or the street. The proposed uses of these screened porches for
sleeping and sitting are both seasonal in nature and will cause no disruption to the neighborhood.

2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicants to pursue,other than an area variance, because five feet is the minimal depth necessary to build a functional porch.
3. Town Law§267-b(3)(6)(3). The variances granted herein are not substantial. The current rear yard setback of the existing
.dwelling-is s36 feet-The proposed screen porch additions are only 5 feet deep and will decrease the rear yard setback to 31.1

virtually no conforming setback location to construct an addition in the rear yard.
5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood. The site is flat, and the land
disturbance caused by the,.proposed additions will be minimal.
6..Town Law U67-b(3). Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of screened porches, while preserving and protecting the character of the neighborhood and the health, safety
and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town
Law 267-B, motion was offered by Member Weisman,seconded by Member Schneider,and duly carried,to
GRANT the variance as applied for, and shown on the plot plan and architectural drawings prepared by Blake McGregor Goble,
Architect September 30,2008 and labeled TP1.0,71.1,A0.0,A1.0,A1.1;A1.2,A3.0,A3.1,subject to the following Conditions:
1. The screened porches shall remain seasonal in use,and shall not be heated or enclosed with windows.
2. The proposed addition shall be fitted with gutters and leaders to discharge roof runoff into a drywell.
That the above conditionsbe written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or
survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action
does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the
Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action.

The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase
the degree of nonconformity.

MEETING OF DECEMBER 29, 2004

Property Location: 195 Village Lane, Orient; CTM 18-5-8
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions,without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicants' 13,875 sq. ft. lot has 130 feet along-Village
Lane, 118.20 feet along the northerly property line, 140.45 feet along the southerly side property
line, and 90 feet at the rear line. The lot is improved with a one-story frame house and accessory
garage building, as shown on the June 5, 2001 survey prepared by Peconic Surveyors, P.C.,
amended May 4, 2004.
BASIS OF APPLICATION: Building Department's September 10, 2004 Notice of Disapproval, citing
Section 100-33 in its denial of a building permit application concerning construction of a proposed
swimming (lap) pool. The reason stated in the disapproval is for a side yard location, rather than a
rear yard location.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on December 16, 2004 at
which time written and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following facts to
be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 12 ft. by 55 ft. lap pool
along the side of the existing dwelling, in the northerly side yard. The pool is proposed at least 40
feet from the front property line and seven (7) feet from the side lot line, as shown on the survey
prepared by Peconic Surveyors, P.C. amended December 16, 2004.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of alternative relief will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The appli'cant's home is centered on the lot.

Most of the rear yard is occupied by an accessory garage building and a sanitary system. The lap
pool construction is proposed within a fence enclosure along the northerly yard, near the house, and
at least 40 feet from the front line along the street. No objections or concerns were raised at the
December 16, 2004 public hearing concerning this proposed location.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The rear yard of the property contains an
accessory garage and a sanitary system.
3. The amount of relief requested to locate a lap pool structure in a side yard at least 10 feet from
the side property line is the maximum relief the board would approve.
4. The difficulty has not been self-created and is related to the location of the existing sanitary
system in the rear yard and garage in the rear yard. To move these structures would be very costly
and would require other types of variance applications before agencies.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an accessory lap pool structure,while preserving and protecting the
character of the neighborhood and the health,safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-13, motion was offered by Member Goehringer, seconded by
Member Orlando, and duly carded, to
DENY the variance as applied for with respect to the proposed 7 ft. side yard setback, and to
GRANT alternative relief with a minimum side yard setback at 10 feet, SUBJECT TO THE
FOLLOWING CONDITION:
That screening be placed on the north side.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly

The following information was excerpted from a New York State Historic Preservation
Field Services Bureau publication.
The Impact of Alternative Energy on the Landmark Commission:
The job of the Landmark Commission in this era of green technology and design
remains the same as it always has been: manage change within our community while
protecting historic character.
As a commission we must consider the following issues:
1. .New technology must be incorporated into historic buildings to keep them
viable.
. 2. New technology can be incorporated into historic buildings sensitively.
3. The Landmark Commission must be prepared to address Certificate of
Appropriateness applications dealing with new technologies on a case by case
basis.
Characteristic Style:
Alternative energy:
Current preservation philosophy revolves around the concept that the greenest
r building is the one already built, it embraces the ides of embodied energy. Every
effort should be made to use the buildings existing materials, repair and restoration
rather than replacement of structure and windows. A restored old window when
properly weatherstripped and with an appropriately installed storm window is just
as efficient as a new window.
Along with the green building concept the Landmark Commission will consider
proposed sustainable energy systems such as solar or wind power.
Solar Panels: The Landmark Commission will ask property owners to consider
alternative locations, such as locating panels on the lot rather than the building, at an
ancillary building, or on less prominent roof slopes tan that associated with the main
elevations. Their installation should not cause damage or loss to historic materials,
and should be entirely reversible: These systems are technologically evolving
rapidly and a smaller and much less intrusive system may be on the market in a
relatively short time.
The landmark Commission will consider these systems on a case by case
basis.

Wind Turbines: Most large wind turbine systems are installed as a free standing
structure and are not considered an alteration to a designated structure. However a
locally designated scenic viewshed or historic building setting may be impacted. We
may ask for alternative locations or the project to be downsized to remove the most
egregious visual impacts.
The Landmark Commission will consider the installations on a case by case
basis.

INSTRUCTIONS FOR APPLICATION FOR PARTIAL EXEMPTION FOR
ALTERATION OR REHABILITATION OF HISTORIC REAL PROPERTY
Authorization for exemption: Section 444-a of the Real Property Tax Law authorizes a partial exemption from
real property taxation for the alteration or rehabilitation of historic property. Counties, cities, towns, and villages
may enact local laws authorizing the exemption; school districts may do so by resolution. Municipalities
authorizing the exemption may limit eligibility to forms of alteration or rehabilitation prescribed in the local law or
resolution.
Criteria for exemption: Assuming local authorization for the exemption, to qualify, (1) the improved property
must be designated as a landmark or be property which contributes to the character of a locally created historic
district; (2) the alteration or rehabilitation must be made for purposes of historic preservation; (3) the alteration or
rehabilitation must satisfy local guidelines and review standards in the local preservation law; (4) prior to the
commencement of the alteration or rehabilitation, such change must be approved by the local preservation
commission; and (5) the alteration or rehabilitation must be commenced after adoption of the local law resolution
authorizing the exemption. Landmark designation, if any, and approval from the local preservation commission
must be attached to the application.
Duration and computation of exemption: Generally, the amount of the exemption in the fust year is 100% of the
increase in the value attributable to the alteration or rehabilitation. The amount of the exemption remains the same
for years two through five; thereafter the exemption is phased out over the next four years (that is, in year six, the
exemption is 80 percent of the increase in value; then 60 percent-in year seven, and so on). Municipalities
authorizing the exemption,however,may reduce the percentages of exemption.
Place of filing application:
Application for exemption from city, town, or village taxes must be filed with the city, town, or village assessor.
Application for exemption from county or school district taxes must be filed with the city or town assessor who
prepares the assessment roll used to levy county or school taxes. In Nassau County,applications must be filed with

Dear Landmarks Prese'rration Commissioners:
It has been some time since I've had any interaction with the LPC and I'd like to
provide a review of the approval process as I understand it to accompany the
revised design you will be considering.
The last major objection of the Commission related to the proposed new dormer
windows and how they complimented the Craftsman style of the existing house;
the commission felt that the massing and particular language of the dormers fell
short of following the language of the style. In response, I have revised the
massing and particular form of the proposed dormers:
1.On both the north and south facing roof slopes, the dormers are now
symmetrical to the existing central gables.
2. On the south side, they are massed as two horizontal volumes of awning
windows which project forward from a blank midsection that encloses the
upper stair hall volume (into which the top of the existing gable would die).
The projections will be treated with extended eaves and exposed rafter tails,
while the middle section, set back from the two side sections, will be treated
simply with cedar siding and no roof overhang. In this way, the forms will read
as two shed-type dormer windows symmetrically placed about the central
gabled porch, rather than as a long dormer that is only partially fenestrated
(this was the specific concern of the LPC over the last design).
3. On the north side, a single smaller dormer is placed on center with the first
story gable to provide a clerestory window for the proposed second floor
bathroom. It will be detailed in similar fashion, with extended eaves and
exposed rafter tails.
I hope that you will agree that the new design succeeds in more appropriately
following the language and formalism of the existing house. I welcome any and all
feedback and hopefully we can soon arrive at a design that both accommodates
the programmatic needs of the Owner as well as achieve the best aesthetic
