NOW THEREFORE BE IT RESOLVED,that the Southold Town Historic Preservation Commission determines that all"as built"and proposed work detailed in photos dated March 7, 2016 and plans dated May 26, 2016 by architect Mark Schwartz meet the criteria for approval under Section 170-8 (A)of the Southold Town Code and, BE IT FURTHER RESOLVED,that the Commission approves the request for a Certificate of Appropriateness. WHEREAS, a building permit was issued for interior alterations at 335 Village Lane, Orient, and WHEREAS, the property is a landmark within a historic district,and is therefore under the jurisdiction of the Southold Town Historic Preservation Commission,and - ------—WHEREAS;---the-applicant made-a-permit amendment request to-the building-department-to--- allow uilding-department to---allow for window replacements on the fapade of the structure, and WHEREAS, an administrative permit was issued on April 19, 2016 allowing the applicant to replace the windows"in kind"and a public hearing was scheduled to address "as built"exterior work, done without the benefit of a required Certificate of Appropriateness,and WHEREAS, the applicant failed to appear with amended plans before the Historic Preservation Commission and it was brought to the attention of the commission that the windows had been replaced outside of the scope of the administrative permit, and WHEREAS, Chapter 170 of the Southold Town Code requires approval from the Historic Preservation Commission,and is therefore in violation of Southold Town Code. NOW THEREFORE BE IT RESOLVED that the Historic Preservation Commission hereby rescinds the Administrative Permit issued on April 19,2016 (RESOLUTION 4.19.16.1), and BE IT FURTHER RESOLVED that the Historic Preservation Commission authorizes and requests that the Southold Town Building Department hereby issues a"stop work order"to the owners of 335 Village Lane in Orient.
