RE: 335 Village Lane, Orient, SCTM# 1000-25.-24.13

RESOLUTION:
WHEREAS, 335 Village lane, Orient,NY is on the Town of Southold,New York State and
National Registers of Historic Places, and
WHEREAS, as set forth in Section 56-7 (b)of the Town Law(Landmarks Preservation Code)
of the Town of Southold, all proposals for material change/alteration must be
reviewed and granted a Certificate of Appropriateness by the Southold Town
Landmarks Preservation Commission prior to the issuance of a Building Permit,
and
WHEREAS, an application was submitted to replace windows and an existing bluestone stoop,
as well as legalize an"as built"roof line change and an"as built"wood door
replacement on the existing single family dwelling, and
WHEREAS, the applicant's representatives presented this proposal to the commissioners at a
pre-submission conference on April 19, 2016 and,
WHEREAS, the"in kind"window replacement was approved through an administrative
permit on April 19, 2016 and,
WHEREAS, the administrative permit was rescinded on May 17,2016 and a stop work order
issued by the Building Department on May 20, when it was determined that the
windows were not replaced in kind and,
WHEREAS, a public hearing for all construction was held on June 21, 2016, and
WHEREAS, the applicant testified that the windows were Andersen 400 Series Insert
Windows with Simulated Divided Light exterior-grilles and the wood door was
replaced in kind.
NOW THEREFORE BE IT RESOLVED,that the Southold Town Historic Preservation
Commission determines that all"as built"and proposed work detailed in photos dated March 7,
2016 and plans dated May 26, 2016 by architect Mark Schwartz meet the criteria for approval
under Section 170-8 (A)of the Southold Town Code and,
BE IT FURTHER RESOLVED,that the Commission approves the request for a Certificate of
Appropriateness.

Rescind Administrative Permit
Authorize and Request the Building Department to Issue a Stop Work Order
RESOLUTION: Authorize and request that the building department to issue a stop work order to
the owners of 335 Village Lane, Orient.
WHEREAS, a building permit was issued for interior alterations at 335 Village Lane, Orient,
and
WHEREAS, the property is a landmark within a historic district,and is therefore under the
jurisdiction of the Southold Town Historic Preservation Commission,and
- ------—WHEREAS;---the-applicant made-a-permit amendment request to-the building-department-to---
allow
uilding-department to---allow for window replacements on the fapade of the structure, and
WHEREAS, an administrative permit was issued on April 19, 2016 allowing the applicant to
replace the windows"in kind"and a public hearing was scheduled to address
"as built"exterior work, done without the benefit of a required Certificate of
Appropriateness,and
WHEREAS, the applicant failed to appear with amended plans before the Historic
Preservation Commission and it was brought to the attention of the commission
that the windows had been replaced outside of the scope of the administrative
permit, and
WHEREAS, Chapter 170 of the Southold Town Code requires approval from the Historic
Preservation Commission,and is therefore in violation of Southold Town
Code.
NOW THEREFORE BE IT RESOLVED that the Historic Preservation Commission hereby
rescinds the Administrative Permit issued on April 19,2016 (RESOLUTION 4.19.16.1), and
BE IT FURTHER RESOLVED that the Historic Preservation Commission authorizes and
requests that the Southold Town Building Department hereby issues a"stop work order"to the
owners of 335 Village Lane in Orient.

Preservation Commission sets a public hearing regarding the application of Keith Kane. Request
for a Certificate of Appropriateness under Section 170-7 (b) of the Southold Town Code,
concerning proposed additions and alterations to a registered landmark structure at 335 Village
Lane, Orient, SCTM—25.-2-4.13 at 3:45 p.m. on Tuesday, May 17, 2016 in the Southold Town

I have been to the site and reviewed the existing windows of the front (west) elevation. The Owners
plan to replace the front windows with white Andersen units with matching divided lites pattern. The
front door will remain. The existing window trim, shutters and the house painted wood siding will
remain.
The first floor existing double hung windows are 33.8" wide x 67'high.
The first floor proposed double hung windows are 33.625" wide x 65.375" high
The second floor existing double hung windows are 33.8" wide x 58"high.
The second floor proposed double hung windows are 33.625"wide x 57.5" high
