Located: 1175 Waterview Drive, Southold. SCTM# 1000- 78-7-15 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The dock structure was constructed without the benefit of the Board of Trustees review and a Wetlands Permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Town of Southold LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS JAN 0 8 '1U116 Southold Town 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for Planning Board proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes",then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus,the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. A copy of the LWRP is available in the following places: online at the Town of Southold's website (southoldtown.northfork.net),the Board of Trustees Office,the Planning Department, all local libraries and the Town Clerk's office. The existing structure measures 78.0'±in overall length and consists of the following: FIXED ELEVATED CATWALK measuring 4.0' Wide x 48.0' Long, supported by six(6)posts(6" x 6"), and including top decking of an open grate design; HINGED RAMP measuring 3.0' Wide x 14.0' Long; and FLOATING DOCK measuring 6.0' Wide x 20.0' Long, and secured by two (2) pilings (6.0" dia.. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure,makes beneficial use of a coastal location,and minimizes adverse effects of development. See LWRP Section III—Policies;Page 2 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable Subject proposal is consistent with the policy in that the siting/utilization of the reconstructed dock assembly maintains the character of the surrounding neighborhood, which currently consists of many similarly-improved residential lots with similar accessory structures (i.e. dock assemblies) In addition, the reconstructed dock will be in harmony with the"...beneficial use of a coastal location..." in that the legally created residential waterfront O.e coastal) lot is enhanced by the reconstructed dock assembly in order to maintain access to the contiguous surface waters Accordingly, we believe that this project is consistent with this policy. See LWRP Section III—Policies Pages 5 through 7 for evaluation criteria, ® Yes ❑ No ❑ Not Applicable Subiect proposal will not adversely impact the visual quality of the surrounding area in that the surrounding area is currently comprised of properties improved with similar appurtenances (i e. dock assemblies) of similar size and scope. Scenic resources, assumedly views of Goose Creek, are not at risk due to the reconstructed dock assembly being typical of the character,of this section of waterfront. Accordingly, this proposal will comply with Policy 3. - Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion.
