Michael Kimack on behalf of JOHN AND KORI ESTRADA request a Transfer of Wetland Permit#4096 from David B. Tuthill to John and Kori Estrada as issued on December 10, 1992, and Amended on June 1, 1993; and for an Amendment to Wetland Permit#4096 to construct a 4'x8' fixed dock extension using Thru-Flow decking and two (2) 8" diameter dock pilings onto the seaward end of existing fixed dock for a new total length of 58'; reconfigure existing floating dock to an "L" shape configuration; relocate the existing two sets of floating dock securing two- batter pilings; and install one 8"-10" tie-off piling approximately 15' to the west from the new floating dock location. Located: 2350 Deep Hole Drive, Mattituck. SCTM# 1000-123-4-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. 1. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems. Policy 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met: The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion, Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel as proposed. The dimensions of a vessel were provided on a Google Earth photo with the current dock configuration. The applicant has not correctly demonstrated that the dock meets the 1/3 rule and is consistent with "pier" line of the water body. A Google Earth map was provided but does not show the total proposed dock length in relation to the distance of the other side of the waterbody or pier line. A discussion on the potential impacts (if any) to navigation of all vessels have not been provided. It is recommended the navigation channel in relation to the proposed dock is assessed. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities, The application does not discuss the potential impediments/impacts regarding public use. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and The application does not discuss cumulative impacts to the waterway or environment. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. The applicant currently enjoys access to public waters via an existing dock structure.
