FISH AND WILDLIFE HABITAT AND PECONIC ESTUARY PROGRAM CRITICAL HABITAT.
J.M.O. Environmental Consulting on behalf of CHARLES & BRENDA GRIMES requests a
Wetland Permit to construct a 15'x24' bluestone patio on sand; stepping stone paths; 4'x6'
steps; a 4'x158' fixed dock utilizing "Thru-Flow" decking; a 3'x12' ramp; and a 6'x20'float
secured by two (2) piles. Located: 4145 Wells Road, Peconic. SCTM# 1000-86-2-12.6
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action to construct a 4'x158' fixed dock utilizing "Thru-Flow" decking; a
3'x12' ramp; and a 6'x20' float secured by two (2) piles is INCONSISTENT with the
denoted following Policy Standards and therefore is INCONSISTENT with the LWRP.
1. Policy 1. Foster a pattern of development in the Town of Southold that enhances
community character,preserves open space, makes efficient use of infrastructure,

makes beneficial use of a coastal location, and minimizes adverse effects of
development.
The proposed structure is for private recreational use and will not preserve "public" open
space. The applicant has not demonstrated that the action would minimize effects of
development.
2. Policy 3. Enhance visual quality and protect scenic resources throughout the Town
of Southold.

The intent of this policy is to protect and enhance the visual quality of the Town of Southold
as well as to improve the quality of deteriorated areas and other negative visual elements.
The preservation of the aesthetic, historic, and scenic character of the Town is critical to the
continuance of its attraction and economic vitality as a year-round waterfront community.

Policy 3.1 Enhance visual quality and protect scenic resources throughout the Town of
Southold including.
A. Minimize the introduction of structural design components (including utility lines,
lighting, signage and fencing) which would be discordant with existing natural scenic
components and character,
The action does not meet this policy; conversely, the applicant proposes a 190' long
dock structure that could affect the scenic quality of the area. The subject property is
located approximately 669' east of the Wells Road end that provides water access to
Richmond Creek (Figure 1).

J. Protect visual quality associated with public lands, including public transportation
routes, public parks and public trust lands and waters.

1. Limit water surface coverage or intrusion to the minimum amount
necessary.
-The proposed dock structure does not limit coverage of public trust
waters to the minimum amount necessary to access the waterbody for the
purpose of recreational enjoyment (swimming, fishing, launching of
watercraft from shore).
2. Limit alteration of shoreline elements which contribute to scenic quality.

Open, unobstructed water views provide scenic qualities to the public and
user groups. The visual quality of natural resources (salt marsh) and
open waters may be impaired as a result of the 190' long dock structure.
3. Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystems.
Certain natural resources that are important for their contribution to the quality and biological
diversity of the Town's ecosystem have been specifically identified by the State of New York
and Town of Southold for protection. These natural resources include regulated tidal
wetlands designated as Significant Coastal Fish and Wildlife Habitats. The proposed action
is located within a tidal wetland which contains high ecological functions and values. It is
expected that physical loss and degradation of ecological components will occur as a result
of this action. Cumulative functional and degradation impacts to habitats from structures
placed in public waters are a concern.

The proposed construction practices 'of the dock have not been identified. It is
recommended that the applicant identify the proposed construction practices. Activities
during dock construction can destroy vegetation either above or below the tide line by
pulling them from the substrate or destroying their root system. The peat beds underlying
salt marshes can also be compacted through the improper use of heavy equipment.
In sea grass beds, the installation of pilings may have immediate impacts as well as cause
long-term changes. Installation through "jetting"with high-pressure hoses typically disturbs
a surrounding area-- depopulating grasses there prior to construction. Once areas are
depopulated, the presence of pilings may, lessen chances of regrowth. Beal, Schmit, and
Williams (1999) suggest that changes in sea grass communities in the vicinity of pilings may
be caused by the modification of currents, sediment deposition, attraction of bioturbators,
and leaching from chemically treated wood . The installation of dock pilings impact marine
ecosystems. j

Both marsh grasses and sea grasses have adapted to living in extended periods of sunlight.
Their photosynthetic pathways vary from!many terrestrial plants allowing them to be highly
productive in their natural settings. Shading can have significant impacts on the health and

productivity of these plants. The applicant is proposing "Thru Flow" decking and therefore
shading impacts to vegetation should be minimized.
Policy 6.1 Protect and restore ecological quality throughout the Town of Southold.
The proposed action is located within a RICHMOND CREEK IS A NEW YORK STATE
DEPARTMENT OF ENVIRONMENTAL CONSERVATION CRITICAL ENVIRONMENTAL
AREA (Figure 2). A NEW YORK STATE SIGNIFICANT FISH AND WILDLIFE HABITAT
(See attached narrative). AND PECONIC ESTUARY PROGRAM CRITICAL HABITAT.
The application does not discuss the potential impacts to natural resources.

The proposed action does not propose a restoration plan of areas that may be impacted (if
any) during construction.
Policy 6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats.
A. Protect Significant Coastal Fish and Wildlife Habitat values from uses or activities
that would.
1. Destroy habitat values associated with the designated habitat through:
a. direct physical alteration, disturbance, or pollution, or
b. indirect effects of actions, which would result in a loss of habitat.

The proposed action will result in a net loss of tidal/marine wetlands
identified within a New York State Significant Coastal Fish and
Wildlife Habitat. Impacts from direct physical alteration include the
placement of 190' foot structure in wetland/waterbody, disturbance
from construction practices, or pollution from leaching of pesticide
form pilings into waterbodies and unknown vessel support. The
applicant has not discussed the potential for habitat destruction or
significant impairment as defined by this policy.
Policy 6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The applicant must demonstrate that the following dock standards pursuant to §
275-11. Construction and operation standards have been met.
The applicant has not demonstrated that the following dock standards

(d) Review and approval of dock applications. Before issuing a permit for a dock
structure, the Trustees shall consider whether the dock will have any of the
following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel traffic
or vessel congestion;
The proposed dock structure is 190' in length (excluding stair).
The applicant has provided an aerial photo showing dock lengths in Richmond
Creek (attached to April 12, 2018 letter), however, the photo does not accurately
show the detailed relationship of how far the proposed dock extends into the
waterbody past the adjacent docks and whether the proposed length of the dock
is consistent with "pier" line of the water body.
A discussion on the potential impacts (if any) to navigation of all vessels has not
been provided.
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskling and other water-dependent
activities,

[5] Whether the dock will cause degradation of surface water quality and natural
resources,
The proposed action is located within a NEW YORK STATE DEPARTMENT OF
ENVIRONMENTAL CONSERVATION CRITICAL ENVIRONMENTAL AREA, A NEW
YORK STATE SIGNIFICANT COASTAL FISH AND WILDLIFE HABITAT AND
PECONIC ESTUARY PROGRAM CRITICAL HABITAT. The application does not
discuss the potential impacts to natural resources and water quality. The
construction method has not been identified.
All materials used to construct the dock structure have not been specified and
therefore it cannot be determined if the structure complies with Chapter 275
Wetlands and Shorelines.
The operation of the vessel in shallow areas with -2.3' to -2.5' NGVD low water
depth (at dock terminus) may result in the following impacts:
1. Re-suspension of bottom sediments and turbidity
2. Impacts to benthic species, and
3. Erosion of shorelines.
Construction of the dock may also result in the increase of turbidity in the water
column, affecting submerged aquatic vegetation and shellfish. To further the
above policy and to reduce turbidity in the event that the proposed action is
approved, turbidity controls are recommended.
[6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish
and wildlife habitats,
The area where the dock is proposed is vegetated with spartina alferniflora and in
an area of high quality lower and upper marsh. The application does not
discuss the potential impacts to Richmond Creek a designated significant coastal
fish and wildlife habitat.
(11] Whether the cumulative impacts of a residential and commercial dock will change
the waterway or the environment and whether alternate design, construction, and
location of the dock will minimize cumulative impacts; and
The application does not discuss cumulative impacts to the Richmond Creek.
[12] Whether adequate facilities are available to boat owners and/or operators for
fueling, discharge of waste and rubbish, electrical service and water service.
The application does not assess or discuss whether adequate facilities are
available to a potential vessel.

4. 9.3 Preserve the public interest in and use of lands and waters held in public trust
by the state and the Town of Southold.
Small private docks in coastal areas extend into public waters and adversely affect
the public use of such water bodies.
Throughout the Town a total of 303+ public and quasi-public access points have
been established to allow for access to navigable waters. These access points
include, boat launch facilities, road ends, managed parks and Town owned
properties. A boat launch and public beach are located to the west of the property at
the end of Wells Road.
9.4. Assure public access to public trust lands and navigable waters.
E. Provide access to, and reasonable recreational use of, navigable
waters and public trust lands under water.
The applicant currently enjoys access to public waters from the
subject property and Wells Road end located approximately 669' to
the west(Figure 1).
1. Provide for free and unobstructed public use of all navigable
waters below the line of mean high water for navigation,
recreation, and other public trust purposes, including the incidental
rights of public anchoring.
Private dock structures extending into public trust lands and
waters obstruct public use of navigable waters, public
anchoring and other public use in the area where the dock is
located and does not meet this policy.
3. Obstruction of navigable waters and underwater lands is limited.-
The
imited.The USACOE identifies typical impacts to navigation due to small
docks as:
iii. There are instances where a proposed dock would not affect a
designated navigable channel or a federal navigation project, but
could adversely affect passage by paddle craft (e.g., canoes and
kayaks) through passageways along the shore. In some situations,
a dock may force small paddle craft into the dangerous situation
of entering a channel (or open water) utilized by larger, powered
boats. For safety's sake, the smaller craft typically remain close to
the shore—the same portion of the waterway where docks are
generally proposed and constructed.
iv. In some instances, the design of the dock (e.g., its height over the
water or structures at the water end) may impede safe navigation by
obstructing views along the waterway. Structures may obscure
oncoming boat traffic or boats leaving docks and navigation aids.

v. Private docks constructed too close to existing public or private
docks or boat landings may impede safe navigation to, and use of,
those existing facilities. Boats need room to maneuver around docks;
the amount of room necessary is dependent on the size,
configuration, and powering mechanism of the boats (i.e., size of
engine; sail versus engine powered, etc.) Docks that are too close
together may lead to difficulties ,in launching or landing vessels.
a. to the extent that it interferes with commercial navigation.
The right of commercial navigation is superior to all other
uses on navigable waters and may not be obstructed.
The proposed use is recreational and could hinder
commercial navigation and use by bayman in the area.
b. to the minimum necessary for access to navigable waters.
The minimum is determined by evaluating the following
factors:
(i) the extent of the use's dependence on
access to navigable waters,
The use is a private residence. Numerous
facilities are available throughout Town to
promote public water access for recreational
boating.
(ii) the range of tidal water level fluctuation,
(iii) the size and nature of the body of water,
Small watercraft navigate the waters close
to the shoreline for safety. Docks impede
this ability by forcing small watercraft to
navigate around or even under the dock
structure.
(iv) the nature of public use of the adjacent
waters,
Another consequence from private,
residential docks is the potential of
obstruction of navigation. Town regulations
prohibit the obstruction of marked
navigation channels and require a one-third
rule for creeks and harbors. For boaters
with engines, this prohibition fits their needs
since the safe operation of these vessels
could require the use of the channels for
navigation. However, for self -propelled
vessels and small watercraft which use is

not limited to navigation channels, docks
are an impediment, often forcing these
vessels to navigate around the structure or
seaward of the dock line. This forced
navigation restriction potentially puts the
users of these vessels at risk. Similarly,
dock structures limit the ability of sailing
vessels to use the nearshore area by
impeding the ability to navigate the
nearshore area.
(v) the traditional means of access used by
surrounding similar uses,
The traditional use of the waters
included free and unobstructed access
to the nearshore for commercial uses
and recreation by the public. Dock
structures impede public use where
located.
(vi) whether or not alternative means to gain
access are available.
Piers, docking facilities, and catwalks must
not result in an unnecessary interference
with use of public trust lands. Alternatives
to long docks (190') include use of
dinghies to reach moored boats and
mooring in nearby marinas.
c. by extent and characteristics of the developable
adjacent upland area and its ability to support in-water
development for the water-dependent use.
d. by potential adverse effects on natural resources and
their uses, and
The potential impact to natural resources has not been
thoroughly discussed in the application.
e. by potential adverse effects on public safety.

The proposed patio and 4' x 30' access path to the water are recommended as CONSISTENT
with the LWRP policies.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

On March 16, 2018 we received an e-mail from your office
regarding this application. The e-mail noted that the town's LWRP
coordinator needed additional information to complete the review
of this application. That information included a dock line
schematic and the project plans need to depict the distance across
the waterbody from the proposed dock as well as a vessel at the
proposed dock.
For your review we have enclosed a revised project plan (sheet 1
of 2) which depicts the distance from the seaward end of the dock
to the opposite shore line as well as a vessel at the proposed float
dock. We have also include a dock line schematic. The schematic
depicts existing dock structures and their lengths east and west of
the applicant's property as well as docks on the opposite shoreline.

These lengths are for the entire dock structures because some of
the existing structures are just fixed docks and others are fixed
docks with ramps and floats. We would also point out that the
lengths of the structures vary due to the amount of vegetated
wetlands are at each site that must be crossed to reach apparent low
water. We have also included the distances that we have measured
from apparent low water to the seaward end of each structure.

Dear Mr. Corwin:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., June 20, 2007 regarding the above matter:
WHEREAS, David S. Corwin on behalf of DAVID EDELSTEIN applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated April 5, 2007,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP Policies 1, 3,5,6,9,10 & 11, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 20, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposed docking facility does not comply with the standards set forth
in Chapter 275 of the Southold Town Code,
WHEREAS, the Board has determined that the project will affect the health, safety and
general welfare of the people of the town,
NOW THEREFORE BE 1T,
RESOLVED, that the Board of Trustees deems the action to be Inconsistent with the
Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold
Town Code, and,
BE IT FUTHER,
RESOLVED, that the Board of Trustees DENY WITHOUT PREJUDICE the application
of DAVID EDELSTEIN to construct a 4'X 16' ramp, 4'X 46' catwalk, 4'X 12' access
stairs and one (1) 8" dia. mooring pile.
