Main Rd. &Youngs Ave.) Telephone: 631 765-1938 Southold, NY 11971 • �O P Fax: 631 765-3136 Irou LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: May 14, 2018 Re: Local Waterfront Coastal Consistency Review for DAVID KRUPNICK SCTM# 1000-115-12-13 En-Consultants on behalf of DAVID KRUPNICK requests a Wetland Permit to install a 3'x12' hinged ramp and a 6'x20' floating dock situated in a "T" position, parallel to the shoreline and secured by two (2) 8" diameter two-pile dolphins off seaward end of existing 4' x ±46" fixed timber catwalk (with 1.7'x11' bench) to remain; cut existing dilapidated ±17' bulkhead and ±23' groin to grade; and connect water and electricity to the dock. Located: 880 Deep Hole Drive, Mattituck. SCTM# 1000-115-12-13 The proposed action has been reviewed'to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with the LWRP pursuant to: 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws-and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the "as built" dock structure was constructed without obtaining Board of Trustee review or a regulatory permit. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. 1. The proposed vessel to be moored at the dock has not been identified. The vessel would extend further into the navigation channel. 2. Proof that the proposed dock structure meets the 1/3 rule has not been provided in this narrow portion of the creek. 9.3. Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The proposed dock structure will extend further into public trust waters. Further, the dock structure would result in a net decrease in public access to public underwater lands. The applicant currently enjoys access to public water via an existing, private, dock structure. The incremental and segmented extensions of permanent, private, dock structures into public trust waters does not meet this policy. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. J ; ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR DAVID KRUPNICK 880 DEEP HOLE DRIVE MATTITUCK,NY SCTM#1000-115-12-13 Policy 6 The project includes the installation of a ramp and"T"-shaped floating dock off the end of pan existing, permitted(Wetlands Permit No. 1708), fixed dock for the purpose of improving the useability of the existing dockage facility and providing safer access to watercraft moored at the dock; and this proposed dock modification will comply in all ways with the construction and operation standards set forth for residential docks by Section 275-1 l(C)(2)of the Town Code. For example,the proposed Boating dock will be situated more than 15 feet from the side property lines and will allow the dock to reach sufficient water depth while remaining within the limits of both the existing pier line of the adjoining floating,docks and the allowable one-third seaward encroachment across the waterway. Therefore,the orall 16" seaward extension of the dock facility will not impact navigation or other public use of or access tolthe shoreline or adjacent waterway, nor will it result in the physical loss, degradation, or funct'lonal loss of ecological components, such as the"fragmentation of ecological communities," along this developed shoreline that is characterized by numerous, similarly designed and permitted dock structures.
