Main Rd. &Youngs Ave.) Telephone: 631 765-1938 Southold, NY 11971 O �Q P Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, LWRP Coordinator Date: May 10, 2018 Re: Local Waterfront Coastal Consistency Review for GEORGE KATSAMANIS SCTM# 1000-35-4-28.40 En-Consultants on behalf of GEORGE KATSAMANIS requests a Wetland Permit to construct approximately 134 linear feet of vinyl retaining wall with +8' and +12' returns along top of embankment, and backfill where necessary with approximately 15 cubic yards of clean sand fill to be trucked in from an approved upland source; construct approximately 130 linear feet of low-sill vinyl bulkhead with +8' and +12' returns; dredge 10' wide, approximately 1,200sq.ft. area seaward of proposed low-sill bulkhead to a maximum depth of-24" Mean Low Low Water, and create approximately 1,400sq.ft. of intertidal marsh by backfilling area landward of proposed low-sill bulkhead with approximately 45 cubic yards of dredged spoil to be planted with Spartina alterniflora (12" O.C.); restore disturbed portions of existing naturally vegetated slope located between proposed retaining wall and tidal wetlands boundary with native vegetation; and establish and perpetually maintain a 10' wide, approximately 1,350 square foot non-turf buffer area landward of the proposed retaining wall. Located: 1025 Gull Pond Lane, Greenport. SCTM# 1000-35-4-28.40 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that: 1. The Board finds that the applicant has demonstrated that the erosion of the shoreline is sufficient enough to harden the natural shoreline in this area. In the even the action is approved; the following is required to further Policy 6. § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A posed action will be evaluated as to its si nig_ficant beneficial and adverse effects upon the coastal area (which includes all of Southold Town), If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No 0 Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR GEORGE KATSAMANIS 1025 GULL POND LANE GREENPORT,NY SCTM#1000-75-4-28.40 Policies 4 & 6 The project's purpose is to prevent the further erosion of the subject shoreline and embankment and thereby the continued loss of upland and potential flooding and erosion damage to upland residential structures. To do so,the project design proposes to employ a combined structural and non-structural/vegetative erosion control approach where a non-structural approach alone is not viable due to the property's location in a historically bulkheaded canal between adjacent bulkheads, including the recently reconstructed bulkhead to the west. Specifically, 1) a low-sill bulkhead will be installed seaward of the tidal wetlands boundary and an approximately 1,400 sf of vegetated intertidal marsh created behind it; 2) an upland retaining wall will be installed landward of tidal wetlands along the top of the embankment; and 3)the existing, currently eroding naturally vegetated embankment located between the retaining wall and the wetlands boundary will be restored and revegetated where disturbed during construction. The hard structures have been designed to the minimum scale necessary and will have no adverse impact on the adjacent bulkheaded properties or to natural coastal processes and natural resources, as the low-sill bulkhead will be submerged at high tide and the upland retaining wall situated so that it would only become exposed to surface waters if the entire embankment were ever lost to erosion. Therefore,the effects of the project will be the enhancement and protection of Town wetlands through the creation of vegetated intertidal marsh; the restoration and protection of the naturally vegetated slope landward of the wetlands; and ultimately the protection of the upland from potential flooding and erosion damage.
