SUPERVISOR RUSSELL: Would everybody please rise for the Pledge to the Flag? Thank you.
I am going to ask anybody that would like to comment on any of the agenda items to please feel
free? Peter?

PETER HARRIS: Peter Harris, Greenport. Good afternoon everyone. I am sorry, please bear
with me. Item # 1076, I know earlier this year you had talked about capital expense for Fishers
Island for sidewalk work and I see now there's also $500,000 marked down here for I guess the
mainland in the Town. Is there a specified area where this $500,000 is being spent? That we
know of?
SUPERVISOR RUSSELL: I actually think there is, it probably should have been included in the
agenda. I know you had raised an issue with regard to a problem area, if you want to contact me
tomorrow, I will give you a specific idea on where this work will be done.
MR. HARRIS: That will be great, Scott, because just this past week or so there was a crew from
the highway department that was down on the Main Street in Greenport, clearing sidewalks of all
types of debris, what have you, they did a bang up job cleaning it up but it only brings to light

how bad the sidewalks, especially on Main Street, how bad they are. So, I just assumed that
when I saw this $500,000, that it has probably already been earmarked for somewhere.
SUPERVISOR RUSSELL: I think it is.

ANNE MURRAY: Anne Murray from East Marion. I wanted to comment on item 1045 and
urge the Town Board to please, please enact this rental permit law. I hope you will be voting on
it tonight. It's been a long time coming, what two, three years Jill? Since you started working on
it...
COUNCILWOMAN DOHERTY: Well, since I really started working on it about one and a half
years but we have been talking about it for three years.
MS. MURRAY: Right. I think it's a long time coming and I urge the town to do this because we
need safe housing for everyone. Thank you.

Comments regarding resolution 1045
COUNCILWOMAN DOHERTY: I just want to say this has been a struggle for all of us for
years and I don't like anytime that we have to make more codes and more law but we feel it's
evident that it has come to this and I want to thank everybody for their support and everyone that
came out gave their comments and I vote yes.
SUPERVISOR RUSSELL: Yes, I just want to comment quickly because I had wrestled with this
and it was actually some reservation I had in supporting it. There were several public hearings,
the original legislation was admittedly perhaps overly prescribed. It's been stripped down to its
most basic, very, very straightforward provisions. It removes the necessity of having a town
official inspecting your property, you do have the opportunity of going to an outside engineer.
It addresses long standing safety, health and welfare issues, with regard to giving fire marshals
access for ensuring that the properties are safe. I also want to address what Jill said, I hate
passing new restrictions if we don't have to but people should keep in mind we have actually
loosened the code over the past few years that have made accessory apartments much easier to
get approval for than they had been in years. We have loosened the rules considerably and when
you do that, you loosen the rules in one respect, there's unfortunately an intended necessity to
strengthen the code in other places. I vote yes.

Enact LL #14 of 2018-Rental Permit
WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 25th day of September, 2018, a Local Law entitled "A Local Law in
relation to Rental Permits" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it

RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Rental Permits" reads as follows:
LOCAL LAW NO. 14 of 2018
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. A new Chapter 207 of the Code of the Town of Southold, A Local Law entitled, "A
Local Law in relation to Rental Permits"
207-1 Legislative intent.
A. The Town Board of the Town of Southold has determined that there exists in the
Town of Southold serious conditions arising from non-owner occupied rental of
dwelling units in one, two and three family and multiple dwellings that are
substandard or in violation of the New York State Uniform Fire Prevention and
Building Code, Building Rehabilitation Code, Electrical Code, Fire Prevention Code,
Plumbing Code, and other codes and ordinances of the Town. Many of these dwellings
are inadequate in size, overcrowded and dangerous, and such dwelling units pose
hazards to life, limb and property of residents of the Town and others, tend to
promote and encourage deterioration of the housing stock of the Town, create blight
and excessive vehicle traffic and parking problems and to overburden municipal
services. The Board finds that current Code provisions are inadequate to halt the
proliferation of such conditions and that the public health, safety,welfare and good
order and governance of the Town will be enhanced by enactment of the regulations
set forth in this chapter.
B. Nothing herein shall be interpreted to supersede any requirements contained in
Chapter 280, Chapter 100 or any other chapter of the Town Code of the Town of
Southold.
§ 207-2 Definitions.
As used in this chapter, the following terms shall have the meanings indicated:
CODE ENFORCEMENT OFFICIAL - The official who is charged by the Town Board
with the administration and enforcement of this chapter, or any duly authorized
representative of such person, including but not limited to the Building Inspector,
Chief Building Inspector, Principal Building Inspector, Senior Building Inspector,
Building Permits Examiner, Zoning Inspector, Electrical Inspector, Plumbing
Inspector, Fire Marshal, Fire Marshal I, Fire Marshal II, Chief Fire Marshal, Town
Investigator, Senior Town Investigator, Ordinance Enforcement Officer or
Ordinance Inspector of the Town of Southold, Stormwater Manager, Town
Engineer and such person(s) shall be certified as a New York State Code
Enforcement Official; Code Enforcement Officer.

DWELLING - A building designed exclusively for residential purposes.
DWELLING, MULTIPLE-FAMILY - A building, other than an apartment house,
designed for and occupied as a residence by three or more families living independently of
each other.
DWELLING, ONE-FAMILY - A detached building designed for and occupied exclusively
as a home or residence by not more than one family.
DWELLING, TWO-FAMILY -A building arranged, designed for or occupied exclusively
as a home or residence for not more than two families living independently of each other.
DWELLING UNIT -A single unit within a building or structure providing complete
independent living facilities for one or more persons, including permanent provisions for
living, sleeping, eating, cooking and sanitation.
IMMEDIATE FAMILY - The immediate family of the owner of a housing unit consists of
the owner's spouse, domestic partner, children, parents, grandparents or grandchildren,
siblings, uncles, aunts, nieces, nephews, cousins and in-laws.
OWNER-Any person, partnership, corporation or other entity who, alone or Jointly with
others, shall have legal title to any premises,with or without accompanying actual
possession thereof; or who shall have charge, care or control of any dwelling unit as a
cooperative shareholder or as executor, administrator, trustee, receiver or guardian of the
estate or as a mortgagee in possession, title or control; including but not limited to a bank
or lending institution, regardless of how such possession, title or control was obtained.
RENT - A return, in money, property or other valuable consideration (including payment
in kind or for services or other thing of value), for use and occupancy or the right to use
and occupancy of a dwelling unit,whether or not a legal relationship of landlord and
tenant exists between the owner and the occupant or occupants thereof.
RENTAL DWELLING UNIT - A dwelling unit established, occupied, used or maintained
for rental occupancy
RENTAL OCCUPANCY - The occupancy or use of a dwelling unit by one or more persons
as a home or residence under an arrangement whereby the occupant or occupants thereof
pay rent for such occupancy and use.
RENTAL OCCUPANCY PERMIT - A permit which is issued upon application to the Code
Enforcement Officer designated by the Town Board with the administration of this
Chapter and shall be valid for 24 months from the date of issuance.
207-3 Fees.
Rental Permit fees shall be set by the Town Board by resolution.

§207-4 Smoke detectors and carbon monoxide detectors.
Each rental dwelling shall be equipped with functioning smoke detectors and carbon
monoxide detectors, in compliance with New York State Uniform Fire Prevention and
Building Code.
§207-5 Inspections.
A. No permit shall be issued under any application unless the rental dwelling unit has a
valid Certificate of Occupancy or Pre-Certificate of Occupancy.
B. The Code Enforcement Official is authorized to make or cause to be made inspections,
to determine the condition of dwellings and to safeguard the health, safety, and
welfare of the public. The Code Enforcement Official or his designated representative
is authorized to enter the subiect premises upon the consent of the owner.
C. Search without warrant restricted. Nothing in this chapter, except for provisions
concerning emergency inspections, shall be deemed to authorize the Code
Enforcement Official or his authorized representative to conduct an inspection of any
premises subject to this chapter without the consent of the owner of the premises or
without a warrant duly issued by an appropriate court.
D. Conflict with other chapters or law. Nothing in this chapter shall be construed to
negate the authority for inspections pursuant to any other section of law or court-
ordered inspection.
E. Presumption of rent. Any dwelling, dwelling unit, rooming house, rooming unit or any
other premises subiect to this chapter shall be presumed to be rented for a fee and a
charge made if said premises are not occupied by the legal owner thereof. This
presumption shall be rebuttable.
4207-6 Application for search warrant.
The Code Enforcement Official or his designated representative is authorized to make
application to the Town of Southold Justice Court or Supreme Court of Suffolk County, or
any court of competent jurisdiction, for the issuance of a search warrant in order to
conduct an inspection of any premises covered by this chapter where the owner refuses or
fails to allow an inspection of its rental premises and where there is reasonable cause to
believe that a violation of this chapter has occurred. The application for a search warrant
shall in all respects comply with the applicable laws of the State of New York.
§207-7 Rental permit required.
A. It shall be unlawful for any rental occupancy to exist in any dwelling without the
owner's first having obtained a rental permit from the Code Enforcement Official.
(1) It shall be an affirmative defense to a violation of Subsection A of this section that
the rental occupant or occupants is/are immediate family members of the owner
of the subject premises, as defined in this chapter.

B. Rental permit application requirements.
(1) Rental permit applications shall be in writing on a form provided by the Town and
shall include the owner's name, address and telephone number.
(2) Rental permits applications shall contain a description of the unit, including the
number of rooms in the rental dwelling unit, and the dimensions and use of each
such room shall be included. The name, address and telephone number, if any, of
the managing agent or operator of each such intended rental dwelling unit shall be
included
(3) Rental permits applications shall include the maximum number of persons that are
being requested to occupy the rental dwelling unit.
(4) All applicants for a rental permit shall sign an affidavit stating that they have
received a copy of and fully understand this Chapter of the Southold Town Code.
(5) All applicants must submit the following documents:
(a) Copies of all certificates of occupancy and/or pre-certificates of
occupancy for the rental dwelling unit;
(b) An affidavit setting forth the address to be used as the last known
address of the owner for service pursuant to all applicable laws and
rules. The owner shall notify the Code Enforcement Official of any
change of address submitted pursuant to this section within five
business days of any change thereto, and ;
(c) Inspection report. The owner of the rental dwelling unit shall (1)
arrange for an inspection of the unit or units and the premises on
which the same are located by the Code Enforcement Official or his
designee employed by the Town of Southold, or(2) provide to the
Code Enforcement Official an inspection report, on a form provided
by the Town, signed by either a New York State licensed professional
engineer, New York State licensed architect or home inspector who
has a valid New York State Uniform Fire Prevention Building Code
certification that the structure and the dwelling units contained
therein meet all applicable housing, sanitary, building, electrical and
fire codes, rules and regulations.
(6) Each application shall be executed and sworn to by the owner of the premises.
(7) All rental properties containing eight or more rental units shall provide for a
designated site manager,who shall be available to address and resolve any issues with
the property 24 hours a day. The owner of the property must file the manager's
address, telephone number and other contact information with the Code Enforcement
Official within five days of the designation of the manager or any changes thereto.
C. Notwithstanding the above, no rental occupancy permit shall be required for a
residential care facility licensed under federal, New York State or Suffolk County
guidelines.
D. Renewal of rental permits.
(1) A renewal rental permit application signed by the owner shall be completed and

filed with the Code Enforcement Official at least 90 days prior to the expiration
date of any valid rental permit. A renewal rental permit application shall contain a
copy of the prior rental permit.
(2) Prior to the issuance of a renewal rental permit, the owner shall cause an
inspection of the unit or units and the premises pursuant to 207-7 B(5c) above.
(3) The Town of Southold shall not accept, review or approve any renewal rental
application for a rental dwelling unit dwellings wherein the prior rental permit
expiration date has passed. If the expiration date has passed, the owner must file a
new application.
X207-9 Revocation of permit.
A. The Code Enforcement Official may revoke a rental occupancy permit where he or
she finds that the permit holder has caused, permitted, suffered or allowed to exist and
remain upon the premises for which such permit has been issued, for a period of 14
business days or more after written, return receipt requested notice and opportunity
to be heard has been given to the permit holder, or the managing agent of such rental
dwelling unit, a violation of the Multiple Residence Law and/or New York State
Uniform Fire Prevention and Building Code or a violation of this chapter or other
chapter of the Town Code. Revocation of a permit under this subsection cannot be
done by a devisee or assistant of the Code Enforcement Official.
B. An appeal from such revocation may be taken by the permit holder to the Town
Board, by written request, made within 30 days from the date of such revocation. The
Town Board shall hold a public hearing on such appeal after receipt of written request
of such appeal, and after such hearing shall make written findings and conclusions
and a decision either sustaining such permit revocation or reinstating such permit
within 30 days after close of such public hearing. Unless the Town Board directs
otherwise in circumstances constituting serious threats to health and safety, the filing
of an appeal shall stay the effectiveness of a permit revocation until the Town Board
has considered and ruled upon the issue.
C. Any permit holder that takes an appeal to the Town Board from the revocation of a
rental permit shall be required to pay an administrative fee $200.00 to the Town Clerk
with the written request for the appeal.
X207-10 Broker's/Agent's responsibility.
A. Broker's/Agent's responsibility prior to listing. No Real Estate Broker or agent shall
list or otherwise advertise, or offer for lease any rental dwelling unit for which a
current rental permit has not been issued by the Code Enforcement Official.
4207-11 Enforcement.
This chapter shall be enforced by the Code Enforcement Officer as defined by this chapter.

X207-12 Penalties for offenses.
A. Any person, association, firm or corporation that violates any provision of this chapter
or assists in the violation of any provision of this chapter shall be guilty of a violation,
punishable:
(1) By a fine not less than $500 and not exceeding $5,000 or by imprisonment for
a period not to exceed 15 days, or both, for conviction of a first offense.
(2) By a fine not less than $1,000 nor more than $10,000 or by imprisonment for
a period not to exceed 15 days, or both, for conviction of the second of the
two offenses, both of which were committed within a period of five years.
B. Each week's continued violation shall constitute a separate additional violation.
C. This section is enacted pursuant to Municipal Home Rule Law 10(1)(ii) a(9-a) and
10(1)(ii)d(3) and pursuant to 10(5) of the Statute of Local Governments, and is
intended to supersede Town Law § 268 and any other statute or local law to the extent
necessary to increase the minimum and maximum penalties contained therein.
4207-13 Implementation.
Il. Severability.
If any clause, sentence, paragraph, section or part of this chapter shall be adjudged by any
court of competent jurisdiction to be invalid, such iudgment shall not affect, impair or
invalidate the remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, section or part thereof directly involved in said iudgment.
III. Effective Date.
This chapter shall be effective upon filing with the Secretary of State. However, in order to
afford property owners a sufficient amount of time to apply for and obtain a rental permit
as set forth herein, no violation of this chapter will be charged prior to August 1, 2019 and
no violation for failure to obtain a permit shall be issued to a person or entity that:
A. Has filed the necessary application in proper form with all required information
and attachments on or before August 1, 2019, and;
B. Has not received a final determination on the application on the application for
reasons over which the applicant has no control.

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED DECEMBER 18, 2018, AUTHORIZING THE
ACQUISITION AND INSTALLATION OF COMPUTER
HARDWARE AND SOFTWARE, STATING THE ESTIMATED
MAXIMUM COST THEREOF IS $97,500, APPROPRIATING
SAID AMOUNT FOR SUCH PURPOSE, AND AUTHORIZING
THE ISSUANCE OF BONDS IN THE PRINCIPAL AMOUNT OF
$97,500 TO FINANCE SAID APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to acquire and install computer hardware and software.
The estimated maximum cost thereof, including preliminary costs and costs incidental thereto
and the financing thereof, is $97,500 and said amount is hereby appropriated for such purpose.
The plan of financing includes the issuance of bonds in the principal amount of $97,500 to
finance said appropriation and the levy and collection of taxes on all the taxable real property in
the Town to pay the principal of said bonds and the interest thereon as the same shall become
due and payable.
Section 2. Bonds of the Town in the principal amount of $97,500 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (referred to herein as the "Law"), to
finance said appropriation.
Section 3. The following additional matters are hereby determined and declared:

(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 32 and
108 of the Law, is five (5) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation
notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will not
exceed five years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by a general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the
issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative
to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections
56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized, and of any bond anticipation notes issued in
anticipation of said bonds, and the renewals of said bond anticipation notes, and as to executing
contracts for credit enhancements and providing for substantially level or declining annual debt
service, are hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.

Section 7. This bond resolution shall take effect immediately, and the Town
Clerk is hereby authorized and directed to publish a summary of this bond resolution, together
with a Notice attached in substantially the form prescribed by Section 81.00 of the Law in "The
Suffolk Times, " a newspaper published in Southold, New York, having a general circulation in
the Town and hereby designated the official newspaper of said Town for such publication.

THERESA MCKASTY: Thank you for the opportunity to speak and I want to thank the Town
Board for coming the other day on a very cold Wednesday at Iron Pier beach to support
Riverhead Town Board in requesting that the FAA provide the public with a public hearing.
With that said, I am in receipt of a letter that Southampton Town had written to the US
Department of Transportation. which I would like to read to you briefly and it says, 'To Whom it
May Concern, In follow-up to our attached letter submitted on December 13, 2018 regarding the
north shore helicopter route, notwithstanding there needs to be a meaningful public hearing
process with hearings being held within the east end towns affected. Not only were the three
workshops hosted by the FAA inadequate but also failed to meet the legal standard pursuant to
the statute which required the FAA to hold a public hearing within 30 days of enactment of the
FAA authorization act of 2018. therefore. I urge you to schedule public hearings regarding this
matter on the east end of Long Island as soon as possible. Respectfully Submitted, Christine

Riverhead as well.

Peter Harris, Greenport
PETER HARRIS: Good evening again, Peter Harris, Knapp Place Greenport. Former
Superintendent of Highways, Town of Southold. When I was up earlier, the second thing I
wanted to ask, I couldn't find it at the time, was the #1079, resolved the Town Board Town of
Southold hereby appoints Margaret Brock to the position of temporary account clerk for the
Highway Department. The account clerk that was there, is she no longer there?
SUPERVISOR RUSSELL: I can't comment on personnel issues. This is a matter with regard to
personnel, I cannot comment.
MR. HARRIS: Okay, alright. That's that. This past week, one morning when I was waiting to
do my due diligence of babysitting for my grandson, I happened to be watching channel 22 and I
watched the town board work session prior to the last town board meeting. During that meeting,
the highway superintendent was present and was stating to the board members how much time
and effort he had spent selling used highway equipment via auction international. My question
is, for someone who worked so hard to sell this equipment, that it be driven off town property
with the Southold Town logos still affixed to the doors of these trucks. Any time while I was in
office and any auction that I had ever went to and bought municipal equipment, those logos had
to be either removed or defaced. You don't send a vehicle down the road with a Southold Town
logo affixed on the side of these vehicles. I happened to pass one of them in Riverhead, on
Route 58. It was getting ready to go up on the Long Island Expressway. Who fell asleep at the
switch? And I can't say but I have got to go right to the top because that's the person that is
supposed to oversee everything. And to let any of those vehicles to be driven out of our town
highway facility with those town logo's still intact, god forbid, god forbid if one of those
vehicles had been used in an un-law abiding situation. Southold Town. I don't get it. Five years

on the job and something like that? To some people and it sounds like I am talking out of my hat
but that's a serious thing to let these vehicles left the facilities. They should have either been
towed or taken on trailers out of there not just to be driven down the road. Next thing was that I
heard through the grapevine that one of the purchasers had purchased two vehicles and he got
over $800 worth of fuel out of the fuel tanks. The fuel tanks were full. Why would we sell a
vehicle at auction and have the tanks be full of fuel? Who was asleep at the switch? That's only
two of the trucks that I know about. I don't know about the rest of them. I don't know, was the
insurance taken off these vehicles before they left, I hope? I mean, it would have been a pretty
sad sight for this town if one of those vehicles had been involved in an accident. I don't know.
SUPERVISOR RUSSELL: I am just going to ask if the Town Attorney, will you contact the
Highway Superintendent tomorrow and look at the issue whether town's have to have the
insignia removed?
TOWN ATTORNEY DUFFY: Yes.
SUPERVISOR RUSSELL: And then advise him accordingly?
MR. HARRIS: I will tell you they do, Scott. When I used to purchase vehicles out of New
York City, down at Brooklyn Navy Yard, every single vehicle that the City of New York sold,
their markings were defaced. Any vehicle that I sold, no logos, if we couldn't get the decal off,
they were spray painted over so you couldn't read them. Let's see, oh, while listening to the
work session, there was an issue about a six wheel dump truck, combination flow and dump
body, $145,000. Well, these six wheel dump trucks, they have a capacity of eight or nine cubic
yards, alright, when I was in office hence,post being in office, the town had purchased used New
York City sanders, Mack sanders. Twenty plus cubic yard capacity. No matter what year the
vehicle is, the city of New York, they have a standard spec so a truck that was made in 2000 is
identical to a truck that is built in 2018. It's the same exact specification, so that if we bought, if
the town bought some used vehicles, they were identical. No matter what the year, the truck is
identical, so that when you, I mean, when I was buying the trucks at the city auction, I think the
most they ever spent was $7,000. And if you got and they had roughly 19,000-20,000 miles on
them. If you got five years, five years, you basically were spending, figure like $1,200-$1,300 a
year. That's pretty cheap. Five year throwaway. Now the city no longer has the auction, so
they have been purchasing these sanders through a private vendor and I think now they are
spending I don't know, $30-35,000. If that, for a truck that can hold almost three times the
amount and it costs '/4 of a brand new truck that holds eight or nine cubic yards, to me it doesn't
make sense to go and buy that $145,000 flow and dump body. It just doesn't, being in the
business for 43 years, it makes sense to me. I know some people don't think that way but quite
honestly, those trucks that we bought from the city, the last year I was in office I had bought, you
could adapt an adaptor to put a regular snow plow, the city, they have a different low bearing
plow but there was an adaptor you could buy and put on the front of the truck so that truck could
carry the same kind of plow our other plows could carry. So Riverhead Town they have done it,
it just doesn't make sense to me to go out and spend $145,000 for, not saying you might not need
a truck but it doesn't make sense to me to go out and spend $145,000 for a truck that you could
buy for '/4 the amount and then you have, first of all, you are going to burn less fuel, you are

going paying the driver less time because he is not going to be coming back and forth to be re-
loaded because in this town, we only have a central loading location. So if you are up in Laurel
or you are out in Orient Point and you run out of material, you have got to come all the way back
to Peconic. So with these trucks, with the bigger spreaders, you can get three times the amount
done. And you are saving time and fuel of running back and forth. I listened to the
Superintendent saying how much money he got from the auction and he was moving funds
around to tell you how he could go and buy a truck and quite honestly, you stopped him in his
tracks because he hadn't come prior or he hadn't spoken to the Supervisor or anybody else but
you know, I'm not saying I'm the greatest but some of the things that are going on just don't
make any sense. You also had a discussion and trying to chase my grandson and trying to listen
at the same time, it was about the catch vats and I think it had to do with keeping records about
the daily use, well, when I was in office, I drew up a log sheet that was used on a daily basis by
the operator of that vehicle because you didn't always have the same operator every day but
there was a log book in there with log sheets and in that log you log the location of the basin, the
condition of the catch basin, how much material was removed, how much time was spent at each
location. We didn't keep, I never kept track of miles because you are not doing a lot of miles
unless you are working in Laurel or you are working in Orient Point and you are coming back to
where they discharge the material. So I don't, I don't know, he made a statement that well, we
just started doing that on Monday. I am just wondering, if this is the same information you were
looking at, what I just stated?
COUNCILMAN DINIZIO: You are asking me? Yes.
MR. HARRIS: I don't understand, Jim. We had this, we had this in place....
COUNCILMAN DINIZIO: Well, I can say this because I have been on the board now for six
years. A lot of things that are logged are just that, logged and they are not necessarily used to
measure productivity on a regular basis. You know, so I am encouraging them to take that next
step and start using that information to get more productivity out of those. You know, yes, I
believe those logs still exist, okay, but the next step needs to be that you do on a weekly basis or
whatever, that log and do a report on it and have a monthly report that says you know, the truck
was here or there and maintenance all of that and you know, it's placed down into writing, not
just a log in a book, so it's the next step. I can't say that what you described still doesn't exist, I
believe it does.
MR. HARRIS: Okay. And I will say this, out of all the machinery that A, any highway
department uses the two types of machinery that have the biggest wear and tear on them is an air
vac and a street sweeper because with an air vac and you are sucking up and you have got sand
and gravel, all kinds of things and it's being going up through these metal pipes, I mean, there
are areas where it is a big rubber hose but there's elbows and what have you, that these pipes,
they do. they wear holes right through them. The same thing with the mechanical sweeper, you
have so much abrasion with the materials that these two types of machinery, you get a
tremendous amount of wear and tear, no matter who is in charge, okay? I don't know what the
situation is now, the person that used to fix, replace all these worn out parts just retired recently
from Southold Town, big loss for you people, I am going to tell you. the guy worked magic

many, many times and, of getting that stuff back up and when the last air vac that I purchased,
well, I turned around and I sunk like $60,000 into the second one that you still have, stating that
it doesn't have the draw anymore to pull from a basin but they are still using it to pick up wood
chips and do puddles and what have you. I mean, it's worth the while to reinvest because you
know, I think it was like, I don't know, close to $300,000 for that air vac but it's a very important
piece of machinery, you know, it's not a pickup truck, it's not an eight or nine cubic yard flow
and dump, this is a specialty piece of equipment that working with Jamie and Michael and they
go out now, they have the camera that they can go and go through, cross pipes and they have the
irrigator that can go in and open the cross pipes up, it's important, it's very important that but we
as, you people sitting up on that dais need to remember, it costs money to be in business and you
can't always let some pieces of equipment just go till they are just totally dead. You have got to
make that step forward and even if you go and buy, not even buy it, if you have one that's in
really good condition and you have one that is ready to die, okay, maybe you don't have the
money to go, that $300,000 but there's got to be something for $150,000 out there that's still in
good shape that can still do the job for you because we have a lot of, we have a lot of flooding
issues still in this town, even with the amount of drainage that has been put in over the years, and
if the water doesn't get off the road, you have to go there with that air vac and you have to take
that water and get that hazardous situation off the road. So, I have taken enough of your time.

Doug Roberts, Greenport
DOUG ROBERTS: Good evening, Doug Roberts, Greenport. You read a lot of national news,
some of it is very troubling. Election fraud, disenfranchise of voters around the country.
Troubling stuff. And when you read that stuff, you think well, at least that doesn't happen in my
town, at least that doesn't happen here. Well, friends, it did. and it look like it has been maybe
for a while and I am here tonight because I am a little concerned, most of you know that I am a
Greenport Village Trustee, I am probably the least powerful elected official in New York State.
I am about the only elected official around here that's willing to say anything about it so far and
that's very troubling and that's why I am here. We have two people that were arrested and
charged with trying to steal an election including misrepresenting themselves while on the clock,
taxpayer funded as Board of Election employees, pretending they are Green Party members
getting signatures for candidates. Forging signatures of deceased people. It's sick. Here in
Southold, allegedly. These two gentlemen had political patronage positions by virtue of their
membership on the Southold Republican Committee, the same committee that put everybody up
there on the ballot. There is a video posted on the Southold GOP twitter feed that is not aging
well. In it, we see a gathering at the Mattituck Veteran part two weekends before this last
election, we see many familiar faces in the crowd, some of you folks. We see a speech by GOP
chairman McGreevy and the camera pans over just as Mr. McGreevy says the words about our
Congressman, `he's a normal, everyday guy just like us' and we see him palling around with a
man who was just arrested and charged with election fraud, on the committee, Board of Elections
employee. The same person was also running interference it seems, in Greenport during the
Maritime fest when the candidates, congressional candidates were appearing, potentially even
helping to guide the tracker who was shoving his camera phone in my face when I walked

around with Perry Gershon, harassing me. So this person was intrinsically linked with this
campaign, it's very concerning. When all this was happening, we have heard nothing from our
GOP elected officials. You are mute on it. Why? Is there something to hide? Is this the kind of
activity you want to support but being silent on it, it makes you complicit. So that leads to more
questions, what else is going on with the Southold GOP? What did the committee officials and
the chair know and when did they know it? Why is everyone afraid to condemn this stuff? How
much influence does the party have over what happens here at Town Hall? Now keep in mind,
there have been many other election irregularities around here recently. In this past
congressional cycle, I was one of many concerned citizens calling in a couple of weeks before
the election to Legislator Krupski, County Executive Bellone because the Republican
Commissioner Lalota, Board of Elections Commissioner Lalota unilaterally decided to cutoff on-
site absentee balloting, on his own, without any sort of checks and balances. Well, County
Legislator and County Executive got involved, that practice was ended. By the way, the
absentee ballots came in pretty strong for the Democratic candidate. As a poll watcher in
Greenport during this past election, I noticed that poll workers, I really think it was an honest
mistake by poll workers they are good folks, but for some reason, the instructions from BOE
made it seem that they needed to put a piece of paper on the table that said show your drivers
license. That's of course, only for folks that didn't vote in the last couple of elections. I got that
situation fixed through a couple of phone calls as a poll watcher but why did that only happen in
Greenport. Hopefully, this is just a misunderstanding. This calls into question everything
though. We have got to look at everything now. Last town election cycle, a fellow Greenporter
called the police because somebody was stealing a campaign sign for a Democratic candidate in
front of her house. It turns out it was a Republican candidate. You can check the police report.
A town councilman stole my private text messages and made them public in a bizarre 45 minute
campaign stunt circus of slander and carrying on at a village board meeting, a village by the way
he doesn't live in, doesn't vote in. Then he took the phone over to his facebook page, where he
held court as his supporters took shots at me and my family including threats to come to my
home and harass me. We had a three year old at the time. It's behavior unbecoming of a human
being and unbecoming of an elected official. But I digress. Countless farmers and winemakers
come to these meetings when you have hearings on agri-business issues, they claim they feel
they are taking a risk in speaking up, fearing their businesses might be harmed because a permit
won't get approved, code enforcement. What is going on? Somebody in the Southold GOP
didn't like a facebook post of mine, so I got a message on facebook saying take it down or else.
Or else. I could go on with these stories, everybody in town knows about it. Why all these
attempts at intimidation? Why cover up and protect committee people who may have tried to
steal an election? When things are confusing, it usually helps to follow the money. According
to public records, Southold GOP committee members and their family members collect $217,000
per year in Board of Election salaries. Here in Southold, town taxpayers fund GOP committee
people and their family members to the tune of $970,000 in salaries for staff in appointed
positions. With an additional almost $700k in elected official compensation. That doesn't
include the health care. So being a Southold GOP committee person allows one to feed a trough
of almost $2,000,000 in taxpayer dollars. The town's budget is only $45 million. $20 million of
that is salary, so it's about 10 % of the salaries going to families of committee members. So to
me, that's astounding when compared to these other things. If we had no election fraud issue,
you know, things were kind of going okay, we don't have to talk about it. Does that explain why

there's such silence around this election fraud issues and these voter intimidation tactics. Look,
there's a surprising amount of agreement at your meetings. With one party rule, there often isn't
anyone around to blow the whistle. I would imagine that the party that put you here would like
to keep the gravy train going. Now, how far would that party go to protect this? It seems
someone on the committee may have been willing to break some laws. We elect you to speak
up, regardless of your party affiliation. When you see something is not right, that somebody is
trying to hide something from the public, we want you to speak up. People over party. At our
work session at the Village Thursday night, I am going to have some difficult questions to ask
our mayor about why the flooding on Fifth Street and Fifth Avenue hasn't been fixed. He and I
do good work together, in part because we are willing to challenge each other when we have to,
when we feel it is right. I am asking you all to do that with each other as well. It our job as
elected officials to be watchdogs and advocate for the people we serve. Now look, I don't know
many of you very well at all outside of your public lives. We say hello at parades, you seem like
nice folks, we exchange pleasantries. I don't believe in my heart of hearts that everybody sitting
up on this dais wants to be associated fraud and other voter intimidation tactics, I don't. I was
telling a Republican friend the other day, you know, you and I are never going to vote for the
same people for congress or president, but the R or D after our names doesn't matter when it
comes to ethics, common sense, getting things done locally. To be fair, this Board does some
pretty un-Republican things. You raise taxes every year, increase elected officials compensation
every year, I am a registered Democrat, I have done a lot in the Village to free businesses from
regulations. Democrats are probably mad at me about that but you know, we do what we have
got to do, what we think is right. We don't all fit into these boxes of R and D, right? So I think
some, maybe all of you on this Board want to do right. I am here tonight to urge you to speak
up. Tell your committee chair publicly that election fraud is a serious matter and you won't
allow him to keep people on the committee who have proven to be involved in it and suspend
them, maybe, while they are being investigated. Call for a full investigation with the Board of
Elections. Send that up the flagpole with your party at the county level, look into those decisions
that have been made to disenfranchise Suffolk County and Southold voters. Remove any hint of
political meddling by unelected people at Town Hall. Because I can tell you this, those of you
who do this, you will earn respect from this Democrat and probably many others. And who
knows, maybe you will earn a few votes too. Please, end your silence on the election fraud
issues, stand up for ethics, stand up for justice. Thank you for listening.

Kathryn Quigley, Greenport
KATHRYN QUIGLEY: Hi, my name is Kathryn Quigley, Greenport. I am here as
Chairwoman of the Southold Town Democratic committee to reiterate some of the things that
Doug Roberts said. Approximately one year ago, I came before you to address my concerns
about accountability and transparency within the Town Board and one of the reasons I spoke
about this issue is because I believe that one party rule carries a risk of fostering corrosive,
corrupt, anti-democratic behavior and in the absence of a balance of power among our elected
officials, transparency and open, consistent communication with voters can help alleviate those
concerns. However, I regret that today, about one year later, residents are learning firsthand of
the dangers of corruption and silence resulting from one party rule. On December 4"', two

Southold town residents were arrested for alleged fraudulent petition schemes involving the
Green Party. These individuals knowingly submitted nominating petitions for candidates
containing forged signatures, including signatures of people who had died. It has been well-
reported that these individuals are Board of Election employees, which is of course, deeply
concerning. What is also concerning, but in my opinion has been somewhat less reported is that
these individuals are both Southold Town GOP committeemen. In this position, they are
responsible for gathering signatures on petitions for all Southold Town GOP candidates. So
what does this have to do with you? You have all been and presumably will be again, Southold
Town GOP candidates. This means that this scandal relates directly to each of you. Now, let me
be clear, I am not implying that any of you were in anyway personally were involved in this
fraudulent scheme. What I am saying is now that these unfortunate acts have happened, it has
significant bearing on you as GOP elected officials. Official representatives that got you on the
ballot, the party that worked to elect you, the party that represented both you and the majority of
voters who voted you into your positions, have been arrested for election fraud. That is why,
frankly, as Doug said, that these arrests happened two weeks ago, their actions have been
reported on and known of for many months, yet none of you, no one on the Town Board has said
a word publicly so much as expressing concern, condemning their actions or calling for an
investigation into your own party to ensure that these fraudulent behaviors don't run more
deeply. Again, I am not implying you played a role in this, however, your subsequent failure to
speak out once these actions came to light, actions that erode voters trust in our democratic
systems, makes each of you complicit. What's more, it leads one to question your silence. Why,
as our town's elected representatives, public servants, have you not had the courage to speak up
with regard to a very concerning issue that so directly concerns the public and our trust in the
election process? Why not call for an investigation? How do we know that this fraud isn't more
rampant and hasn't been happening even beyond the Green Party line? Especially since they
have the actual authority to collect signatures for the GOP. Are you worried about what else you
might find? Are you satisfied with Mr. McGreevy's statement that the issue will be dealt with
internally, AKA secretly, behind closed doors and without transparency? I can assure you,
voters will not be content with that level of secrecy and corruption. It's this very culture of
secrecy that creates an environment in which cheating and fraud can flourish. I ask you, is this
the party that you want to run for reelection with? A party secretly sweeping its committeemen's
election fraud under the rug with no assurances that this fraud doesn't run deeper? We are
seeing election processes tested on a national level, time and again we are learning of ways that
GOP across the country have, as the Suffolk Times put it so aptly this week, looked to cheat to
win. It is deeply disturbing that we are seeing these same trends happening locally and it is
incumbent upon all of us to hold our elected officials and political parties accountable. As such,
I call on each of you to take a public position on this issue and to call on GOP Chair McGreevy
to bring the necessary reforms in order to protect your party, all voters and our political system.

LEROY HEYLIGER: Good evening, my name is Leroy Heyliger, I live in Mattituck. Deacon
at the Unity Baptist Church and I have two issues that I would like to address to the Board, first

is about our community on Factory Avenue, the African-American, Latino community and the
residents of the Cottages. I want to thank the Board for assigning your Deputy, Denis
Noncarrow to look into the matter about the trucks that we are having, the flow of traffic and any
improvements that can be done to alleviate the conditions on Factory Avenue. The speeding, the
parking of those trucks, etc., that has been going on for years and has been running over our
church property. He has been very diligent and I am looking forward to working with him in the
future as to the northern section, the residential section of Factory Avenue about pedestrian
walkway. I know there's a lot of questions up there, they don't want sidewalks put in but it's
gotten so hazardous now that something has to be done maybe a bike lane or some kind of a lane
there where they can move those mailboxes back a little bit so people and people going up and
down both sides of that street would have more room to walk and go over in the grass and it's
especially dangerous at night, when, a rainy night, almost hit somebody going through that
residential area. They had on dark clothing, it was raining and the next thing I knew, I had to
swerve out of the way. This lady, she was carrying a child in her arms. The other thing that, on
a personal matter, this local law public hearing, 1077, 1 am glad to see it's on here. I live right
there on Wickham Avenue and right by the Mattituck creek and I am very concerned that this
change would affect my quality of life and the quality of life of the residents of the Mattituck
creek. We have enough problems with the flow of the creek itself and environmentally it's a
very delicate area and the creek goes all the way down across the bottom of Wickham Avenue,
all the way down to as far as Wolf Pit and further on down and it floods and they have problems
and I want to ask the Board to, when this comes up, to consider the environmental impact and the
quality of life that is going to affect us. I understand that they want to take part of that Mattituck
Creek Lane, they want to change it to a Road and it's going to affect us in some way if they
change those, if they put those parcels in in that area and I would appreciate it so much if they
would consider this zone change. Thank you.

Ted Thirlby
TED THIRLBY: My name is Ted Thirlby, I live in Southold. I am here also to talk about the
recent charge of election fraud brought against members of this Southold Republican committee,
who are paid employees by the Board of Elections. We have all heard about this kind of thing
happening around the country but as it turns out, we are not isolated out here. It is upsetting to
me and to all of us that it is happening right here in Southold. This is an attack on core American
value and it's conducted by members of the Southold Town Republican Committee. The
Republican campaign theme for the last election was "Results" but what we are seeing with these
felony charges against committee members can only be understood as a result of low standards
and poor leadership in the committee. We should all recall that the last Town Board election was
extremely close, the seat was won by something like 34 votes.
COUNCILMAN GHOSIO: Thirty two.
MR. THIRLBY: Thank you. The question I have been hearing around Southold Town from
Democrats and Republicans alike is, if the Republican Committee BOE employees are willing to
commit felonies with petitions, what else were they willing to do? As Town Board members,
you need to understand this is question that is being asked by your constituents. This goes to the

very integrity of your seats here on the Board. Another question is, why have you as elected
officials of the Town made no statement about this matter? As our elected officers, you are not
on the Republican Committee but you now have a responsibility to represent the best interests of
everyone in Southold Town. An obvious part of that responsibility would be to make sure that
our local elections are free from fraud and meddling. As a voter of Southold Town, I ask that
you make a public position on these charges. And that you request the Suffolk District Attorney
investigate further into the workings of the Southold Town Republican Committee.
SUPERVISOR RUSSELL: Who else would like to address the Board?
Chris Larkin, Greenport
CHRIS LARKIN: Good afternoon, Chris Larkin. I am actually a fairly newly elected
Democratic committee person here in Southold and I was extremely upset to have learned that
my compatriots, have been alleged to committed this fraudulent activity and I really would say
that I urge you to speak out on it because there are so many questions, nationally, about whether
or not we can trust, what's real news, what's fake news and I think that we have our Democratic
committee person speaking out, (inaudible), I think it would be important for our elected officials
to speak out and I am glad to hear that Doug would be making a statement in the near future for
the Village, the Greenport Village but...oh, you did it already. Excellent. But I would urge you
to speak out and I would say that we are going to follow the DA's investigation and as Kathryn
said, we are not going to allow this to get swept under the rug. And I think, I urge you to get
ahead of it as opposed to behind it because if other things, I don't know these people but I would
say that maybe some other things have happened and you might want to be just ahead of the
game if something else comes out of this. Thank you.
