WITNESSETH,that the party of the first part,in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,
lyingand being in the village of Mattituck, Town of Southold, County of
Suffolk and State of New York, known and designated as Lot 3 as shown
on a certain map entitled "Map of Marratooka Point" and filed in the
Office of the Clerk of the County of Suffolk on March 19, 1.927 as Map
Number 331 and being bounded and described as follows:
BEGINNING at a point on present high water line of Great Peconic Bay
where the easterly side of Lot 2 on map aforesaid intersects said high
water line of Great Peconic Bay; thence North 5° 28' 20" West along
the division line between Lots 2 and 3 and land (now or formerly) of
Kristine M. _Powers 2013 Trust, 197.15 feet to the observed high water
line of Deep Hole (Gardiner's) Creek; thence running a tie course of
South 85° 33' 17" East along the observed high water line of Deep Hole
(Gardiner's) Creek 56.18 feet to the westerly line of Lot 4 and land
(now or formerly) of Giacone; thence South 8° 50' 30" East along the
division line between Lots 4 and 3 and last mentioned land, 173.57
feet to the observed high water line of .Great Peconic Bay; thence
South 72° 17' 56" west along the observed high water line of Great
Peconic Bay 67.07 feet to the point or place of BEGINNING. .
BEING AND INTENDED TO BE the same premises described in a deed made
by John D. Carey as Executor of the Estate of Joseph J. Carey and,
recorded June 30, 1988 in Liber 10635, at page 534; and in a deed made
by Ann Cassidy and recorded July 27, 2016 in Liber 12873, at page 38.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other.purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
