paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or

BEING AND INTENDED TO BE the same premises as conveyed to the Grantor by deed made by George W.
Kreiling and Frances V. Kreiling dated July 3, 2007 and recorded September 24, 2007 in Liber 12523 Page 612 in
the Office of the Clerk of Suffolk County.
The Grantor is the is the same person described as Grantee in deed dated July 3, 2007 and recorded September 24,
2007 in Liber 12523 Page 612 in the Office of the Clerk of Suffolk County.
TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads
abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party first part
will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.

ALL that certain plot, piece or parcel of land, situate, lying and being on Lupton's
Point in Mattituck, Town of Southold, County of Suffolk and State of New York,
and bounded and described as follows:
BEGINNING at a monument set on the northerly line of a twenty (20)foot right of
way hereinafter described at a point one hundred (100.00) feet westerly along
the northerly line of said right of way from the southwesterly corner of land of
William F. Eske and about eight hundred twenty (820.00) feet easterly along said .
line of right of way from the easterly line of Marratooka Road;
From said point of beginning running in a northerly direction along the easterly
line of lands of Blanche L'Hommedieu Weese, the following two courses and
distances:
1) North 10 degrees 14 minutes 50 seconds West, 100.00 feet to a monument;
2) North 28 degrees 44 minutes 00 seconds East 107.00 feet, more or less and
through a monument to the ordinary high water line of Deep Hole Creek;
RUNNING THENCE in a southeasterly direction along the southerly line of Deep
Hole Creek, South 64 degrees 54 minutes 40 seconds East, 40.07 feet to the
westerly line of lands of William F. Eske;
RUNNING THENCE South 10 degrees 14 minutes 50 seconds East, 160.00 feet
to the northerly line of said twenty(20) foot right of way;
RUNNING THENCE in a westerly direction along the northerly line of said twenty
(20) foot right of way South 79 degrees 45 minutes 10 seconds West, 100.00
feet to the point or place of BEGINNING.
TOGETHER with a right of way over the twenty (20) foot wide private road to and
from the premises hereby conveyed to Marratooka Lane, and to and from Deep
Hole Creek at the end of said twenty(20) foot private road where it adjoins Deep
Hole Creek on he easterly end of Lupton's Point.
Together with riparian rights in and to Deep Hole Creek, and all of the right, title
and interest of the party of the first part in and to the lands under the waters of
