Chairman Orlowski: Good evening. I would like to call this meeting to order. The first
order of business is to set Monday, February 10, 2003, at 6:00 p.m. at the Southold
Town Hall, Main Road, Southold as the time and place for the next regular Planning
Board Meeting.
Mr. Cremers: So moved.

PUBLIC HEARINGS
Chairman Orlowski: 6:00 p.m. - Starkie, George & John - This proposal is to set off a
1.94 acre lot with an existing house from an 18.76 acre lot. The property is located
north of the Main Road, between Cox's Lane & Depot Lane in Cutchogue. SCTM#1000-
96-3-2

Are there any comments on this proposed set-off? Not hearing any, are there any
questions from the Board? Since there are no questions from the Board, I will entertain
a motion to close the hearing.

What is the pleasure of the Board?
Mr. Edwards: Mr. Chairman, I'd like to entertain the following motion:
WHEREAS, this proposal is to set off a 1.94-acre lot with an existing house from a
18.76-acre lot, north of the Main Road between Cox's Lane and Depot Lane in
Cutchogue; and
WHEREAS, on November 14, 2001, the Town of Southold purchased the Development
Rights on the remaining 16.82 acres of property; and
WHEREAS, the Southold Town Planning Board granted sketch plan approval to the
subdivision map, dated March 9, 2001, on May 14, 2001; and
WHEREAS, the Planning Board, pursuant to the State Environmental Quality Review
Act, (Article 8), Part 617, performed a review of this Unlisted Action, made a
determination of non-significance and granted a Negative Declaration on May 14, 2001;
and
WHEREAS, due to the fact that Lot 1 is improved with a residential structure and the
Development Rights have been sold on Lot 2 to the Town of Southold, the Park and
Playground Fee is not applicable and therefore waived; and
WHEREAS, all conditions and requirements of the Subdivision Regulations of the Town
of Southold have been met; and
WHEREAS, the applicant has received approval from the Suffolk County Department of
Health, dated October 18, 2002; be it therefore

RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated June 11,2002, as revised, and authorize the Chairman to endorse the final
surveys.

Hearings Held Over From Previous Meetings:
Chairman Orlowski: Fishers Island Club, Inc. - This proposed site plan is for a 3,200
sq. ft. equipment storage building with an attached 800 sq. ft. covered equipment wash
pad. The property is located on East End Road on Fishers Island. SCTM#1000-1-1-

Right now, we're still waiting for- they're at the Zoning Board of Appeals and we're
waiting for their decision. If anybody wants to make a comment on this, they can.
Otherwise, I'll entertain a motion to keep this hearing open.

Chairman Orlowski: Harbes, Edward III & Monica - This proposed set-off is for 2 lots
on 44.219 acres on the north side of Sound Avenue in Mattituck, 2,174' west of Aldrich
Lane. The lot to be set off is 1.843 acres. SCTM#1000-112-1-7
This hearing is still open. There are some outstanding things that we're looking at and
we've talked to the applicant about it. I don't know if you want to make a comment for
the public hearing?

Edward Harbes, 111: No, not at this time.

Chairman Orlowski: North Fork Bank - This proposed site plan is for a new 20,895 sq.
ft. two-stow addition. The property is located on the north side of Main Road in
Mattituck, one quarter mile west of Factory Avenue. SCTM#1000-122-6-20 & 22
This is also at the ZBA waiting for their determination before we make a decision. The
hearing is going to be held open. If anybody wants to make a comment now, they can.
Joseph Fischetti: Just two quick updates. We have received approval from the Health
Department. We're just waiting for another copy. I have only two copies in my hand
right now. We are also, again, making revisions to the covenants on the parking that we
had discussed. The ZBA Hearing is on Thursday. We have changed the site plan on
the parking and curbing for the west side and all the plans that Victor wishes will be in
the Board's hands within when the next meeting is held. When is the next meeting?
Mr. Cremers: February 10th.
Mr. Fischetti: February 10th, NO problem. We'll have it in about two weeks.
Chairman Orlowski: O.K. Very good. Any other comments? Hearing none, I'll entertain a

Chairman Orlowski: Perino, Joseph - This proposed major subdivision is for 7 lots on
20.8211 acres. The property is located on the south side of Main Road, 150' west of
Sigsbee Road in Mattituck. SCTM#1000-122-7-9.
This is tied up in the moratorium right now and the hearing is held open while, I guess,
the Town Board is addressing the waivers. I'll entertain a motion to keep this hearing
open.

Chairman Orlowski: Island Health Project, inc. - This proposed lot line change is to
merge a 10,890 sq. ft. parcel, SCTM#1000-9-2-6.2, with a 12,565 sq. ft. parcel,
SCTM#1000-9-2-8, creating a 23,455 sq. ft. parcel. The properties are located at the
north corner of Oriental Avenue and Crescent Avenue on Fishers Island.
I don't know if anybody has a comment. This hearing has been open for a year so. I'll
entertain a motion to keep this hearing open.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET
OFF APPLICATIONS
Final Determinations:
Chairman Orlowski: Baxter Sound Estates - This proposed minor subdivision is for 2
lots on 4.65 acres. The property is located on Oregon Road, west of Bridge Lane in
Cutchogue. SCTM#1000-72-2-2.1
Mr. Cremers: Mr. Chairman, I'll offer the following:
WHEREAS, the proposed minor subdivision is for 2 lots on 4.65 acres in the R-80
Zoning District where Lot 1 equals 3.24 acres and Lot 2 equals 1.41 acres; and
WHEREAS, this subdivision was granted conditional final approval by the $outhold
Town Planning Board on August 13, 2002; and
WHEREAS, the applicant has posted a performance guarantee in the form of a certified
check, number 67466750 in the amount of $60,425.00, to satisfy the bond estimate;
and
WHEREAS, the Planning Board accepted the certified check on November 4, 2002 and
the Town Board on November 7, 2002; and
WHEREAS, the applicant has submitted an Administration Fee in the amount of
$3,625.00 to the Planning Board Office; and
WHEREAS, the applicant has submitted a Park and Playground Fee in the amount of
$10,000 to the Planning Board Office; and
WHEREAS, the applicant has submitted the covenant and restrictions filed on Liber
12214, Page 376 with the Office of the Suffolk County Clerk to the Planning Board
Office; and
WHEREAS, the applicant has submitted a letter of non-jurisdiction from the Department
of Environmental Conservation, dated November 6, 2002, to the Planning Board Office;
and
WHEREAS, all conditions of conditional final approval have been met; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore

RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated November 19, 2002, as revised, and authorize the Chairman to endorse the final
surveys.

SITE PLANS - STATE ENVIRONMENTAL QUALITY REVIEW ACT
Determinations:
Chairman Orlowski: Chris Mohr Landscaping - This proposed site plan is to construct a
3,057 sq. ft storage building in a landscape contractor's yard. Access to the site will be
provided via a common driveway agreement with the adjacent property. The property is
located on the north side of CR 48, 700' west of Cox's Lane in Cutchogue. SCTM#1000-
96-1-20.1
Mr. Cremers: Mr. Chairman, I'll offer the following:
BE IT RESOLVED that the Southold Town Planning Board, makes a determination that
the proposed is a Type II Action and is not subject to review pursuant to 6 NYCRR Part
617.5.

the proposed is a Type II Action and is not subject to review pursuant to 6 NYCRR Part
617.5.

locate up to twelve communications antennas on an existing monopole and install
related equipment and fencing. The property is located on the north side of CR 48,750'

Mr. Cremers: I'll offer the following:
BE IT RESOLVED that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, establishes itself as lead agency, and as lead
agency, makes a determination of non-significance and grants a Negative Declaration.
