SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated August 24, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 20,881 square foot non-conforming lot located in a R-40 Zoning District. The northerly property which runs adjacent to Fleetwood Road and measures 129.20 feet (70.00 feet lies within a flood zone with 40.7 feet measuring southerly), the easterly property measures 200.10 feet, the southerly property measures 64.10 feet and the westerly property which runs adjacent to Hamilton Avenue measures 231.65 feet. Currently there is a single-family cottage which the applicant wishes to demolish along with another accessory barn building that will also be demolished. There is an existing one-story one car garage located in the front yard adjacent to Hamilton Avenue which the applicant will keep and renovate as shown on the survey last amended April 24, 2018 by John T. Metzger, L.S. This property is located in the Fleets Neck community which has many small homes as it was a summer waterfront community. The subject property and other nearby properties occasionally flood and the Town has been assisting to remedy the flooding. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15 and the Building Inspector's July 6, 2018, Notice of Disapproval based on an application for a building permit to demolish and existing single - family dwelling and accessory barn and build a new single-family dwelling and accessory 3 car garage with a second story workshop with half bath, at; 1)existing accessory one car garage located in other that the code required rear yard; 2) proposed accessory garage partially located in other than the code required year yard; at 550 Fleetwood Road, Cutchogue,NY. SCTM#1000-137-5-1. RELIEF REQUESTED: The applicant requests variances to demolish an existing single-family dwelling and accessory barn and build a new single-family dwelling and accessory garage at 550 Fleetwood Road, Cutchogue, Page 2, December 20, 2018 #7224, LoGrande SUM No. 1000-137-5-1 NY. SCTM#1000-137-5-1. The proposed construction on this non-conforming 20,881 square foot lot in the R-40 District is not permitted pursuant to Section 280-15, which states that accessory buildings shall be located in the required rear yard. An existing accessory one car garage will remain in the front yard, and the proposed accessory garage will be partially located in the front yard. The site plan drawing by Mark K. Schwartz, Architect shows a new two-story wood frame residence of 2,369.1 square feet with a detached 3 car garage with a second story with a workshop and a have bath measuring 1,747.5 square feet. The plan's site data indicates that the old septic system that will be abandoned and a new septic system installed. New leaders and gutters will be installed as well as drywells installed for both the new residence and the proposed three car garage. ADDITIONAL INFORMATION: At the Public Hearing held on December 6, 2018 several neighbors to the subject property gave testimony and several letters were received from residents asking the Board to consider the large scope of the project and objected to the large three-car, two story garage. They reasoned that the improvements would be too large and would dramatically change the character of the neighborhood. One neighbor expressed that the location of the garage would cause a problem of headlights shining into his home when cars pull into the garage. Additionally, the neighbors were concerned with too many trees being cut to accommodate the large home and the garage, which would lead to more flooding in the area, as evidenced by photographs that were submitted; a situation already occurring in the neighborhood. The existing one car garage has a pre-existing Certificate of Occupancy issued on November 3, 1995 to the previous owners. The applicant was asked to update the site plan, (pages S-1 & S-2), in order to correct information relating to front yard setback averaging. A site plan prepared by Mark Schwartz, Architect was revised on December 6, 2018 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 6,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area and community of Fleets Neck is comprised of mostly smaller homes and seasonal cottages. While the proposed home will be larger than most nearby homes the large size of the proposed three (3) car two story garage with a workshop and half bath along with the renovation of the existing one car garage on a small property exceeds what can practically be built on the lot. There is no evidence that there are multiple garages in nonconforming locations in the surrounding area. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The size of the garage could be scaled down and moved to a conforming location. The existing garage has room for one car. Moreover, the Board did not receive any information as to the intended use of the second floor workshop in the proposed three car garage. 3. Town Law &267-b(30)(3). The variances granted herein is mathematically substantial, both representing 100% relief from the code for having a non-permitted front yard location. However, the existing one car garage already has a Certificate of Occupancy and will only undergo renovation to conform to the look of the new residence. Evidence has been submitted to suggest that the requested variances in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The neighbors and residents of the area wrote letters and testified at the Public Hearing that they object to such a large project in their community and such a large project would be detrimental to the character of the community as a whole. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitation on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a two story accessory garage with a workshop and half bath while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Planamento, and duly carried,to 1) GRANT the variance for the existing one car garage, and shown on the survey last amended by John T. Metzger, LS dated April 24, 2018 and the Site Plan drawn by Mark K. Schwartz, Architect dated December 6, 2018, and; 2) DENY the variance for the proposed two story, three (3) car garage with a workshop and half bath as shown on the survey last amended by John T. Metzger, LS dated April 24, 2018 and the Site Plan drawn by Mark K. Schwartz, Architect dated December 6, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The existing one car garage shall remain unconditioned space. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three Page 4, December 20, 2018 #7224, LoGrande SUM No 1000-137-5-1 (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. The property line for 550 Fleetwood Rd is the tree line on the left side of the pictures. While I recognize the need and desire for the Logrande family to upgrade I believe this project, as it is put forth today, would negatively impact the surrounding properties including the drainage in the adjacent streets (Fleetwood Rd and Hamilton Avenue). It is for these reasons I oppose this proposal and would ask the board to deny the building permit as it exists today. We have owned at home at 385 Glenwood Road, two houses up the street (a thirty second's walk) from the proposed development for almost two and half decades, and spend large periods working and living there year-round. There has been significant development, building, and rebuilding in the area during those years, much of it thoughtful, even beautiful, some of it clearly violating the NY State prohibition that structures and configurations not be "seriously out of place in [a] neighborhood." New constructions of this type have usually had serious environmental impacts not just on adjacent properties (where damage has been most severe), but on the local area more broadly, where we have experienced dramatic loss of habitat for the beneficial insects, mammals, birds, and other wildlife that are critical for healthy soil and garden maintenance (including, critically, drainage), as well as agriculture, and which are essential parts of the life we cherish in this part of Long Island. We have never opposed a single variance before, although much recent construction has given us cause for concern, though not at this level. We have never before seen a local plan so wildly out of character with other construction anywhere nearby and so likely to cause immediate and serious harm to adjacent neighbors, especially in view of a) the frightening rate of tree clearing already occurring next to the lot and nearby, which has exacerbated the flooding already growing much worse each year as a result of global climate issues. The street immediately in front of the proposed development was badly flooded in late October, and the area briefly lost power. Flooding occurs in this area more and more. Additional tree clearing and large construction will only make the problem more severe. b) the planned three-car garage with two-story addition, which will sit like a virtual apartment building at the property line of the tiny bungalow next door—a structure which is much more typical of the houses in the area, many of which, especially those along Fleetwood, were designed as summer cabins. The entire McMansion structure is grossly out of character in size, design, and conception with anything in the neighborhood and is environmentally radically unsound. But just as I would not build out my property to severely adversely impact my neighbor, I would not like to see any property owner be permitted to build out any property in our town to severely adversely impact any neighbor. And to the decision makers, may your heads and hearts be clear and may they point in the same direction. The subject property owner/ applicant is asking you to apply rules written for large 4 sided properties to a small 3 sided property. The relief requested is completely outside the bounds of what is appropriate and permissible. Thank you, Carol McMahon 135 Case Road Cutchogue, NY 1 DI 122 c�2?, DEC - 12019 My Case against the Variances for 550 Fleetwood Road 275 Hamilton Avenue is a house my grandparents bought in the 1950's and for which my son is the 4 1 generation of my family to enjoy. My concerns about the proposed development for the neighboring property at 550 Fleetwood Road are these: 1) My grandparents named the house "Happy Hollow". It was customary back then to give houses on Fleet's Neck names and many— like mine still does—had signs hanging on their fronts with the names painted on thein. My grandparents chose the name "Happy Hollow"because the property is in a hollow, meaning the land is depressed, slightly below the level of the surrounding land, most notably the road it is on, Hamilton Avenue. From time to time we have had problems in the basement with flooding, which would be as high as two feet. Our hot water heater would either need to have its igniter replaced or it would be destroyed and need replacement; the last time the heater needed to be replaced because of flooding was in July, 2010, and when it was replaced I instructed the installers, Bert's Reliable, to place the heater on top of as many cinderblocks as was possible in order to keep the heater above the flood waters. Similarly, when I had an HVAC system installed in 2016 I asked the installer, Star Mechanical, to install the unit on the ceiling for the same reason. I have a major concern that the proposed development will increase the intensity and frequency of flooding on my property. This is because the plans call for the construction of a large three-car garage with two stories and a bathroom and its associated asphalt paving up to the property line, which will require the clear cutting of the existing trees and the paving of the ground. With this I will lose the percolation of water into the soil that is currently in the area and the respiration of additional water into the atmosphere provided by the vegetation. I back up my concern with an article from the Suffolk Times, "Southold Town May Restrict Tree Clearing on Residential Properties" (published on May 31, 2016) in which Town Supervisor Scott Russell "said he believes tree removal legislation should be drafted through the lens of the town's drainage code, since clear-cutting properties affects the ground's ability to absorb stormwater. 'Tree-clearing has community impacts it's not just private property rights,' he said." Were the garage to be built within the area of the property that does not require a variance it would alleviate the water issue for my property. 2) The state rules concerning variances as outlined in the document "Zoning Board of Appeals" by James A. Coon prohibit, among other things, that the "alteration being proposed will result in a structure or a configuration that will be seriously out of place in the neighborhood". The proposed development will be seriously out of place in the neighborhood, a neighborhood which consists of more modest structures, none of which have a three-car garage, let alone a three-car garage with two stories.
