Mattituck,NY SCTM No. 1000-144-2-6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 8, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 14,000 square feet, .321 acre parcel located in the R-40 Zoning District. The property measures 100.00 feet to the westerly property line along Sigsbee Road, 140.00 feet to the northerly properly line, 100.00 feet to the easterly property line and 140.00 feet to the southerly property line. The parcel is improved with a one-story frame dwelling(demolished to the foundation) and a detached accessory garage in the side yard as shown on a survey prepared by Michael K. Wicks Land Surveying dated October 5, 2016 and certified to Tracy Peck, Bethpage Federal Credit Union and First Equity Abstract Corporation and the Proposed Site Plan prepared by Mark Kevin Schwartz, Registered Architect, dated October 17, 2017 and updated June 14, 2018. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's June 25, 2018, Amended July 20, 2018, Notice of Disapproval based on an application for a building permit to demolish an existing single family dwelling and construct a new single family dwelling, at; 1) located less than the code required minimum front yard setback of 35 feet; located at: 1305 Sigsbee Road, Mattituck, NY. SCTM No. 1000-144-2-6. RELIEF REQUESTED: The applicant requests a variance to demolish an existing single-family residence with a front yard setback of 39.8 feet and to construct a new residence with a front yard setback of 31.8 feet where the code requires a minimum of 35 feet. Page 2, September 21, 2017 #7087, Peck and Corbett SCTM No. 1000-144-2-6 ADDITIONAL INFORMATION: The applicant is the beneficiary of ZBA decision #7087 issued September 25, 2017 granting a reduced front yard setback of 31.8 feet allowing for the addition of a single story extension of the existing residence on the front and northern side of the house consisting of 510 square feet along with a proposed front yard setback of 33.8 feet to accommodate the addition of a front porch of 96 square feet. The original front yard setback from the facade of the residence, prior to any addition, according to the applicant's survey is 39.8 feet. Additionally, an existing accessory garage, located in the front yard, has a setback from Sigsbee Road of 39.7 feet. Decision #7087 clearly indicates: "Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. " Contrary to the authorization granted in the September 2017 decision, the applicant demolished the subject residence without the benefit of a permit and commenced construction of a new residential structure. A notice of Stop Work was issued on April 27, 2018. On May 24, 2018 the ZBA responded in writing to the applicant's architect declining their request for approval of a De Minimus demolition of a single family dwelling. A public hearing regarding this application was held on November 1, 2018 attended by only the applicant's agent who indicated that the applicant did not understand that by demolishing the existing house they would encounter an issue rebuilding. The agent was unable to articulate the reason why the house was demolished and speculated that it was the result of possible termite or other `hidden' damage which caused structural problems. As a courtesy, the application was adjourned to the December 6, 2018 public meeting in order to allow the owner to appear before the Board to personally explain the individual circumstances of this demolition and their need to seek a variance to construct a new dwelling. At the December 6, 2018 public hearing the applicant provided two photos of the project prior to and after demolition and did not convey the reason for the demolition, offer supporting professional evidence, or share collaborative guidance from the Town Building Department or any testimony, when it was discovered that there was structural damage. At this public meeting, the applicant was again afforded additional time to procure letters from the architect and the demolition firm used to support the applicant's claim of the discovery of severe structural damage. On December 20, 2018, a letter was received from the design professional stating that he had been to the site prior to construction and most structural areas were finished and observation of existing framing was not available. He did not observe major deflection or damaged areas. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 6, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. While Sigsbee Road is improved with approximately 63 homes with varied front yard setbacks and non-conforming lot sizes and lot widths, the subject parcel is twice the size of the majority of developed lots in the immediate neighborhood. The parcel is currently improved with a pre- Page 3, September 21, 2017 #7087, Peck and Corbett SCTM No. 1000-144-2-6 existing one car garage. The house that previously stood at this address has been demolished and as such, future development of the site should conform,when possible, to the current Town Code. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could move the proposed one story residence to a conforming location without hardship, working off of the original footprint and foundation of the now demolished house. 3. Town Law 4267-b(3)(b)(3). The variance requested for the proposed one story residence is mathematically substantial, representing 9.4 % relief from the code. Variances granted on Sigsbee Road, in the past, have been for renovations and additions to existing homes and not for new construction. 4. Town Law &267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code when the site is developed. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single family residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings. 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Sigsbee Road is improved with 63 homes with varied front yard setbacks and non-conforming lot sizes and lot widths. The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant could conceivably move the proposed one story addition further toward the; rear of the home and reduce the depth of the proposed front porch to a depth of 4 to 5 feet; however, the applicant's representative described difficulty in reconfiguring the alterations when reviewing that options because of the existing floor plan and layout of the home and the need for a porch depth that is functional. 3. Town Law &267-b(3)())(3). The variance granted herein for the proposed one story addition is mathematically substantial, representing 9.4 % relief from the code. The variance granted for the proposed front porch addition is not substantial representing; 3.4 % relief from the code. Elowever, these variances are mitigated by the many non-- conforming front yard setbacks on Sigsbee Road and the fact that the Board of Appeals granted a front yard setback of 24 feet for a covered porch addition in April of 2016 (Appeal No. 6935) for a residence at 1330 Sigsbee Road which is almost directly across the street from the subject property. 4. Town Law §267-b(3) b 4 No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(k)(5)_ The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The overall objective of the Zoning Board is to grant the smallest variance possible. 6. Town Law &267-b.
