By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SSE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SETS REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that applicant has ample room in the rear yard to locate the accessory building, that strong winds in this area are a common hardship, and that the accessory building can be properly anchored. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hardship; the hardship created is not unique and would be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will change the character of the neighborhood, and will not observe the spirit of the Ordinance. THWREFORE IT WAS RESOLVED George A. Kophen, Sunset bane, Southold, New York, be DENIBD permission to build garage and reduce required side yard and setback on property located on the north side of Middle Road, Mattituck, New York. The Board also stipulates thtt the accessory building (garage) be relocated to the rear yard within ninety days (90 days) from November 2, 1972.
