That the said Board of Trustees and the Town of Southold are released from any and all damages,or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. Box 582 Bohemia, NY 11716 RE: BRIAN PARKER & SHERI WINTER CLARRY 225 WILLIAMSBURG DRIVE, SOUTHOLD SCTM# 1000-78-5-14 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 14, 2018 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of BRIAN PARKER & SHERI WINTER CLARRY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 16, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to install a 5'x5' cantilevered platform; a 30"x14' aluminum ramp; and a 6'x20' floating dock secured by two (2) 10" diameter piles; and to install and perpetually maintain a 10' wide non-turf buffer which is inclusive of the decking along the landward edges of the bulkhead be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to remove existing timber bulkhead and construct approximately 15' landward of existing 101 linear feet of new vinyl bulkheading with a 6' wide by±95' long and 6'wide by±15' long non-treated lumber decking along the landward edges of the new bulkheading; remove approximately 125 cubic yards of fill from the landward side of exiting bulkhead in order to construct new more landward bulkheading; be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: requiring that turbidity controls be in place; and, 2 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 14, 2018, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of BRIAN PARKER & SHERI WINTER CLARRY to remove existing timber bulkhead and construct approximately 15' landward of existing 101 linear feet of new vinyl bulkheading with a 6'wide by±95' long and 6' wide by±15' long non-treated lumber decking along the landward edges of the new bulkheading; remove approximately 125 cubic yards of fill from the landward side of exiting bulkhead in order to construct new more landward bulkheading; install a 5'x5' cantilevered platform; a 30"x14' aluminum ramp; and a 6'x20'floating dock secured by two (2) 10" diameter piles; and to install and perpetually maintain a 10' wide non-turf buffer which is inclusive of the decking along the landward edges of the bulkhead; with the condition that turbidity controls be installed during construction; and as depicted on the site plan prepared by Jeffrey Patanjo, dated October 23, 2018, and stamped approved on November 14, 2018. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, on November 9, 2018 the Southold Town Board of Trustees found the application of BRIAN PARKER & SHERI WINTER CLARRY to be an Unlisted Action Negative Decision pursuant to SEQRA Rules and Regulations. A Short Environmental 0 Assessment Form and a field inspection have been completed by the Board of Trustees; and it is hereby determined that it will not have a significant effect on the environment, and; WHEREAS, the Southold Trustees are familiar with this project having visited the site on November 7, 2018 and having considered Jeffrey Patanjo plans for this project last dated October 23, 2018 showing the proposed bulkhead, dock and water depths, a Kenneth M. Woychuk, Land Surveyor survey last dated January 16, 2018, and a John Gerd Heidecker, Land Surveyor bathymetric survey dated October 19, 2018, and; WHEREAS, in reviewing the project plans last dated October 23, 2018, and water depths on the bathymetric survey dated October 19, 2018, it has been determined by the Southold Town Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • Navigation: The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation, and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Toxicity: The proposed dock decking shall be constructed entirely of non-toxic materials. • Scope in relation to the riparian rights of shellfishers: The plan allows a standard ramp to float design that will not impede access for small vessels at low tide, and those seeking shellfish and crustacea on foot in season. • Scope in relation to view sheds: The seaward end of the proposed dock lies landward of all existing docks that frame the view shed. As such the perspective will not be discernibly different from the existing view. • Environmental upkeep: The dock design projects a lifespan of 30 years, and with limited pile replacement minimizes bottom disturbance. THEREFORE, on account of the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. SCTM# 1000-78- 5-14 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Although it is recognized that the proposed bulkhead is presented as new construction, permits for the existing bulkhead could not be located within Town records and it was constructed without Board review and a Wetland Permit. The proposal to install a 5'x5' cantilevered platform; a 30"x14' aluminum ramp; and a 6'x20' floating dock secured by two (2) 10" diameter piles decking along the landward edge, removal of fill and establishment of a 10' wide non-turf buffer is recommended as CONSISTENT. In the event the action is approved the following is recommended to further Policy 6. 1. Require turbidity controls in compliance with Chapter 275. 2. Require that the 10' wide non-turf buffer be vegetated with native plant species.
