SEE REVERSE Vy 41; ZONING BOARD OF APPEALS FORM ZB4 2 ,r 3 APPe s /Marjorie McDermott Secretar Southold Towm Boara of Appeals After investigation and inspection the Board finds that applicant requests a special exceptoon to use premises and operate a commercial storage building on the south side of Corwin Street, Greenport, New York. The property is near the Incorporated Village of Greenport bounded on the north by Corwin Street, east by Seventh Street, south by the Long Island Railroad; and west by Eighth Street. The special exception is requested because of the recent amendment of the Zoning Ordinance which makes the wholesale storage and warehousing use to which the structure on the premises Is and has been put for more than fifty years a non-conforming use. The property is on a railroad siding and is an ideal location for this type of use; it has been used for storage since right after World War I. The Board agrees with the reasoning of the applicant. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. THEREFORE IT WAS RESOLVED Thomas and Virginia Jernick, Shelter Island, New York, be GRANTED permission to use premises and operate a commercial sterage °building. Location of property: south side of Corwin Street, Greenport, New York. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Grigonis, Hulse, Doyen. The property is near the Incorporated Village of Greenport bounded on the North by Corwin Street, East by Seventh Street, South by the Long Island Railroad and West by Eighth Street (sketch attached). The use to which it has been put since before any zoning ordinance was enacted in the Town has been the same or similar to the use to which it has been put during the time there has been a zoning ordinance. The property is presently being used for wholesale storage and warehousing and will continue to be used for such a use under the prospective ownership of persons who will rent it to the East End Supply Company, Inc. It is submitted that inasmuch as (considering the railroad right-of-way as a street) the property embraces an entire block and since the premises enjoyed a legal use for so many years, the application should be granted. 7552 STATE OF NEW YORK qty/ ...._ .... oa, ....._. ....._...._...._...... TEE CHAIRMAN: Tho application is accompunied by a survey ind1c~t1ng that the property is approximately 100 feet on the westorly boundary, is 249 feot in length on tho Long Island Railroad and thore is a warehouse on the property extending about two-thirds ot the length of the property parallcl to tho Long Island Railroad. TUE CHAIRMAN: Is th<!lre anyone prosont .lho wishes to speak for this application? STANLSY S. CORWIN, ESQ.: I Qmt~o attorney for the poople who are Going to beoome purchasers of tho property. There is presently a contract betweon Thomas and Virginia Jernick and Walter and Harry Burden. The property is on a railroad siding and it is an ideal lecation for the type of business that they wish to conduct and it is the type of business that has been conducted there for fifty years whon my father put the building up. It has al'1&ys been used for storage, since riGht after World War I. I ",I > ( ( ( Southold Town Board of ~ppe~la -17- May 25, 1972 Th~ C~\IR~tN: Do thoy propose to chango tho building? MR. COmaN: Thoy m:;.y chango tho doorw:;:.;rs but there will be no structural changes. MR. ROWARD TERRY, Building Inspector: ~ocauso of tho fact that they occupy a wholo block, I think that for thair protection in case of fire tho setback linos should bo rocogniz&d so that if they ever want to robuild thoy would havo ~omothing to start with. Historically, that whole block has had non-conforming use ~ith tho excoption of the Mills building. Wo should recognize the exictinz setback lines in caso thoy should want to robuild. TllE C~IRMA:N: Tho Board recognizes the applicant's right to vary tho front yard setback to a reasonable distance based on the size of tho lot. MR. CORWIN: The reason tho lot is longo~ on one side than on tho othor is that it pro-datod tho railroad. TEE C~!"IRMAN: Is thero anyono p::,",sont who .lishes to spe" against this application? (Thoro was no rosponse.) THE CH.'l.IRYJI\N: Are thero any questions? MR. HOWARD TERRY, Building Inspector: Bocause of its proximity to the Village we have to have approval of tho County Planning Commission. After invG~tigQtion and inspection the Board finds that ~pplicant requosts Q Spoci~l Excoption to use promises and operate a cOmmorciQl storage building on tho south sido of Corwin Street, Groonport, Now York. Tho property is near tho Incorporated Village of Groonport bounded on tho north by Corwin Stroot, east by Seventh Stroet, south by tho Long Island Railroad, and wast by Eighth Street. The special exception is requestod bocQuse of tho recent amendment of tho Zoning Ordinanco Which mAkos the wholosale storage and warehousing use to which tho structuro on the promises is and has boen put for more than fifty years a non-conforming use. The property is on a railroad siding and is an ideal location for this typo of uso; it has boen used for storage sinco right after World War I. The Board agrees with tho reasoning of the applicant. The Board finds that tho public convenionce and welfare and justice will be servod and the legally established or permitted use of noighborhood property and adjoining use districts will not be pormanently or substantially injurod and the spirit of the @rdinance will be observed.
