After investigation and inspection the Board finds that
applicant requests permisslou to divide property- Lots #3, 4 and
5, Map of Cedar Beach Park, Seuthold, ~ew York. The findings of
the Board are that if division of property' were allowed there
would be many' more requests for division. The Board agrees that
the acre lot size as required by' the Zoning Ordinance should be
upheld.
The Board finds that strict application of the Ordinance
would not produce practical difficulties or unnecessary hardship;
the hardship created is not unique and would be shared by' all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will change the character
of the neighborhood, and will not observe the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED Farm View Building Co., Inc., 54 James
Street, Patchogue, New York, be DENIED permission to divide property';

REASON FOR APPEAL

1. STRICT APPLICATION OF THE ORDINANCE would pr~uce practicaldifficulti~ orunn~es-
sa~ HARDSHIP becau~ the applicant wishes to divide Lots 3, 4 and 5 into
two separate building lots with each having less than 40,000 sq. ft.,
as required by the present Southold Tow~ Zoning Ordinance.
2. The ha~shipcreatedis UNIQUE andisnotshared by all propedies alike in the immediate
vicini~ ofthis prope~y and in this use di~rictbecouse most of the other parcels in
this subdivision are already in single and separate ownership, and
almost all have a frontage on subdivision roads of 100 feet. In order
for the applicant, a contractvendee, to utilize s~id Lots 3, 4 and 5
under the present Southold Town Zoning Ordinance, it would be necessary
to treat the foregoing lots as a single parcel with a frontage on
Cedar Beach Road of 300 feet. Such Utilization of land would be out
of character with all of the other lots in the subdivision.
3. The Variance would obse~e the spirit of the O~inance and WOULD NOT CHANGE THE
CHARACTER oF THE DISTRICT because the lots are situated in an old subdivision
in which the major portion of the lots have a frontage of 100 feet on
existing roads, and areas ranging from approximately 14,500 sq. ft. to
20,000 some odd sq. ft. Upon the granting of this variance, each of the
divided lots would have an area in excess of 20,000 sq. lb, and each
would appear more attractive as buildable lots for a residential
dwelling.
