SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 8, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,401 square foot parcel located in an R-40 Zoning District. The parcel is oddly shaped and is accessed by a right of way from NYS Route 25. The parcel measures 175.00 feet along the right of way and then turns west for 60.60 feet before turning north for 50.00 feet and then turning west for 100 feet. The parcel then measures 100 feet on the Northwest side, 258.86 feet on the northeast side, 150 feet on the east side along a private road, known as Birds Eye Road, and 129.55 feet on the south side. The parcel is improved with a two and one half story frame house and garage with wood decks, a frame building, and a tennis court under construction. All is shown on a survey by Nathan Taft Corwin, III, LS dated May 22, 2006 and revised July 13, 2018. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and the Building Inspector's July 3, 2018 Notice of disapproval based on an application for building permit to relocate an accessory tennis court; at: 1) located in other than code required rear yard; located at 500 Stephenson Road, Orient,NY. SCTM No. 1000-17-1-6. RELIEF REQUESTED: The applicant requests a variance to re-locate an existing tennis court in a front yard to another front yard location which shifts the court to the east and further away from the private Right of Way owned by the applicant. r Page 2, December 6,2018 #7210, Green SCTM No. 1000-17-1-6 AMENDED RELIEF REQUESTED: Pursuant to the Board members' request, a revised survey dated November 2, 2018 was received on November 30, 2018 depicting proposed 10 feet high backstop fences to be located at the northern and southern ends, and to be used in conjunction with the tennis court. ADDITIONAL INFORMATION: The applicants testified and presented photographic evidence that the tennis court has existed in the non-conforming location on the property for over 100 years. The original tennis court and post and wire fence partially infringed on part of the applicant's Right Of Way which is also used to accessed neighboring property to the west, as shown on a survey by Nathan Taft Corwin, 111, L.S., dated May 22, 2006 . The applicant is proposing to move the court to keep it out of the Right Of Way. An agent for the owner of a neighboring parcel to the west spoke against the application, while many neighbors spoke and wrote in support of the application. At the hearing the Board asked about the height of fencing for the proposed tennis court, since the code only permits a fence to be 4 feet high in a front yard; and subsequently advised the applicants to return to the Building Department to obtain an amended Notice of Disapproval for the required fencing. In reviewing the November 3, 2018 updated survey, it was determined that no Notice of Disapproval was required by the Building Department, but advice was offered that the proposed fence should be made part of this decision. The applicant previously received variance relief in ZBA decision# 6067 to re-build an accessory structure located 5 feet from the property line where code required a minimum 10 foot setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 6,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: The applicant submitted substantial evidence that the tennis court has been in existence since 1881. An attorney representing a neighboring property owner argued that the tennis court use had been abandoned. In support of this argument the attorney submitted only her testimony that her client was surprised he had seen no evidence of a tennis court prior to or since his purchase and that she had checked the County's website and that she did not see evidence of the court during the eighties. The applicant, however, submitted photographic evidence showing the tennis court in existence through the decades, including before and after the 80's. In addition, the applicant testified that the Court has been used through the years without an abandonment of the use. In addition, the applicant submitted testimony that for some years, the applicant has undertaken to restore the tennis court, including adding clay to the court surface, removing the backstop fences when they fell into disrepair, removing the striping to facilitate resurfacing of the court, and installing a new drainage system that will be covered by artificial grass. In addition, a neighboring property owner testified that the neighbor who was objecting to the variance was rarely at the property as it has been undergoing renovations and that he had observed the tennis court being used since 2006. Based on the foregoing, the Board finds the testimony and documentary evidence provided by the applicant and the neighboring property owner to support a finding that the tennis court use has not been abandoned. 1. Town Law V67-b(3)(b)(1). Grant of the variances for the tennis court and backstop/fence will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes built in an irregular sub-division which pre-dates zoning in which both dwellings and accessory structures are non-conforming under today's zoning code. The subject property is set well back from the Main Road and is accessed along a private R.O.W that ends at the subject property Testimony at the public hearing established that the subject tennis court pre-exists zoning, having been constructed in 1881. The application before the Board seeks to slightly move the tennis court so it does not protrude into the private Right Of Way, which is also owned by the applicant. Page 3,December 6,2018 #7210,Green SCTM No. 1000-17-1-6 Several neighbors wrote to say they had been given permission by the applicants over many years to use the tennis court as an amenity to the neighborhood. In addition,the owner of the adjoining property at 360 Stephenson's Rd opined that he believed that granting the variance would improve his property value. An attorney appearing on behalf of one the neighbors stated that granting of the variance would be a detriment to her client because the client's property is directly across the Right of Way from the tennis court. However, the Board finds, that with the condition imposed herein for landscape screening along the shared Right Of Way,that quite the opposite is true, since the variance would move the pre-existing tennis court out of the Right Of Way and farther away from the neighbor's property. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed location for the tennis court and backstop/fence is the only feasible location due to the substantial sloping topography of the property. While it was suggested that the applicant might be able to move the tennis court to a conforming location or at least farther away from the Right Of Way than what the applicant proposes, the topography of the property does not permit this unless the property is cleared of trees and substantially regraded and retaining wall(s) are installed. Moreover, there was no clear testimony about the type of engineering that would be required in order to relocate the tennis court. 3. Town Law t 267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for the non-conforming front yard location for the tennis court and 100% for the fence height. However, in actuality, the requested variance is only to slightly move the tennis court a few feet from where it has existed for approximately 137 years, and the applicants are not proposing to totally enclose the tennis court but rather to install fencing as backstops only at each end of the court. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The property has been in the applicant's family since the 1880s and the family ownership, as well as the tennis court, pre-dates the establishment of zoning in the Town of Southold. 6. Town Law &267-b(6). Grant of the requested relief for the tennis court and backstop/fence is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a tennis court while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried, to GRANT the variances as AMENDED for, and shown on survey prepared by Nathan Taft Corwin, III, L.S. dated November 2, 2018 indicating the placement of backstops/fencing. SUBJECT TO THE FOLLOWING CONDITION: 1. Landscape screening shall be planted and continuously maintained along the western property line between the tennis court and the Right Of Way and installed and maintained to insure safe sight lines and access to the as built garage belonging to the neighbor to the west That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. PROPERTY FACTS/DESCRIPTION: The May 22, 2006 survey confirms the property size to be 39,231 square foot parcel with 308.56 feet along Birds Eye Road (private road), 100 feet along the northwestern lot line, 160.6 feet along the southwestern lot line, and 271.19 feet along the western lot line. The property is currently improved with a two and one story accessory building in disrepair. The accessory building is shown on the May 22, 2006 survey at 20.2 feet from the northern lot line and 1.2 feet from the eastern lot line. BASIS OF APPLICATION: Zoning Code Sections 280-15 (C), based on the Building Inspector's June 18, 2007 Notice of Disapproval concerning proposed construction/replacement of an accessory building in the same nonconforming location at less than the code required 10 feet from any property line. CHAPTER 280 (formerly Chapter 100) - ZONING CODE PROVISION: Zoning Code Section 280-15 (C), which states that an accessory building shall not be constructed less than 10 feet from any lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 13, 2007, at which time written and oral evidence was presented. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 6267-b(3)(b)(3)(1). Grant of alternative relief will not produce a significant change in the character of the neighborhood or a detriment to nearby properties. The accessory structure is barely visible to adjacent properties and roads, in part because of the heavy vegetation in which it sits. The same would be true of a shed constructed in a conforming location. 2. Town Law 6267-b(3)(b)(2). The benefit of a new shed can be achieved without a variance. There is no structural necessity that the new shed be constructed at less than the code-required 10 feet from the lot line. The remains of the existing building stands on a stone foundation that has been reinforced with concrete that is itself in disrepair. No evidence has been presented that any of the original foundation will be retained. 3. Town Law §267-b(3)(b)(3}. The variance sought is substantial, amounting to an 88% reduction in the required setback. Alternative relief, allowing a 5-foot setback, would amount to a 38% reduction of setback. 4. Town Law-§267-b(3)(b)(5). The alleged difficulty has not been self-created, in that that the proposed location is the site of an existing structure that is in a state of total disrepair. The difficulty has been self-created in the sense that is a consequence of the applicant's wish to construct a new building on the site of the building that it will replace. 5. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that the relief applied for will have an adverse impact on the physical or environmental conditions in the neighborhood. The Board finds that the benefit to the applicant of having the new shed located in the footprint of an existing structure is outweighed by the magnitude of the relief sought and value of enforcing the code in the absence of substantial reasons for granting relief. To date I have not heard from the applicants and I cannot force them to communicate with us. To summarize our position, my client objects to the proposed location of the tennis court and asks that the tennis court be set back to conform to the required setbacks from the road. The applicants appeal is to relocate an accessory tennis court to the applicant's front yard. The argument made by the applicants in support of the location of the tennis court is that they were merely "resurface a preexisting tennis court"; however, this tennis court lost the preexisting nonconforming location more than 20 years ago. The applicant admit that they did not maintain the tennis court as their efforts were directed to the reconstruction of other structures. A preexisting nonconforming use terminates if it is discontinued for two years or more. In this case, Town Code 280-122 Nonconforming building with a conforming use, terminated by discontinuance of the use in one year. The area where the tennis court was once located,has been an unimproved area used, at times, for parking cars. There are several reasons the proposed placement of a tennis court, where it is proposed is not appropriate: 1. It is located directly under the main electric lines to my client's home. It does not seem prudent to play tennis directly under electric lines. 2. It is located directly adjacent to the road. The code requires the tennis court to be located 50' from the road. At the time the tennis court was first constructed on the subject property, according to the applicants in the 1800's, a subdivision of the land had not been filed. Even after the subdivision was filed in 1906, the properties were part of the same family. The lots are now owned by unrelated individuals and a certain amount of privacy and compliance with legal setbacks is expected. The applicants are proposing a 3' setback from the road when 50 is required. That is a substantial variance. r � 3. Applicants do not show the proposed location of a fence. If fencing is to be placed on the property it should be shown on the survey. The application for a variance is required if the fence will exceed 4' in height. This variance will need to be noticed and published. 4. A topographic survey is needed in order to determine if the fence could be moved toward the west. 5. There may be room to move the tennis court away from the street by a retaining wall. In order to design a retaining wall a topographic survey is needed. It may not be possible to move the tennis court to 50' from the road, but the topographic survey will identify reasonable alternatives. The bank does not begin to climb until beyond the utility pole which appears to be at 50' from the road. In addition, the applicants have a flat area north of the proposed tennis court, adjacent to their gravel driveway. There are more conforming alternative locations for this tennis court than what is being proposed. 6. There should be landscaping provided to screen the tennis court from the street. Landscaping should be carefully design to keep the street passable. Evergreens right on the property line will, in a very short time, will block the street and make the street impassable. The tennis court is screened from view from Birds Eye Road but there is no screening from Stephenson's Road. 7. The tennis court, fencing and screening will adversely impact and interfere with access to my client's garage. A review of any proposed landscaping to screen the tennis court and possible fences should be reviewed in this application. These are questions which we request that the ZBA ask & the applicants should answer prior to the grant of a variance. The meeting should be adjourned for them to provide the appropriate documents, including a variance for a fence height, a topographic survey, and alternative locations, to address the above issues. Minor �C��D Irv• I,aJ�� ZONING BOARD OF APPEALS STATEMENT— MOM TO READ My name is Beverley Greene, and I am reading this letter by my daughter Charlotte Greene, who could not be here, in support of her and her aunt JoannWendy Lomas's application for a building permit to renovate our historic tennis court at 500 Stephenson Road Orient. Wendy is here, and she andp Charlotte are the co-owners of this property. Just to give you background on the court, it was built by our great grandmother, Mary Sing Stephenson, in 1881, and was one of the first clay tennis courts in New York State. It has been in use by our family continuously since that time, and we are seeking to finish the restoration process which we began in 2005, in which we had decided to resurface it in a manner that can be more easily and inexpensively maintained. I have provided a number of photographs over time of the court in use, on this poster and USB. In addition, 4 of our long-term neighbours on Stevenson Road have written letters , supporting the court and mentioning their personal knowledge of this history. We last appeared here in front of the Zoning Board of Appeals when we sought to restore the Crab Shack, which was built by our great uncle Ezra Hallock Young. Since 2005 we have undertaken three historic renovation projects, of which the crab shack and our ice house restoration have been completed, all with the required permits and variances. These first two projects were of higher priority than the tennis court as they were both aging structures in danger of falling down. Now we are seeking to restore the tennis court as it is equally important to us to maintain the original outbuildings and amenities that have existed here over the decades. Here we would like to apologise for not having initially sought a permit as we had been advised by the company doing the restoration, Southwest Greens, that it was not necessary given that it involved resurfacing of an existing court, and we have never had a permit on the occasions when we have renovated the court in the past. Given the company's experience in the matter we didn't think to seek a permit. We have always sought permits for other projects where we thought they were necessary. I forwarded a letter which we requested from Southwest Greens, where they indicate that we had a conversation regarding our erroneously assuming no permit was required. Also, I asked the company to describe in the letter the full surface permeability ;Z o of the court, loose crushed stone with a fake grass overlay, which does not require any additional drywell system and is playable immediately after rain unlike many other court surfaces. The stone has been in place for about a year and we can see that it drains well. As you can see in the two surveys, we have shifted the court a small amount to ensure that the corner is off the private driveway next to it which we own via our Stephenson Road LLC. The court can not be further away from the driveway as there is a forest next to it which is uphill. The historic fencing around the court was wooden posts with mesh netting, approximately 10 feet high. We were planning to rebuild it in the same manner: because the existing posts were rotten, we took them down last year in order to replace them. It would be fairly easy for us to shift the court back to original position if required. We hope that you will be able to approve this court as we are pleased to have it playable again for our family, particularly Charlotte and my granddaughter (aged 9) and grandson (aged 12) who enjoy playing tennis. There is no other available flat area on our property for a court of this size, as we have unusual historic boundaries in R40. We would like to be able to complete this restoration and see this part of our property look somewhat the way it used to look. I am very happy to plant screening along that side. Nate has altered the survey to indicate the backstop placement, and he's sending it to you now. It is usually 10 feet high -the open mesh between the posts makes it not too obtrusive though - you can see how it was in the photos. Regarding your survey question, I asked this of Nate too - will I need to bring a survey copy to the Building Dept or will it automatically be shared with them? I mentioned that I moved it as far as the company was able to move it into the woods hill and away from the right of way. We had to move and regrade a large amount of dirt in order to move it away from the right of way as much as we did (even though it wasn't a large movement) - it was a lot of work making a berm alongside the court and they didn't feel they could move it more as the hill slopes up straight away considerably. We did depict the move that we did on our latest survey. The move that we did actually opens up enough space for screening along the right of way.
