The Piping Plovers and Least Terns have successfully finished nesting on the beach for the season and most if not all have left the area. There are currently no concerns for negative impacts to threatened or endangered species at this site regarding the proposed work. The plovers and terns should return again in the spring and work will be restricted from April 1 to September 1 again next year. Any construction or other activity within 100' of the water or beach is required to receive a permit from the Board of Trustees. Also be aware that the permit to construct a covered wood gazebo is dated November 19, 2003, and is good for 24 months, and will expire next November 19, 2005. If you know that you will not be building the gazebo before next November please submit a request for a one-year permit extension by next October 2005. It is possible to amend your Gazebo permit to include the fence. Please submit a survey showing the location of the fence and a check for$50 for the amendment. WHEREAS,Proper-T Permit Services. on behalf of Cutchogue New Suffolk Park District applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated October 2,2003 WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 19th, 2003 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code. WHEREAS, the Board has determined that the project as proposed will not affect the health, Safety and general welfare of the people of the town.
