That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Any maintenance which involves more than 50% of the length of this structure requires approval of the Board of Trustees.We further understand that failure to maintain the structure could result in a requirement to post a bond and/or have the repairs ordered as a lien against the property upon a finding by the Board of Trustees that said lack of maintenance would risk life, property or important natural resource features. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable I ANTONIOS DAGOUNAKIS &MARIA SISKOS 55585 ROUTE 48 GREENPORT,NY SCTM# 1000-4-1-13 Wetlands State Effect, CEMP Statement of Effect and LWRP 4,5,6 The project seeks to replace a bulkhead that was significantly storm damaged and partially destroyed during Winter Storm Grayson on January 4, 2018. The existing, developed site has been improved with and supported and protected from flooding and erosion by a bulkhead for more than thirty years. Specifically, the existing bulkhead was permitted pursuant to Southold Trustees Permits 279 and 6655/66550, which were issued in 1985 and 2007, respectively, and transferred to the applicants on December 13, 2017, weeks prior to Winter Storm Grayson. Reconstruction of the bulkhead would thus maintain the property's historical method of protection against erosion and flooding, and there is no viable non-structural alternative means of maintaining and protecting the applicants' property from erosion and flood damage. Rather, without replacement and maintenance of the bulkhead, which would tie into the existing bulkheads on the two adjoining properties, the subject and adjacent lands and the residential structures located thereon would be exposed to severe erosion and flood damage, as ultimately would be County Road 48, which is located as close as 62 feet from the line of the bulkhead. To mitigate the potential impacts of the project, consistent with Chapter 275-1 l(B)(1)(c), the reconstructed bulkhead would be armored with stone toe armor(relocated from the area behind the bulkhead where it was placed as an emergency erosion control measure pursuant to Southold Emergency Wetlands Permit No. 9141E) to dissipate reflective wave energy. And pursuant to Chapter 275-11(13)(1)(d), the 10' wide area landward of the bulkhead would be maintained as a nonturf buffer in the form of a stone splash pad. For all the reasons and information described above, the project 1) is reasonable and necessary and lacks a viable alternative; 2) would not cause increased erosion or otherwise adversely impact the conditions of the subject or surrounding properties; 3) would create no significant adverse ecological impacts on the adjacent beach, unvegetated, littoral zone tidal wetlands or surface water quality of Long Island Sound; and 4)will thus comply with the permit standards of Chapters 275 and 111 and will be consistent with Policies 4, 5, and 6 of the LWRP.
