That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to'provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein, authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. °10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 582 Bohemia, NY 11716 RE: LEAH ZARA & RICHARD KASNIA 400 WINDJAMMER LANE, SOUTHOLD SCTM# 1000-79-4-8.1 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 14, 2018 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of LEAH ZARA & RICHARD KASNIA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 6, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed actions are Inconsistent with the LWRP, and WHEREAS, the LWRP Coordinator issued a recommendation that the application to construct an untreated deck and a 10' wide non-turf buffer is recommended as Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: docks are pre-existing and non-conforming and were constructed prior to the current Code and will be permitted; requiring the use of turbidity controls; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 14, 2018, at which time all interested persons were given an opportunity to be heard, and, r WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 1 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure.complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, -RESOLVED-,-that-for-the mitigating factors-and based-upon the-Best Management-Practice-- requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of LEAH ZARA& RICHARD KASNIA to remove existing timber bulkhead and replace in-place 50 linear feet of new vinyl bulkhead, and to raise the height an additional 12"; install new 6' wide non-treated walkway along the landward edge of the proposed bulkhead; and for the two (2) as-built 2' wide by 14' long ramps and two (2) 6'x20'floating docks off bulkhead; with the condition that turbidity controls be installed during construction; and to establish and perpetually maintain a 10' wide non-turf buffer landward of the bulkhead; and as depicted on the site plan prepared by Jeffrey Patanjo, dated October 22, 2018, and stamped approved on November 14, 2018. SCTM# 1000-79-4-8.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Locating two docks on one residential lot is not permitted pursuant to Section §275-11. Construction and operation standards, C, (c),[1] Residential docks: 11 Only one catwalk may be permitted per residential lot. Only one moorin_g or dock may be permitted per residential lot. Upon a showing of special need due to low water level and hazard to property, the Trustees may permit both a mooring and a dock for the same residential property. A Wetland Permit for the docks or the bulkhead could not be located within Town records. They were constructed without Board review and a Wetland Permit. The construction of an untreated deck and a 4' wide non-turf buffer is recommended as CONSISTENT. In the event the action is approved the following is recommended to further Policy 6. 1. Require turbidity controls in compliance with Chapter 275. The 5' wide easement in not shown to extend over this parcel. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
