As required and pursuant to our prior request,you have included in your correspondence, a detailed description and specifics of your planned special event. In prior written communications I apprised you of the Town's criteria for allowing special events. In accordance with my prior decisions, I find that there is no nexus between marketing your agricultural products as a tree farm operation and wedding events. Furthermore, events on this site have been subject to numerous complaints by owners of neighboring parcels that have cited excessively loud music and noise disturbances. Subsequently, I am denying your request for special events that involve catering and live music. Pursuant to Section 205-6 of the Southold Town Code, an applicant who is denied a permit by the Chairperson of the Zoning Board of Appeals may apply to the Town Board for reconsideration of the applications by filing an appeal with the Town Clerk within ten (10) days of the date of denial. I respectfully request that you give it your reconsideration as I believe the application complies in every way with the requirements for a special event permit. Event date: This revised application is only for the one event date of June 9, 2018. Subsequent dates are deleted from this application. I was apparently misinformed when I was told by another applicant that as an efficiency and economy measure,future uncommitted event dates could be addressed in a single application for one fee. As that is apparently not the case, I stand corrected. Nexus:As a pre-condition to me making the farm property available to the wedding couple,the family has contracted to purchase juvenile Christmas trees to use as souvenir wedding favors.A copy of that contract is attached to document the nexus. Liability Ins: A current certificate of insurance is attached. The policy renewed in March after the time of the original application. Catering:The Old Town Farm does not serve food or beverages or offer catering services in any way. Our business is farming.The wedding family will contract with and avail itself of the services of off- premises based providers. Updated food service provider information is as follows: Eat'Me, Drink Me, Inc 134 5t"Ave Bayshore, NY Suffolk Permit#PT0008855 attached. Traffic and Parking: A total of 138 guests and participants are expected at the wedding.With the addition of vehicles for food service people, it is anticipated that about 75 cars might be involved. All parking will be off the road and contained entirely within the property. The wedding family intends to employ a valet parking service to ensure the orderly management of cars. The original application which you have includes a map showing primary ingress/egress limited to Main Bayview Rd and an emergency only exit onto Willow Pond Lane. In accordance with your stipulation of 300sq ft/vehicle, I have measured and calculated that we could easily park all the expected vehicles onsite. See map. ,z ti Music/noise/neighbors: The wedding family does intend to have recorded (not live) Latin music at their daughter's wedding. Everyone is aware and respectful of the neighbors and any concerns they may have. Sound will be kept central to the property and directed away from neighbors as much as possible and at a volume level within Town ordinance limits. Music will end at 1013M and the property vacated as expeditiously as possible following that time. I do not believe any prior special event held at the Old Town Farm has ever violated the noise ordinance, and I wish to point out that no noise violations have ever been issued. While there have been no violations,you have indicated that there have been prior noise complaints.With one off-base exception, any such complaints are unknown to me. Would you be kind enough to provide me with a list of names and dates and times of the complainants and the specific complaints to which you are referring so that I may refute them,otherwise kindly disregard them and treat them as hearsay. Sanitation/trash: While we do have a bathroom available for use at the farm,the wedding family has arranged for rental sanitation facilities and dumpster service for trash.The locations for this temporary equipment as well as the party tent are shown on the same map as the parking.
