Case , Executor - Estate of Ruth Case Appellant Yardley, Pa, at a meeting of the Zoning Board of Appeals on September 20", 1972 the appeal was considered and the action indicated below was taken on your ( ) Request for variance due to lack of access to property ( ) Request for a special exception under the Zoning Ordinance ( Request for a variance to the Zoning Ordinance 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... Subsection .................... paragraph .................... of the Zoning Ordinance and the decision of the Building Inspector ( ) be reversed ( ) be confirmed because 9;50 P.P-:. (E.S.T. ) , upon application of Estate of Ruth Case , Yardley, Pa. , for a variance in accordance with Article III, Section 301 of the Zoning Ordinance to set off lot with less than required frontage and area. Location of property; north side of New Suffolk Avenue, Cutchogue, New York, bounded north, by Case Road; east by Meadow Lane; south by New Suffolk Avenue; west by T. Shalvey and others. Fee paid y15-00- 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVER2E (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE ONI G BOARD OF AP ALS FORM Z134 - 7� -- — _ 'rte a Marjorie T`IcDermott, Secretary ChaN ° Southold Town Poard of Appeals After investigation and inspection the Board finds that applicant requests permission to set off lot with less than required frontage and area on premises located on the north side of New Suffolk Avenue, Cutchogue, New York. The findings of the Board are that applicant owns a piece of property which is unusual and which is larger in size than any of the lots in the surround- ing area. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE 12 WAS RESOLVED Estate of Ruth Case , Yardley, Pa. , Clifford T. Case, Sr., Executor, be GRANTED permission to sat off lot with less than required frontage and area on premises located on the north side of New Suffolk Avenue, Cutchogue, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the provsiions of decedent's Will dated August 23, 1969 left this parcel undevised. The Executor has obtained a bona fide purchaser for value but will not be able to sell unless approval of the undersized`'lot is granted. 2. The hardship created is UNIQUE and is not shared by all Properties alike in the immediate vicinity of this property and in this use district because at the time of execution of the Will such division was legal and premises constituted a valid building lot. - 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because there are other homes in the vicinity situated upon lots of similar size , some in smaller size .
