In your application, you describe some detail of one event scheduled for June 2, 2018, but no information or details are specified for the remaining nine events. Pursuant to the procedures and standards of special event provisions detailed in Chapter 205 of the Southold Town Code, a special event approval shall be determined after careful consideration of any or all impacts on adjacent property owners and the surrounding neighborhood. The Town shall consider the impacts of the event on the safe and orderly movement of traffic within and contiguous to the event, as well as impacts on public town services to the areas contiguous to the event and to the Town in general. Accordingly, the Town has the right to revoke any permit or deny future permits if events generate unforeseen impacts to health, safety or welfare of residents and guest of the Town. In response to a previous special event application for an event held in 2017, I informed you that the following criteria for allowing special events, such as weddings and reception events, on your property had not been met: 1. No nexus between marketing your agricultural products as a tree farm operation and multiple wedding events 2. Catering use is not permitted in the R-40 Zoning District 3. A use variance must be approved for a special event to take place on the premises. In addition, your application is deficient of required documents including, but not limited to,the following: 1. For the number of vehicles by attendees for each event(199)the Town would require a traffic control plan. The Otd Town Farm, LLC-2018 Page 2 2. A submitted plan showing how you intend to mitigate impacts to neighboring property owners and traffic. 3. A Special Event application allows for only 6 similar events, within a three month period, afterwards, an application must be submitted for each additional event to include a fee payment of$150. 4. A current Certificate of Liability Insurance. The submitted certificate expired on March 6, 2018. More importantly, the site has been subject to numerous complaints by owners of neighboring parcels during past events that have cited excessively loud music and noise disturbances. Subsequently, I am denying your request for special events that involve a wedding with catering and live music. Pursuant to Section 205-6 of the Southold Town Code, an applicant who is denied a permit by the Chairperson of the Zoning Board of Appeals may apply to the Town Board for reconsideration of the applications by filing an appeal with the Town Clerk within ten (10) days of the date of denial. Accordingly,any completed application that is not submitted 60 or more business days prior to the scheduled event may be refected or subject to a late processing fee of$256.00 by the Office of the Zoning Board of Appeals, unless a waiver is obtained from the Board Chairperson. Reasons for requesting an expedited review must be submitted in writing to the Chairperson. When is a Permit Required? All Special Events,per Southold Town Code Article I, Section 205-2 (Definitions)must obtain a permit from the Zoning Board of Appeals. Occasional events on private residential properties hosted by the owner,thereof to celebrate family events, holidays,charitable or other not-for-profit fundraisers do not require permits. Any use of residential prope!jy for profit such as a venue for weddings or other events is prohibited. To Obtain a Permit You Must Submit to the Zoning Board of Appeals: 1. A completed application form signed by the owner and the eventmanager. 2. The fee based on attendance,AS per Article 11, Section 205-4(B)of the Town Code,as follows;a. $150.00-for attendance of less than 500 attendees, b. $250.00 for attendance of 500 to 1000 attendees:for EACH event,EACH DAY,Payable to the Town of Southold. 3. The applicant must provide a certificate of general liability insurance naming the Town of Southold as an additional insured with limits of$1 million dollars per occurrence or such other limit as may be required by the Town Board for events where expected attendance exceeds 500 attendees. 4. A Parking Event Plan: consisting of a survey, site plan and/or aerial view of the subject property that includes the locations of on-site parking, sanitary facilities, and tents or other temporary structure(s).(See application form for details) 5. They desire to have a lowkey hands-on family affair where they can plan and decorate for the event themselves. They will have catered food and beverages provided by Matthew of the Rolling in Dough Pizza truck from Greenport. They may also have a whole roasted pig by a provider yet to be determined.They will have a tent in the event of inclement weather.They will have recorded Latin music. The entire event will be conducted and supervised with respect to neighbors and will be entirely concluded by loPM. Other Dates: The itinerary for the events on the other dates is very much the same as for June z with the differences being in the individuals being married and their choice of caterers. The Old Town Farm is very mindful of its neighbors and insists that any such event held at its premises be disciplined and respectful. Old Town Farm management does not favor events with an emphasis on alcohol. Any event music must be directed away from neighbors to the best extent possible and will be turned off by 1oPM . The quality of life for neighbors could be adversely impacted given that they plan to have a wedding every weekend for nine weeks in a row. If these events are permitted to proceed, a condition that requires strict adherence to the noise code is recommended. Similarly, some of the parking is planned along the property lines of neighbors,which could also adversely impact the quality of life of those neighbors from the noise of parking up to 50 cars adjacent to their back yards (see Parking Area E on the parking plan). If these events are permitted to proceed,moving parking areas away from property lines is advised.
