SOUTHOLD TOWN BOARD

WORK SESSION

9:30 A.M. Unsafe Buildinq hearing with respect to the property of Sophie
Furmankiewicz, Main Bayview Road, Southold, was-postponed.. Work has commenced
on the demolition of the unsafe building ~n question.
9:45 A.M. - Michael Zweicj, Chairman of the North Fork Planning Conference, metwith
the Town Board to give a progress report from the Organizing Committee of the
US/UK C~)untryside Stewardship Exchange which will begin on July 14th when the
participants arrive in Southold Town four participants from the United Kingdon,
and four participants from the United States, who will jointly participate in a land
use study of the North Fork. Also in attendance were other members of the
Organizing Committee: Bill Cremers, Larry Fuller-Perriner Bill Peters, Margaret
Brown, Ronnie Wacker, Mark McDonald. Discussion was held concerning
proclamations to be given to the participants, displaying the British Flag, availability
of a police boat to bring the group into New Suffolk to view the waterfront. The
question of extending the Town's insurance coverage for a barbecue at Founders
Landing was discussed. Town Attorney Arnoff called the Town's Insurance
Consultant William Mullen who advised Mr. Arnoff that he would not recommend this..
The cost is substantial, and the Board would create a very dangerous precedent
by extending the Town coverage to a private function. The Town Board agreed
with Mr. Mullen's recommendation. Mr. Zweig presented the Board with copies of
a press release outlining the final selection for the participants of the US/UK
Exchange.
10:05 A.M. Greenport Villacje Mayor YVilliam R. Pell III, along with Superintendent
of Utilities James Monsell, and Superintendent of Water and Sewer Gerald Hickson,
met with the Town Board to discuss progress with upgrading the Scavencjer Waste
Treatment Plant. Mr. Hickson reviewed the agenda for the recent training of Village
personnel by Cameron Engineering, P.C. and Peconic Associates. A timetable was
submitted outlining the plans for design, bidding and commencement of work.on plant
improvements which are projected to be under way by September 16th.--Onanother
subject, Mayor Pell suggested a committee be formed to discuss his proposal for the
Southold Town Police to patrol the Sandy Beach area of'Greenport. For the Village
Police to patrol this area, it requires them to leave the Village boundaries for two
and one-half miles. It was agreed a committee comprised of Supervisor Harris,
Mayor Pell, the Town and Village Police Chiefs, and the Town and Village Attorneys
would sit down and discuss the feasibility of this proposal.
10:30 A.M. - Harry Fagan met with the Town Board to discuss his proposal to create
an "Adopt a Mile Marker" program. In 1755 Benjamin Franklin, while working for
the Postal Department, placed 30 markers between the County Court House and
Orient Point to measure postage fees. Twenty-four markers were placed in Southold
Town, and 21 remain in place. Mr. Fagan's program is designed to involve local
organizations who would assume the responsibility of caring for and maintaining the
markers. The Board wholeheartedly endorsed Mr. Fagan's proposal, and he will
further develop the program, and once it is in place the Town Board will declare
a "Mile Marker Week" to 'bring it to the attention of the public.
11:10 A.M. For Discussion Items: (1) Request from the Fishers Island Civic
Association, Conservancy, and Oevelopment Corp. I~or the Town Board to extend
the three acre minimum for hotel and motel construction on Fishers Island to the
"Limited Business" and "General Business" districts. The Town Atto~-ney will
determine whether there are currently any properties in the Town of Southold. that
might be affected if this three a~re n~inimum were to be extended to the "General
Busness" district. (2) Appointment to vacancy on the Open Space Committee was
discussed 2:25 P.M. during Executive Session (see resolution no. 33). (3) Letter
from J. Kevin McLaughlin, attorney for Catherine R. Stimpson and Sue Larson,
requesting an exterision of time for the demolition of a building on their property
at East Marion. Mr. McLaughlin advised that their is an executed contract of sale
on the property, and the purchaserr :who owns a contiguous improved parcel, will
remove the building and' debris immedi,ately after transfer of title. Mr. McLaughlin
requested an extension for one month to July 21st. The Town Board agreed to the
extension · provided any and all u'tilities servicing the premises are immediately
disconnected, and the premises be demolished and removed on' or before July 21,
1991 (see resolution no. 24). (4) Assistant Town Attorney Kierna~ presented a
proposed local law with regard to transferring authority for removal of excess topsoil
in subdivisions from the Towr~ Board to the Planning Board. The Town Board set
this matter down for a public hearing on July 2nd (see resolutions 22 and 23). (5)
Town Attorney Arnoff presented the Town Board with the proposed Local Law in
Relation to Coastal Erosion Hazard Area's. He advised that should the Board be in
agreement With the proposed, law, it must be sent to the Commissioner of the DEC
for review and acceptance, after which the Board may set a public hearing (see
resolution no. 29). (6) Discussed appointment of a Swimming Instructor (see
resolution no. 30). (7) Discussed pro~3osed Local Law in Relation to Drive-thru
Windows which was 'drafl~ed by Town Attorney Arnoff and submitted' to the Town
Board just prior to the Work Session. It was decided to refer this proposal to the
Zoning'and Planning Committee for study. (8) Board. reviewed two proposed Local
Laws related to the Home Occupation Law. One permits the parking of 25 foot
tr~icks on a re~ident's driveway (the law curreritly restricts the permissible length
to 20 feet) provided the resident owned the truck on the date of this ~mendmentf
and the other attempts to further clarify the section on allowable signs in a
residential area (see resolutions 25, 26, 27, 28).

it was Resolved that the Town Board enter into Executive Session. Vote of the
Board: Ayes: Supervisor Harris, Justice Edwards, Councilman Penny, Councilwoman
Oliva, Councilwoman Latson, Councilman Wickham. Also present: Town Attorney
Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry. The Town A.ttorneys
discussed with the Town Board litigation and personnel.

A Regular Meeting of the Southold Town Board was held on Tuesday, June
18, 1991, at the Southold Town Hall, Main Road, Southold, New York Supervisor

RESOLVED that the Town Board of the Town of Southold hereby reappoints
Community Development Administrator James C. McMahon as Southold Town's
representative on the New York State Department of Environmental Conservation
She lfish Advisory Committee, effective immediately, he to serve in said position
without compensation.

period.

reduction of the Performance Bond for The Woods at Cutcho.gue from $319,680.00
to $120,000.00, all in accordance with the recommendation of'the Southold Town
Planning Board.

closure of Sound Avenue, between Love L~ne and Westphalia Road, Mattituck,
between the hours of 6:30 P.M. and 9:30 P.M., September 6, 1991, as a safety
precaution during the public concert, "Voices in Praise", being held by the
Mattituck Presbyterian Church, provided the Mattituck Presbyterian Church secures
and files with the Town Clerk a Certificate of Liability Insurance for at least One
Million Dollars naming the Town of Southotd as an additional insured.

3, 1996, he to serve in said position without compensation.

7.-Moved by Councilwoman Latson, seconded by the Entire Town Board,
WHEREAS, the Town Board of the Town of Southold has repeatedly indicated its
support for the purchase and preservation of Robins Island in its natural state;and
WHEREAS, Robins Island, a 400+ acre natural island in the Town of Southold, is
one of the most unique and important landmarks on the East Coast of the United
States; and
WHEREAS,the Town Board believes that the preservation of Robins Island is a
regional concern and that the Island's preservation would be of benefit to the entire
region, and proper disposition, management, and use of this Island could be of
great economic and environmental benefit to the Town of Southold; and

WHEREAS, since 1960 the Suffolk County Planning Commission has recommended
the preservation of Robins Island; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby urges the Suffolk
County Executive and Suffolk County Legislature to move forward with all expediency
with the purchase of Robins Island.

RESOLVED that the Town Board of the Town of Southold hereby accepts the bid
of Richard Perkins, Orient, in the amount of $826.00, for the purchase of one (1)
1986 90 h.p. Yamaha Outboard Motor, in as in condition, from the Town of Southold.

the north side of Main Road, Laurel, which permit expires on July 9, 1991, be
and hereby is granted for a six (6) month period.

RESOLVED that the Town Board of the Town of Southold hereby appoints Peter
Graseck as a Lifecjuard (1st year), effective immediately, for the 1991 summer
season, at a salary of $7.42 per hour.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute a Contract Budget Modification Request
to the program budget for the Nutrition Program between the County of Suffolk
and the Town of Southold, which modification results in a zero net change.

14.-Moved by Councilwoman Oliva, seconded by Justice Edwards, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute an agreement between the County
of Suffolk, acting through its duly constituted Executive/STOP-DWI Department,
and the Town of Southold, for the STOP-DWI funding for enforcement activities
by Town of Southold police personnel, effective January 1, 1991 through December
31, 1991, at a total contract amount of $4,536.00; all 'n accordance with the
approval of the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby appoints Denise
Conte as a full-time seasonal Clerk in the Assessors Office and the Central Data
Processing Department effective upon her termination in the Tax Receiver's Office
in mid-July, at a salary of $5.30 per hour.

Councilwoman Oliva, Councilman Penny, Justice Edwards, Supervisor Harris.

RESOLVED that the Town Board of the Town of Southold hereby appoints Charles
Tyler as a part-time Public Safety Dispatcher, effective immediately, at a salary
of $7.72 per hour.

Commissioner of Public Works Raymond L. Jacobs to install a streetlight on pole
#130 in front of East Wind Shore~ condominium, County Road 48, Southold.

RESOLVED that the application of William Bauer, President of Bauer Farms, Inc.
for renewal of his single family caretaker trailer permit, for trailer located off of
the south side of County Road 48, west of Peconic Lane, Peconic, which permit
expires on July 4, 1991, be and hereby is granted for a six (6) month period.

COUNCILMAN WICKHAM: I'll just make a brief comment. First, the two hearings,
and the resolution at the end were basically of a means of consolidating the two
committees, that have existed in the past, one for the Farmland Preservation Program,
and one for the Open Space Program. They're being established as a single
committee. The functions are not being abolished, but rather it's being combined
as one. 1'11 just make a very brief note of the working of the Planning and Zoning
Committee. The Committee has been asked to do basically two things, that it's
working out at this time. One is to help coordinate the review of the ~/aterfront
Revitilization Program. The Town has engaged consultants to come up with a draft
report, and the Committee is attempting to get the views of the various,Town Boards,
and agencies, to get a coordinated review of that document. Secondly, the Board
has asked the Planning and Zoning Committee to solicite the views of the Greenport
Water Company, the Suffolk County Water Authority, and other experts in the field,
to help establish some guidelines under a management plan for the protection of
groundwater in the Town of Southold, and the possible expansion of public water
in this town. The Committee will be working on that during the next few weeks,
and hope to have a report. Thank you, Scott.
SUPERVISOR HARRIS: Is there any other member of the Board?
COUNCILWOMAN LATSON: I'd like to refine my statement on Resolution #31, that
authorized Supervisor Harris to execute agreements for the summer recreation
programs. This year, obviously, we're faced with budget deficits. The Recreation
Program in many parts is funded as a result of~ State revenues. We don't know
right now how much we're going to ge~ in State revenues. We may get what we
hope for. The latest I've heard is that the Governor, or Legislators, are proposing
a $350,000,000.00 personal income tax. Sooner or later, hopefully, the Budget
of New York will be settled, and I hope it's something that we can all live with,
even though these are tough times. However, my concern with this fees is that
user fees get to the point that the average person can't afford to participate, and
these programs are basically designed for kids. There's a lot designed for the
senior citizen, but they're designed for kids, and all of us who have kids and
families know that it cost a lot of money, and all of us know that if you raise fees
too high, they can become counterproductive. So, I hope that people participate
in these programs. They are good programs, and we do have excellent instructors,
but I hope that in our wisdom that we're able to keep fees down, so that these
programs are available to everyone. Okay, enough on resolution thirty-one. Now,
I'd like to talk about one item, that's very close to my heart. I have several that
are very close to my heart, but one that is very close to my heart, and probably
very close to a lot of yours, is the environment. Right now before us in Southold
Town, we have three areas that have the opportunity to preserve some land. One
is about 241 .acres in Laurel Lake that hopefully will be preserved with the 7o
sales tax money. Last Tuesday Councilwoman Oliva, and I, had the opportunity
to travel up to the Suffolk County Legislature, where the resolution was approved
with one extension to fund the ~o~
~o sales tax. Now, this is very important for the
Town of Southold, because it allows the acquisition of land around the aquafer
in Laurel Lake. The money will not be bonded by the County until September
but they should start to appraise the land. Now, anytime during a recession is
a good time to purchase property. Some of the greatest land acquisitions in this
country were made during the depression, thanks to Teddy Roosevelt. So,
besides the Laurel Lake, we're still looking at the Baxter property, and the Town
Board has not given up on that. Even though we're in litigation our Town
Attorneys are working hard, and the Town Board is working hard. No one wants
to see the property overpaid for, but nobody wants to see it lost, so everybody
say a prayer, and keep your fingers crossed, and maybe we'll acquiring it. The
third is Robins Island, that we passed a resolution on tonight. Now, Robins Island
has been around since 1960. I have 8 feeling if Robins Island has been around
since 1960 to be acquired, that it should make it a little bit longer. Now, there's
this one guy that's giving us a hard time, and his name is Finley, and he doesn't
think that the people in Southold can afford the luxury of preserving Robins Island.
But I don't think Robins Island is a luxury. We read in the papers recently, that
the North Fork of Long Island is one of the twelve last great places in the world,
and it's important for Robins Island to be preserved. There is a fund, that you
can send money to, if you're willing to help. I don't think I can solicit for it
personally, but I'm sure if you talk to your neighbor, and spread the word, you
can find out. Now, I'd just like to tell you a little bit about what Town Board
members do. Well, we interviewed, Scott and I, interviewed members for the Open
Space Committee this week. i did attend the Planning and Zoning Committee meeting,
where we talked about the Suffolk County Water Authority. Waterfront Revitilization
was on the agenda. It didn't get to Councilman Wickham's (tape change) moving
in a very good direction to reach a meeting of the minds on this. I think there's
~ lot of things involved in this, but I think everybody wants to see people making
a living and working in these hard times, and t think the Code Committee under
the direction of Councilman Penny has taken a really good step in rectifying what
may have been some bad feelings. I've been involved in a Youth Board, and we
have our meetings every week, and it's chaired by Mary Anne Fleischman, and
Mary Anne Fleischman is an excellent lady. She does a terrific job. I, also,
attended a meeting of the US/UK Stewardship Exchange. I know I've spoken long
enough, but they'll be here July 14th through July 17th. It's planning conference.
It's going to incorporate people from the United States, and the UK. The Brits
are coming, and the United Statesis working together, and we always work ~ell
with the Brits, and we're going to be discussing agriculture, business, namely
tourism, and affordable housing. The last thing I'd like to say is over the week-
end..almost the last thing I have to say, over the weekend I had the opportunity
to meet a Marine in full dress uniform, who participated in Operation Desert Storm,
not Desert Shield, but Desert Storm. The Marines went in. I happened see this
young man in uniform, and I went up to him, and I asked him, did you participate
in Desert Storm, and he said, yes. I said to him, can I shake your hand, and
he shook my hand, and I want to thank you for what you did, and a lot of people
want to thank you. You did a great job. He gave me the warmest handshake,
one of the warmest handshakes I've ever received in my life, and his eyes clouded
over with tears, and the guy had to be all of 24 years old, and a handsome guy.
It made me wish I was a little bit younger. I'd just like to leave you with two
closing thoughts. There are 50,000,000 cases of Aids in this country. There are
35,000,000 people living in poverty, and 13,000,000 of them are children. Thank

COUNCILWOMAN OLIVA: I would just like to add, Ellen and I did go down to
the County to participate in the debate for the acquisition of~° sales tax money,
and I would just like to add that this Town Board, and the Planning Board, and
Mark McDonald, and Bob Villa have worked very, very hard to get us included
into the Special Groundwater Protection Areas, which were started, by the State,
and the study was done by the Long Island Regional Planning Board. We worked
very hard to be included, so that we would be able to take advantage of this 7o
sales tax money. We don't have the pine barrens here. We only have a few areas
that really have our deep recharge areas, and one of the most important is Laurel
Lake, because there is really no farming around it, and this is first on the
acquisition list, and we really hope that in these times the developers would rather
sell to the County than develop their property. It is crucial for us to have this
land. It goes without saying, of course, Fort Corchaug, and Robins Island, I've
been on the orignal Save Robins Island Committee since 1980, and I sure do hope
that one of these days, that we will get Robins Island.
SUPERVISOR HARRIS: Councilman Penny?
COUNCILMAN PENNY: The Legislature Committee is meeting, again, on Thursday
regarding Home Occupations, and we're going to have the big room this time. There
were quite a few people in attendence the last time, when we met in the small
meeting room, and it was pretty packed, and pretty hot, but probably what
happens, now that we have the bigger room arranged nobody will show up. So,
we're moving ahead on revisions for the Home Occupation Law. Thank you.
SUPERVISOR HARRIS: In closing, I'd like to once again just sort of ditto what
some of our Councilpeople have said. Legislator Mike Caracciolo, and myself', and
many other individuals that work very hard for this ¼% sales tax money to finally
come forward to Legislature so Southold can get it's entitled share of this monies.
The Town of Southold hasn't received one dime to date of any ¼% sales tax monies,
since this program was enacted, and I hope that with God's speed they move
ahead, and get these properties purchased, because it is certainly for the benefit
of the future of Southold Town, that groundwater be protected, and we aren't
doing this for today. We're doing it, obviously for many years to come in the
future for all our children, that are still coming in this great town of ours. So,
I behalf of everybody, that worked very hard for this, as Ruth mentioned, and
as Ellen mentioned, everybody should get credits for this. We want to see this

program move ahead. We have many other properties, that we also feel should
be purchased with our entitlement, again, of the quarter percent sales tax money,
we will be receiving shortly, I hope. The resolution is on by the County Executive,
9iving us entitlement, that they have purchased this piece of property for preserva-
tion for core watershed, and on that have a 9ood evening, and I'd like to say,
good night.
