TO HA FE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part,covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Nassau Point, Town of Southold, County of Suffolk and State of New
York, known and designated as Lot Number 237 as shown on a certain map entitled: "Amended
Map A of Nassau Point Club Properties, Inc." filed in the Office of the Clerk of the County of
Suffolk on 8/16/1922 as Map No. 156, bounded and described as follows:
BEGINNING at a concrete monument on the southerly side of Little Peconic Bay Road distant the
following two (2) tie line courses and distances from a concrete monument set on the easterly side
of a 15 foot path:
1. North 45 degrees 42 minutes 35 seconds East, 31.40 feet;
2. North 79 degrees 53 minutes 27 seconds East, 30.26 feet; said point of beginning also being
where the division line between Lot 238 and Lot 237 on the above mentioned map intersect the
southerly side of Little Peconic Bay Road;
RUNNING THENCE along the southerly side of Little Peconic Bay Road, a tie line course of North
71 degrees 22 minutes 00 seconds East, 59.34 feet to land now or formerly of Rocco Resciniti and
Eileen Resciniti and the division line between Lot 236 and Lot 237 on the above mentioned map;
THENCE along said last mentioned division line, South 15 degrees 05 minutes 00 seconds East,
152.81 feet to the high water mark of Wunneweta Pond;
THENCE a tie line course along the nigh water mark of Wunneweta Pond, South 68 degrees 13
minutes 36 seconds West, 95.40 feet to land now or formerly of Robert Profeta and Gloria A.
Profeta and the division line between Lots 238 and Lot 237 on the above mentioned map;
THENCE along said last mentioned division line, North 02 degrees 35 minutes 00 seconds West,
