We have determined that your applications are incomplete. Pursuant to our recent conversation on October 31, 2017, all actions requiring approval by a local or state agency, having a permitting authority, must conduct a State Environmental Quality Review(SEQR)to determine whether an action/project has potential significant adverse impacts on the social and natural environment. In an effort to fully understand possible significant impacts generated by the proposed additional restaurant use,the Zoning Board of Appeals will require the following information and documents to be included with the aforementioned applications: 1. Signed and Stamped Site Plan by a licensed professional consisting of the standards detailed in Article XXIV, Section 280-133B of the Southold"Town Code. (List of standards attached) 2. The completion and submittal of the attached Full Environmental Assessment Form (EAF)to include a narrative on how your business expansion meets Suffolk County Health Department Article 6 Regulations. RECEMP '- Leslie Kanes Weisman SEP 11 2017 Southold Town Zoning Board of Appeals RECEIVED 53095 Route 25 ZONING BOARD OF APPEALS P.O. Box 1179 SEP 1 A 2017 Southold, NY 11971 September 10,2017 ZONING BOARD OF APPEALS Dear Chairperson Weisman and members of the Zoning Board, Thank you for your review and attention to the special exception application for C&L Realty to reinstate food service to the public As a young girl working for my grandfather at Port of Egypt, I knew of the fishing station and marina next door to us.The property owner's intent then and the stewardship C&L has been following were to enhance the public's access to our waterways while preserving the benefits it offers to our community. In 1983 when the Morris family decided to split the property they sold the bulk land portion that included the Rt. 25 showroom, offices, ships chandlery, mechanics shop, bookkeeping, sales and service. It was home of the' Scallop Shop', which had an ice house, storage space and a scallop and oyster processing service with rooms above. The product was hauled off the boats, processed and stored for shipment to many locations on the island and beyond. The motel was a thriving business that supported the fishing economy, allowing families a way to stay, fish, play and then travel home with fresh caught food for their families. For those who had empty hooks, the fish market was an alternative to still bring fresh seafood home. The original fishing station and business building which included the fish market and bait and tackle shop and 3 motel rooms is where the current Market&Cafe is located.Throughout the time that my parents, William and Kae Lieblein, and my aunt and uncle,Ace and Carolyn Cottral, operated the business a Market was in use. When John Dinizio and his wife took over the Southold Fish Market operation we added fresh vegetable sales to enhance the customer experience of our boaters and local patrons. It was called the Dock& Barn. All of these businesses have continued within the footprint of the originally approved applications of the Morris family. We in fact reduced a 17' section of the original showroom on the western entrance to (enhance the customer experience. It offers a view of the waterfront as you drive along Rt. 25. The vision that the Morris family sought was to sell the Lieblein family the majority of the land portion that is contiguous to the Port of Egypt and to sell the water basin to Charlie Witzke for his boat operation at Albertson Marine. All the families involved who utilize this property have maintained businesses that enhance the community and afford jobs to local residents. Since 2003 1 have been tasked with the refurbishment of the property antl to continue the mission-my grandfather-Captain Bill practiced. He-believed in-providing — — customers with knowledge and "Educating Boaters for a Lifetime of Enjoyment'.The C&L property is marine based with 20+slips and rooms that encourage families to vacation here on the North Fork.We have participated willingly in ways to enhance the waterfront experience while continuing our families 71 years stewardship of the waterfront as an example of good practices. C&L has hosted a Boater Safety 1 program sponsored by Steve Bellone. Bridgehampton Bank held a program for awareness of preservation of our waterways. C&L provided SPAT with free storage of the first nets used in reseeding the bays. In the last 5 years C&L management has participated in promoting the North Fork and the Southold region specifically at the NY Times Travel Show and the Boston Globe Travel Show annually. As a member of the Association of Marine Industries we have attended meeting with NY State,Suffolk County and Southold officials in helping preserve marine and coastal issues.Through the SBDC and the representatives of NY Rising and the Governor's Office of Storm Recovery, I have attended meetings with other AMI members to inform, educate as per our unique property on Southold Bay and support the formulation of new Storm Preparedness. The public use that was impinged while we were in the recovery from Superstorm Sandy was a use that had not lapsed when our long time tenant relocated. While he had outgrown the location, the 50+year use still provided food options to our boating and transient patrons. C&L currently has a CO for a small accessory restaurant(cafe)for our in house patrons. We are seeking to reinstate the use to serve all our marina customers and the public. The bulk of our produce (75%) is sold as fresh to patrons and our wholesale restaurant and grocery store accounts. These orders are managed through phone and text communication reducing the impact of traffic flow on site. The other (25%) is processed to extend the shelf life and season with items such as jams, pickles, salads, pies and breads. We offer the 'Best-in Fresh' and participate in events sponsored by Governor Cuomo in Taste NY. Our products both fresh and processed have been donated through LI Farm Bureau, Discover Long Island and the Jacob Javitz to promote the region for tourism. C&L made donations to CorMaria Retreat house while they were recovering from reconstruction issues for two seasons. The small accessory restaurant offers convenience to our loyal residents and those new to the North Fork. The limited menu changes with the available produce grown throughout the season. We have one large farm style table, a small 4 seat table and counter seating for 4 to enjoy the view of the bay and creek known as Budds Pond. C&L, like the previous tenant, serves the boating customers in season who patronize our fueling and pump out station at Port of Egypt. We are open from 8 A.M.till 9 P.M. in the high season and 8 A.M.till 5 off season. The majority of our customers are day trippers who are generally in for breakfast and lunch for take away for boating, picnics and the beach. As evening approaches, the quiet setting where the sounds of the peepers can be heard in the woods, the splash and sparkle on the water with a glorious sunset is seen over the woods is part of the charm that inspires our late afternoon and evening visitors. This atmosphere is the reason families and couples pull up a chair and enjoy the waterfront seating and look for an easy meal to close the day with nature. Weather permitting patrons dine inside or carry to their boats for the best view of the bird sanctuary, preserved by the Glendenning family. - - RECEIVED - - - SFP 11 ?017 ZONING BOARD Or APPFPLS Many of the public travelers who frequent the property by way of water or public transportation are limited in the ability to travel and dine.Alure, the restaurant at Port of Egypt, closes mid-October till mid-April.The C&L Market&Cafe provide a food service that is locally sourced, with offerings that suit many palates. While many businesses close, for the winter we serve the public year round providing access to a waterfront location to enhance the tourism we need as a community in Southold. The ability for C&L to offer employment to several local residents throughout the year at the Market&Cafe is also part of our community commitment. Along with my team, I take pride in the transformation to a clean and attractive access to Southold Bay at the C&L location. The staff is knowledgeable and friendly and is an attribute to the tourism economy, referring the public to other services they may need. Public access to the Market and Cafe is vital to our continued survival in the community we support and will provide an added benefit as well as be compatible with the neighborhood. Letters of support from organizations and individuals will be submitted for inclusion as part of the application process. Thank you for your consideration in reinstating the public access and the special exception use which is within the same footprint as the original owner applied. CG:lk ZONING BOARD OF APPBALS FORM ZB4 I i P ' Page 2 - Appeal No. 2863 Action of the Zoning Board of Appeals Rendered 10/2/81 RECEIVED Matter of Southold Marine Center Land Holding Corp. SEP - ZOnIrC ROAR] 12017 S OF,gpPgq CS By this appeal, appellant seeks variances to the zoning ordi- nance, Article VIII, Section 100-81, Bulk and Parking Schedule, to divide premises located on the south side of Route 25, a necessary prerequisite to a sale of the westerly portion thereof. The Building Inspector' s reasons for disapproving such division, in effect, are as follows: (1) insufficient buildable upland area, , (2) proposed easterly lot will result in existing buildings having insufficient side yards, , (3) the easterly lot with existing buildings and uses will (possibly)• be without the required off- street parking for that use [off-street parking to be determined by the Planning Board] . The premises in question has a total, acreage on the south side of Route 25 of approximately 3.6 acres, which includes approximately 1.2 acres of underwater land on the west side. The proposed west- erly parcel will contain an area of approximately 77,400 square feet (45,500+- under water and 32,000+- upland) , with 222 feet along Route 25; The proposed easterly parcel will contain an area of approximately 82,700+- square feet, with 222.96 feet along Route 25. The premises in question located on the north side of Route 25 has an acreage of ,approximately one acre, with 200 feet along Route 25. The location of the division line between the westerly and easterly parcels located on the south side of Route 25 as proposed will leave a sideyard setback of the most northerly structure (on the easterly parcel and labeled one-story frame building on applicant' s survey dated 8/28/72 and presently used for showroom and storage pur- poses) ofapproximately four feet, and a sideyard setback of- the southeasterly structure (on the easterly parcel and labeled 2-story frame motel and which ha:s been used as a "scallop house") of ap- proximately one foot. The structures located on these premises are as follows: (1) proposed westerly parcel at the south side of Route 25: docks and concrete platform; (2) proposed easterly parcel at the south side of Route 25: one-story frame building to the north and recently used for showroom and storage purposes; one two-story and• one- one-story frame 'buildings [labeled motel on applicant' s survey] ; small locker; one-story frame. buill ing presently used for retail sales and containing one dwelling unit; *(3) parcel located at the north side of Route 25: substantially large metal building presently used for boat storage. Upon personal inspection of the premises, the Board finds that the areas to be utilized by the public for egress and ingress are unpaved, unlevel and of very poor condition. This Board also agrees with the determination of the Building Inspector that park- ing requirements should be . as determined by the Planning Board. Page 3 - Appeal No. 2863 Iq Action of the Zoning Board of Appeals Rendered 10/2/81 Matter of Southold Marine Center Land Holding Corp. ECElft SEP 2017 80ARD OF APp,5 The Board finds that the relief as requested is not substantial SLS in relation to the zoning requirements of the Town; that the relief requested is within the spirit of the zoning ordinance; that if the relief is granted no adverse effects will be produced on available governmental facilities of any increased population; that the relief if granted will not change the character of the neighborhood; that the practical difficulties are unique; and that the interests of justice will be served by granting the relief requested, subject to the conditions as listed below. On motion by Mr. Goehringer, seconded by Mr. Sawicki, it is RESOLVED, that Southold Marine Center Land Holding Corp. , Appeal No. 2863, be granted a variance to divide the premises for purposes of sale of the westerly portion thereof as shown on the map annexed to the appeal, SUBJECT TO THE FOLLOWING CONDITIONS: ' 1 1. That vehicular access to the southerly portion of the proposed westerly parcel located on the south side of Route 25 shall be provided along the easterly boundary of said westerly parcel, if possible, or by access through the easterly parcel which is to be retained by the present owner. Suitable recordable instruments giv- ing such right-of-way shall be provided for this appeal record and recorded' in the Suffolk County Clerk',s Office. Any such access shall have a minimum width of 30 feet. 2. That access roads affording ingress and egress by the public of both parcels located on the south side of Route 25 shall have a minimum width of 30 feet; shall remain open and unobstructed at all times; shall be regraded and paved in accordance with the following specifications, to wit: (a) Surfaced with a minimum depth of four inches of packed 3/4" stone blend so as to afford access for emergency and other vehicles; such stone blend may be either applied to the ground sur- face and shaped, or the surface may be excavated to permit the application of packed blend to a depth of 411; or in the alternative (b) Shall have topsoil removed to a depth of 8", and then filled with 8" of a good grade stone and sand bank run. The surface shall then be covered with a layer of two to four inches of 3/4" stone blend, or oiled with a minimum of 4/10ths of a gallon of road oil per square yard. , 3. That there shall be no storage of boats or other material within 35 feet of the Main Road on two of the parcels in question at any time (the two parcels in question being located on the north side of Route 25 and the easterly proposed parcel at the south side of Route 25) . No storage of boats or mother materials to be within 16 feet of the northerly property line on the westerly proposed parcel at the south side of Route 25. That the existing buildings and uses shall remain as is as of the date of this variance; and in the event a building or use is proposed to be altered, modified, changed, added, increased, in any way, such proposal shall be• subject to "the prior approval of this Board, except that the three buildings located along the easterly boundary line of the proposed easterly parcel at the south side of Route. 25 and used in,whole or in part for dwelling units shall comply with the living floor area requirements of Section 100-42 of the zoning code. 5. That no further businesses or uses are permitted on any of the three parcels at any time in the future without the express written prior approval of this Board. 6 , That the structures on any of these parcels shall not , exceed 20% lot coverage. 7. That the outer easterly side of the most northerly struc- ture (known as the building used for showroom and storage purposes) cannot at any time be used for storage of boat.s .or other items. 8. That the grant of this variance is subject to obtaining , approvals from the Southold Town Planning Board for parking and subdivision. 9. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 1,2016,stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268,'Waterfront Consistency review of the Town of Southold 'Town Code and the Local Waterfront Revitalization Prograin (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 26, 2016 indicating that based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, that the proposed action is CONSISTENT with policy standards, and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject parcel is located within the NE Zoning District and has frontage on Budd's Pond (connected to Southold Bay)to the south which connects to walkway ramps and several floating docks. The easterly property line measures 314.25 feet, the westerly property line measures 469.81 feet, and the property fronts 222.96"feet to the north onNYS Route 25 (Main Road). Furthermore, the property is improved with a large two story frame building, two (2) large one story marine frame buildings and one and two story hotel buildings as depicted on a survey prepared by John Metzger, LS, dated August 6, 2003, last revised June 27,2013. BASIS OF APPLICATION: Request for Variance(s) from Article`XIII, Section 280-56 and the Building Inspector's June 8, 2016 Notice of Disapproval based on an application for a building permit to demolish and rebuild a portion of an existing storage building, at; 1)less than the code required minimum side yard setback of 25 feet, located at: 61600 NYS Route 25, Main Road, (Adj. to Budd's Pond, Southold Bay) Southold, NY. SCTM#1000-56-6-3.4 RELIEF REQUESTED: The applicant requests a variance to reconstruct a one story portion of an existing two story marine storage building (in place and in kind) having a distance of approximately 1.167 feet from the side yard property line to the west instead of the required 25 feet side yard setback. Page 2, August 18, 2016 v #6975, C& L Realty SEP 1201' I/ SUM No. 1000-56-6-3.4 ZONING BOARD OF APPEALS ADDITIONAL INFORMATION: The applicant testified that the building is used for business and marine storage only, and was damaged by Super Storm Sandy. In 2012, a permit was issued by the Town Trustees, but the applicant was not able to secure a building permit. It was further explained by the applicant that the reason for the setback of one foot from the property line is because of a land sub-division and sale of property after the structure was built in the 1970's. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 4,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighboihood, and other evidence, the Zoning Board finds the following facts,to be true and relevant and makes the following findings: 1. Town Law &267-b(3 (b) )(1). - Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The existence of the most northerly portion of the building has been in the same location for many years and located in a boat yard for more than 60 years. 2. Town Law&267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. In order to rebuild in place and in kind and in the same footprint, the applicant requires variance relief, and any additions or alterations to the subject marine storage building would require variance relief. 3. Town Law 4267-b(3)(16)(3). The variance granted herein is mathematically substantial, representing 95.6% relief from the code. However, the setback was established as a result of a subdivision, the marine storage building has been in its present location for many years without adverse impact, and the proposed construction is in place and in kind and will not increase the existing degree of non-conformity. 4. Town Law 426.7-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this MII District will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has-not been self-'created. The building has been in existence for more than 50 years, in its present location, but has been partially destroyed by Super Storm Sandy. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of reconstruction of the one story portion of a two story marine storage building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 11, 20,13, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATI N:_This apntirat_ ini, .xis rgfinedToe a et ron onsistency review of the Town of Southold Town Code and?the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Aug. 6, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action to construct decking additions to an existing commercial building within the FEMA Flood Zone AE,and outside of the FEMA VE Flood Zone, at less than the code required bulkhead setback of 75 feet, and at more than the code permitted lot coverage of 30% in the MII District are CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. Further, the expansion of the boardwalk in the FEMA VE Flood Zone is recommended as INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, at the request of the Board, on August 15, 2013 the applicant's agent submitted an updated survey by John Metzger dated August 12, 2013 showing the location of the VE and AE flood zones, and an amended boardwalk plan by Garrett Strang, Architect, , that removed the portion of the proposed deck in the VE zone(24 sq.ft.).Subsequently,this Board now determines the application to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION:The Applicant's property is a 81,478 sq. ft.waterfront parcel in the MII Zone. The northerly lot line measures approximately 258,along Main Road, Route 25. The parcel is improved with several commercial structures that are currently in use as a motel, and marina complex as shown, with the proposed new decking additions, and the existing and proposed lot coverage, on the survey drawn by John T. Metzger,LLS/Peconic Surveyors dated August 6,2003, last revised August 12,2013. r BASIS OF APPLICATION: Request for Variances from Article XXII Section 280-116(B) and Article XIII Section,280-56 and the Building Inspector's June 28, 2013 Notice of Disapproval based on an application for building permit to construct decking additions to an existing commercial building, at; 1) less than the code required bulkhead setback of 75 feet,2)more than the code permitted lot coverage-OM%an--the-MI--LDistr-ict.----- - =-- ----- -- - Z Page 2 of 3-August 22,2013 672— Realty,Inc. SCrM I SCTMg1000-56-56-6-3.4 RELIEF REQUESTED: The applicant requests a variance to replace concrete steps, landings and walkways that had existed before the substantial storm damage that, occurred in October 2012 with a wood boardwalk and decking that will be wheelchair accessible with a bulkhead setback of 28.3 feet, where Code requires a minimum of 75 feet, and a variance for 31.3% lot coverage, where Code permits a maximum of 30% in the Mll Zone District ADDITIONAL INFORMATION:The Applicant has received NYSDEC permit#1-4738-04140/00002,dated April 25, 2013, and Southold Town Trustees amended permit#7770 dated Dec. 12, 2012 as a part of the approval process for the proposed project. This parcel was the subject of a prior ZBA decision # 2863, dated.Oct. 5, 1981,when the Board granted a variance for a subdivision of the parcel. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 8,2013,at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the-property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Applicant is basically proposing to replace concrete walkways, steps and landings that had existed before being damaged or destroyed by Super Storm Sandy in late October 2012, with a wood boardwalk and decking that will be more resilient to any future weather event and also wheelchair accessible per compliance with the American's With Disabilities Act(ADA). 2. Town Law §267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The replacement decking will be constructed within 75 feet of existing bulkheads, and therefore requires a bulkhead setback variance, and the decking will exceed code allowed Iot coverage by+1%,which also requires a variance. 3. Town Law - e variance granted herein fora 28.3 feet bulkhead setback or decking, where Code requires 75 feet, is mathematically substantial, representing+62% relief from the code. However, replacing in kind the original concrete steps, landings and sidewalks that existed prior to,severe storm damage was deemed unsuitable due to heaving. By the use of wood decking with the proposed erosion control, potential damage in the future will be minimized and the safe access of persons using the marina's motel.and the docks and boat slips will be enhanced. The variance granted herein for 31.3%,lot coverage, where code allows a maximum of 30% is not substantial, representing a 1.3% increase. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Applicant proposed to mitigate flooding impacts to the site by raising the boardwalk elevation to+5.25 feet in the FEMA Flood Zone AE areas and locating the entire boardwalk and platforms landward of the VE Zone. In addition, the applicant submitted a letter dated August 8, 2013 in which she described the use of landscape cloth and rocks to protect the bulkhead area from storm erosion. Finally, the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created, but is directly related to unusually severe storm damage caused by Super Storm Sandy in Oct.2012. 6. Town Law &267-b.-Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new and, rebuilt boardwalk decking, while preserving t-4)0TW&6cting the character of the neighborhood and the health, safety and welfare of the community. -- - 200413 BOARD OF APPEAI-5 Page 3 of 3-August 22,201 / ZBAtt6672—C&L Realty,Inc. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board ofAppeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited . above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities'under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. MANWARTNG, JR., being duly sworn, deposes and says: 1. • 1 reside at 1225 Seawood Drive, P.O. Box 1802, Southold, New York 11971_ I am the Member/Manager of Chloem, LLC, who is the owner of the property which is the subject of this application,` to both the Southold Town Zoning Board of .Appeals for a Special Exception as well as Site Plan approval from the Southold Town Planning Board. My wife, Rebecca D. anwaring, is the only o er Member of Chloem, 1JUC. Your deponent is also the President/Shareholder of Southold Fish ' Market, Inc. which is the tenant of Chloem,, LLC, and the purpose of these applications =to convert an existing building originally built as a restaurant to, a fish market with small accessory restaurant, all located at 64755 Main Road, Southold, New York, located in a Marine fI (M-II) Zoning District. 2. Since I am not a public speaker, I thought it best to outline in writing to both the Southold Town Zoning Board of Appeals and the Southold Town Planning Board what I am proposing to do at the property located at 64775 Main Road, Southold, ' New York. 'By way of background,' I have been in the seafood business for the past 25 years. I have worked at the Southold Fish Market since 1987 and bought the business from the prior owner ` -1- in 1999_ I am also a licensed commercial fisherman and have been since 1987. The Southold Fish Market has for the past 50 years been located at the Port of Egypt Marina in Southold, New• ►Iq York. Southold Fish Market, Inc. is licensed by the New York RECEIVED State Department of Agriculture and Markets to operate a wholesale and retail fish market. Other than myself, the Fish, SEP 2017 Market employs eleven (11) persons [three (3) full-time ancTONING BOARD OF APPEALS eight (8) part time] . The part-time workers also work full-time during the summer and on holidays. The Southold Fish Market, Inc. sells all types of local and imported finfish and shellfish such , as clams, oysters, scallops as well as lobsters. The wholesale sales are primarily made to restaurants, and the retail sales to the general public_ Eighty percent (80%) of the business is selling of' fresh fish. , The other twenty percent (20%) is selling of condiments such as tartar and cocktail sauces, spices as well as freezing,'', smoking and cooking of the various seafoods for consumption by customers primarily on the premises. The lease between Southold Fish Market, Inc_ and C & ea1ty --PeYt—af Maz ina was not renewed, SO X1 UL for the Southold Fish 'Market to stay in business, I purchased the former Hollister's Restaurant which was located at 64755 Main Road, , Southold, New York, and primarily because it is zoned in a Marine II District, which allows for a fish market and restaurant• by Special Exception from the Southold Town Zoning Board of Appeals_ 3. The proposed relocation of the fish market in the opinion of the undersigned will be compatible with the surrounding neighborhood and the community in general, particularly with regard to visibility and overall appearance.. This particular area fronting on State Route 25 is devoted primarily to commercial uses. To the west of the subject property on the, northerly side of N.Y.S. Route , 25 is Wego Bait & -2- RECEIVED Tackle Shop, and on the east is the Greenport Pottery Company. To the south across N.Y.S. Route 25 is a building being SEP 1 1 2011 renovated as a catering hall as well as the development of ZgNING BOARD OF APPEALS marina. The lands to the north of the property is a large tract of land and it is zoned residential- is vacant, and has one house and several trailers on it. 4. - The plans for the site and building renovations for the fish market are attached to the ,applications and are self- explanatory. As seen from the proposed floor plan, the building is primarily being renovated for a fish market. However, to: provide convenience, to the public and to continue on with the previous business of Southold Fish Market, Inc. , a small restaurant operation is being incorporated into the westerly portion of the building which will'have a very limited menu and will be primarily devoted to the sale of seafood. It is my understanding that this building over the years has been occupied as a tavern and subsequently remodeled as an 80-seat restaurant when' the property was zoned Business but has been reclassified as Marine II, District. 5. It is noted that in , 1985, ,the Southold Town Planning .Board gave permission for renovations to this very same building for an 80-seat restaurant. -The restaurant had gone out of business and has been vacant for several years, becoming in my opinion an eye sore. The building needs complete renovation and refurbishment to accommodate a modern fish market with small ;;c-r_es!ory restaurant_ In the restaurant portion your deponent proposes to have our (4) tables with a maximum of 16. seats_ As seen from the floor plan, the emphasis is on the fish market -as it is eighty percent (8096) of the business_ Wholesale orders are- generally taken by telephone and the fish are delivered to local restaurants. The retail sales to the public will take place in the building on the premises. Due to the, present -3- location of the building; for safety reasons the main entrance for ingress will be located at ,the easterly curb cut. The reason for this is safety, as any vehicle proceeding east on Route 25 and making a left turn into the property will have a much clearer view of the oncoming westbound traffic. Similarly, the egress on the westerly side of the property, allows for vehicles exiting to have a better view of both east and west RECEIVED bound traffic. This is -primarily due to the ,curvature of Route 25 in this area. SEP 112017 . 6. The Suffolk County Water Authority supplies the &iC BOARD OF APPEALS for both the fish market and the small restaurant. The septic and cesspool system for the fish market and accessory restaurant are more than adequate 'as they were originally constructed to accommodate an 80-seat restaurant. It is your deponent's understanding that this septic and cesspool system has been previously approved by the Suffolk County Department of Health for the Holli.ster's Restaurant.. However, I am applying to the Suffolk County Department of Waste Water Management for re- approval. The principal effluent from 'the fish market is primarily clear water containing only fish scales due to the washing and cleaning of the fish_ As to the solid waste,, the fish carcasses are put -in covered buckets and placed in a closed container and then removed to the dumpster at the rear of the property_ North Fork Sanitation picks up the 3 14 yard dumpster and replaces it at a minimum of three times a week. 7. The hours of the fish market will be from 8 A.M. to 6 P.M. and the parking lot lighting as proposed will be more than adequate. The driveway areas will be asphalt and the road along the north boundary line with stone blend which will not produce dust or vibration. There will be no odors emitted from the exterior of the building, and the odors within the building will be that consistent of a fish market. -4- uy) 8. It is submitted that this entire proposed operation will not cause a- public nuisance or any other problems. The northerly, easterly and westerly boundaries of the subject property will be landscaped and along these property lines, a stockade fence will be built according to code. This will provide for the privacy of neighbors on the east and define the property boundary on the north and west and encroachments of the existing underbrush. Along the northerly boundary of the 1 RECEIVED subject property there will be a roadway of pervious material with a French drain underneath which will not •only take careEof11 2017 the drainage but will provide access for the North ForkZONING BOARD OF APPEALS Sanitation truck to remove the dumpster. 9. Although there is presently adequate drainage on the subject property as noted on the proposed site plan french drains are adjacent to the parking areas and a dry well is installed at each end of the building to recapture all of the roof rain runoff as there is presently no gutter or leaders on the present building. The existing building is the only building on the subject property, so there obviously will not be any over-crowding, and the property and the building will be devoted primarily to the fish market operation. 10. It is also brought to the Board's attention there are no churches, schools, or any other recreational areas or public - assembly in this neighborhood at the present time, and as stated there will be adequate buffers for the screening of the subject property from the surrounding properties if that becomes necessary. Remodeling and refurbishing the building will not cause any disturbance as this proposed site is particularly suited for a fish market and a small restaurant, which are both permitted uses in the Marine II Zoning District with Special Exception approval from the Southold Town Zoning Board of -5- Appeals, which in turn requires site plan approval from the Southold Town Planning Board. 11. Finally, there is sufficient and adequate space for the utilization of this building as a fish market to serve the public and along with the small restaurant and further it will be compatible with the adjacent properties.
