I informed her that, yes, that's possible, and I kindly asked her to send me correspondence of her wishes. • As of October 23, 2018, I have not received any correspondence from Amy. • 1 also questioned Building Dept. whether they were aware of any illegal activity, such as a Restaurant, at the site , and was told there was none. • Amy told me she would pick up her application packets. I asked her to contact us ahead of time so the office staff was aware and we can gather the packets for her. • As of this date,November 16, 2018, no further response received from the applicant. MEMORANDUM �1 To: File From: Kim Fuentes, Board Assistant Date: October 31, 2017 RE: C & L Realty— Discussion with Kathy Sepnoski — Special Exception This date, I contacted Kathy Sepnoski by phone to discuss steps in processing her application, pursuant to the Chairperson's instructions: (A meeting was held with the Supervisor, Town Attorney and the ZBA Chairperson in order inquire direction for SEQRA analysis of the aforementioned Special Exception.) The following was discussed: 1) I asked if she wished to proceed with the application, since the property was listed for sale. She indicated that the property has been listed for sale for some time and that she wished to proceed. 2) I told her of the procedure by ZBA to employ professional consultants to conduct SEQRA review on special exception applications. I then gave her brief description of SEQRA and that it was mandatory requirement by the State. 3) Informed her that we had to ask our consultant for a cost estimate to review her application and that we would pass the cost to her. Her comments consisted of not being informed of this procedure when she submitted her application, and her concerns with additional costs to maintain her business. She further maintained that the restaurant has existed and that it was unfair that she received limited approval by the building department to operate the Cafe. Addendum Site Plan Use Determination (SPUD) for "Heron Harbor Restaurant" at 61600 Route 25, Southold. SCTM#1000-56-6-3.4 The Planning Board reviewed the subject property and proposed existing 16-seat restaurant use to change from being open to hotel guests only, to being open to the public. To help make their recommendation, Board members reviewed Town Code section 280-127 Applicability, which states the following: "Any change in use or intensity of use which will affect the characteristics of the site in terms of parking, loading, access, drainage, open space or utilities will require site plan approval." Their assessment, based on parking requirements from the code, is that the intensity of the site is not increasing because previous uses were at least as, if not more intense than the current and proposed uses. The required parking for the previous uses of fish market with a take-out restaurant, the retail bait and tackle shop, the motel and retail/shop/office area in the front of the property was calculated to be greater than the required parking for the motel, 16-seat restaurant, and use of the front building for boat- sales events, and hotel storage. In 1983 when the Morris family decided to split the property they sold the bulk land portion that included the Rt. 25 showroom, offices,ships chandlery, mechanics shop, bookkeeping, sales and service. It was home of the'Scallop Shop',which had an ice house,storage space and a scallop and oyster processing service with rooms above.The product was hauled off the boats, processed and stored for shipment to many locations on the island and beyond. The motel was a thriving business that supported the fishing economy, allowing families a way to stay, fish, play and then travel home with fresh caught food for their families. For those who had empty hooks,the fish market was an alternative to still bring fresh seafood home. The original fishing station and business building which included the fish market and bait and tackle shop and 3 motel rooms is where the current Market&Cafe is located.Throughout the time that my parents,William and Kae Lieblein, and my aunt and uncle,Ace and Carolyn Cottral, operated the business a Market was in use.When John Dinizio and his wife took over the Southold Fish Market operation we added fresh vegetable sales to enhance the customer experience of our boaters and local patrons. It was called the Dock& Barn. All of these businesses have continued within the footprint of the originally approved applications of the Morris family.We in fact reduced a 17' section of the original showroom on the western entrance to enhance the customer experience. It offers a view of the waterfront as you drive along Rt. 25. The vision that the Morris family sought was to sell the Lieblein family the majority of the land portion that is contiguous to the Port of Egypt and to sell the water basin to Charlie Witzke for his boat operation at Albertson Marine. All the families involved who utilize this property have maintained businesses that enhance the community and afford jobs to local residents. Since 2003 1 have been tasked with the refurbishment of the property and-to cofftinue-the mission my grandfather-Captain Bill practiced.He-believed in providing - — customers with knowledge and "Educating Boaters for a Lifetime of Enjoyment'.The C&L property is marine based with 20+slips and rooms that encourage families to vacation here on the North Fork.We have participated willingly in ways to enhance the waterfront experience while continuing our families 71 years stewardship of the waterfront as an example of good practices. C&L has hosted a Boater Safety 'f program sponsored by Steve Bellone. Bridgehampton Bank held a program for awareness of preservation of our waterways. C&L provided SPAT with free storage of the first nets used in reseeding the bays. In the last 5 years C&L management has participated in promoting the North Fork and the Southold region specifically at the NY Times Travel Show and the Boston Globe Travel Show annually.As a member of the Association of Marine Industries we have attended meeting with NY State, Suffolk County and Southold officials in helping preserve marine and coastal issues.Through the SBDC and the representatives of NY Rising and the Governor's Office of Storm Recovery, I have attended meetings with other AMI members to inform,educate as per our unique property on Southold Bay and support the formulation of new Storm Preparedness. The public use that was impinged while we were in the recovery from Superstorm Sandy was a use that had not lapsed when our long time tenant relocated.While he had outgrown the location,the 50+year use still provided food options to our boating and transient patrons. C&L currently has a CO for a small accessory restaurant(cafe)for our in house patrons. We are seeking to reinstate the use to serve all our marina customers and the public.The bulk of our produce (75%) is sold as fresh to patrons and our wholesale restaurant and grocery store accounts.These orders are managed through phone and text communication reducing the impact of traffic flow on site.The other (25%) is processed to extend the shelf life and season with items such as jams, pickles,salads, pies and breads. We offer the'Best in Fresh' and participate in events sponsored by Governor Cuomo in Taste NY. Our products both fresh and processed have been donated through LI Farm Bureau, Discover Long Island and the Jacob Javitz to promote the region for tourism. C&L made donations to CorMaria Retreat house while they were recovering from reconstruction issues for two seasons. The small accessory restaurant offers convenience to our loyal residents and those new to the North Fork.The limited menu changes with the available produce grown throughout the season.We have one large farm style table, a small 4 seat table and counter seating for 4 to enjoy the view of the bay and creek known as Budds Pond. C&L, like the previous tenant, serves the boating customers in season who patronize our fueling and pump out station at Port of Egypt.We are open from 8 A.M.till 9 P.M. in the high season and 8 A.M.till 5 off season.The majority of our customers are day trippers who are generally in for breakfast and lunch for take away for boating, picnics and the beach.As evening approaches,the quiet setting where the sounds of the peepers can be heard in the woods,the splash and sparkle on the water with a glorious sunset is seen over the woods is part of the charm that inspires our late afternoon and evening visitors. Along with my team, I take pride in the transformation to a clean and attractive access to Southold Bay at the C&L location.The staff is knowledgeable and friendly and is an attribute to the tourism economy, referring the public to other services they may need. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 11, 2013, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated Aug. 6, 2013. Based upon all testimony,documentation, personal inspectiop(ANG12JORRIWOF APPEALS and surrounding neighb6rhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(t). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Applicant is basically proposing to replace concrete walkways, steps and landings that had existed before being damaged or destroyed by Super Storm Sandy in late October 2012,with a wood boardwalk and decking that will be more resilient to any future weather event and also wheelchair accessible per compliance with the American's With Disabilities Act(ADA) . 2. _Town Law $267-b(3)(b)(2).The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The replacement decking will be constructed within 75 feet of existing bulkheads, and therefore requires a bulkhead setback variance, and the decking will exceed code allowed lot coverage by+1%,which also requires a variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein for a 28.3 feet bulkhead setback for decking, where Code requires 75 feet, is mathematically substantial, representing+62% relief from the code. However, replacing in kind the original concrete steps, landings and sidewalks that existed prior to severe storm damage was deemed unsuitable due to heaving. By the use of wood decking with the proposed erosion control,potential damage in the future will be minimized and the safe access of persons using the marina's motel and the docks and boat slips will be enhanced. The variance granted herein for 31.3% lot coverage, where code allows a maximum of 30% is not substantial,representing a 1.3%increase. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood. The Applicant proposed to mitigate flooding impacts to the site by raising the boardwalk elevation to +5.25 feet in the FEMA Flood Zone AE areas and locating the entire boardwalk and platforms landward of the VE Zone_ In addition, the applicant submitted a letter dated August 8,2013 in which she described the use of landscape cloth and rocks to protect the bulkhead area from storm erosion. Finally, the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created, but is directly related to unusually severe storm damage caused by Super Storm Sandy in Oct.2012- 6. Town Law $267-b. In order to rebuild in place and in kind and in the same footprint, the applicant requires variance relief, and any additions or alterations to the subject marine storage building would require variance relief. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 95.6% relief from the code.However,the setback was established as a result of a subdivision,the marine storage building has been in its present location for many years without adverse impact, and the proposed construction is in place and in kind and will not increase the existing degree of non-conformity. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this MH District will have an adverse impact on the physical or environmental conditions in the neighborhood. SEP 11 200 ZONING BOARD OF APPEALS By this appeal, appellant seeks variances to the zoning ordi- nance, Article VIII, Section 100-81, Bulk and Parking Schedule, to divide premises located on the south side of Route 25, a necessary prerequisite to a sale of the westerly portion thereof. The Building Inspector' s reasons for disapproving such division, in effect, are as follows: (1) insufficient buildable upland area, (2) proposed easterly lot will result in existing buildings having insufficient side yards, (3) the easterly lot with existing buildings and uses will (possibly) be without the required off- street parking for that use [off-street parking to be determined by the Planning Board] . The premises in question has a total acreage on the south side of Route 25 of approximately 3.6 acres, which includes approximately 1.2 acres of underwater land on the west side. The proposed west- erly parcel will contain an area of approximately 77,400 square feet (45,500+- under water and 32,000+- upland) , with 222 feet along Route 25. The proposed easterly parcel will contain an area of approximately 82,700+- square feet, with 222.96 feet along Route 25. The premises in question located on the north side of Route 25 has an acreage of approximately one acre, with 200 feet along Route 25. The location of the division line between the westerly and easterly parcels located on the south side of Route 25 as proposed will leave a sideyard setback of the most northerly structure (on the easterly parcel and labeled one-story frame building on applicant' s survey dated 8/28/72 and presently used for showroom and storage pur- poses) ofapproximately four feet, and a sideyard setback of the southeasterly structure (on the easterly parcel and labeled 2-story frame motel and which has been used as a "scallop house") of ap- proximately one foot. That vehicular access to the southerly portion of the proposed westerly parcel located on the south side of Route 25 shall be provided along the easterly boundary of said westerly parcel, if possible, or by access through the easterly parcel which is to be retained by the present owner. Suitable recordable instruments giv- ing such right-of-way shall be provided for this appeal record and recorded in the Suffolk County Clerk's Office. The part-time workers also work full-time during the summer and on holidays_ The Southold Fish Market, Inc. sells all types of local and imported finfish` and shellfish such as clams, oysters, scallops as well as lobsters. The wholesale sales are primarily made to restaurants, and the retail sales to the general public. Eighty percent (80%) of the business is selling of fresh fish. The other twenty percent (20%) is selling of condiments such as tartar and cocktail sauces, spices as well as freezing, smoking and cooking of the various seafoods for consumption by customers primarily on the premises_ The lease between Southold Fish Market, Inc_ and C & @alty—o-f—PZoY for the Southold Fish Market to stay in business, I purchased the former Ho.11isteris Restaurant which was located. at 64755 Main Road, Southold, New York, and primarily because it is zoned in a Marine II District, which allows for a fish market and restaurant by Special Exception from the Southold Town Zoning Board of Appeals_ 3. The proposed relocation of the fish market in the opinion of the undersigned will be compatible with the surrounding neighborhood and the community in general, particularly with regard to visibility and overall appearance_ This particular area fronting on State Route 25 is devoted primarily to commercial uses. To the west of the subject property on the northerly side of N.Y.S. Route 25 is Wego Bait & -2- Tackle Shop, and on the east is the Greenport Pottery Company. To the south across N.Y.S. Route 25 is a building being RECEIVED renovated as a catering hall as well as the development of a InAl marina. The lands to the north of the property is a large tract��P of land and it is zoned residential is vacant, and has one h o'U BOAStD OF APPEAL and several trailers on it. 4. The plans for the site and building renovations for the fish market are attached to the applications and are self- explanatory. As seen from the proposed floor plan, the building is primarily being renovated for a fish market. However, to provide convenience to the public and to continue on with the previous business of Southold Fish Market, Inc. , a small restaurant operation is being incorporated into the westerly ptiro 'on of the building which will have a very limited menu and will be primarily devoted to the sale of seafood. It is my understanding that this building over the years has been occupied as a tavern and subsequently remodeled as an 80-seat restaurant when the property was zoned Business but has been reclassified as Marine II District. - 5. It is noted that in 1985, the Southold Town Planning Board gave permisslon for renovations to this very same building for an 80-seat restaurant. The restaurant had gone out of business and has been vacant for several years, becoming in my opinion an eye sore_ The building needs complete renovation and refurbishment to accommodate a modern fish market with small cress r restaurant In the restaurant portion your deponent proposes to have four (4) tables with a maximum of 16 seats. As seen from the floor plan, the emphasis is on the fish market as it is eighty percent (80x) of the business_ Wholesale orders are generally taken by telephone and the fish are delivered to local restaurants. The retail sales to the public will taXe place in the building on the premises. Due to the present -3- •thy W location of the building, for safety reasons the main entraUaVF-ID l for ingress will be located at the easterly curb cut. The SEP -11 Z07 reason for this is safety, as any vehicle proceeding east on OAgD DF AP?eW Route 25 and making a left turn into the property will "Wc-& much clearer view of the oncoming westbound traffic. Similarly, the egress on the westerly side of the property allows for vehicles exiting to have a better view of both east and west- bound traffic. This is primarily due to the curvature of Route 25 in this area_ 6. The Suffolk County Water Authority supplies the water for both the fish market and the small restaurant. The septic and cesspool system for the fish market and accessory restaurant are more than adequate as they were originally constructed to accommodate an 80-seat restaurant. It is your deponent's understanding that this septic and cesspool system has been previously approved by the Suffolk County Department of Health for the Hollister's Restaurant_ However, I am applying to the Suffolk County Department of Waste Water Management for re- approval. The principal effluent from the fish market is primarily clear water containing only fish scales due to the washing and cleaning of the fish_ As to the solid waste, the fish carcasses are put in covered buckets and placed in a closed container and then removed to the dumpster at the rear of the property. North Fork Sanitation picks up the 3 31 yard dumpster and replaces it at a minimum of three times a week. 7. The hours of the fish market will be from 8 A.M. to 6 P.M. and the parking lot lighting as proposed will be more than adequate. The driveway areas will be asphalt and the road along the north boundary line with stone blend which will not produce dust or vibration. There will be no odors emitted from the exterior of the building, and the odors within the building will be that consistent of a fish market. -4- 8. It is submitted that this entire proposed operation will not cause a public nuisance or any other problems. The northerly, easterly and westerly boundaries of the subject RECEIVE® property will be landscaped and along these property lines, SEP stockade fence will be built according to code. This will %ING15ppRDOFApp�� provide for the privacy of neighbors on the east and define the property boundary on the north and west and encroachments of the existing underbrush. Along the northerly boundary of the subject property there will be a roadway of pervious material with a French drain underneath which will not only take care of the drainage but will provide access for the North Fork Sanitation truck to remove the dumpster. 9. Although there is presently adequate drainage on the .subject property as noted on the proposed site plan french drains are adjacent to the parking areas and a dry well is installed at each end of the building to recapture all of the roof rain runoff as there is presently no gutter or leaders on the present building. The existing building is the only building on the subject property, so there obviously will not be any over-crowding, and the property and the building will be devoted primarily to the fish market operation. 10. It is also brought to the Board' s attention there are no churches, schools, or any other recreational areas or public assembly in this neighborhood at the present time, and as stated there will be adequate buffers for the screening of the subject property from the surrounding properties if that becomes necessary. Remodeling and refurbishing the building will not cause any disturbance as this proposed site is particularly suited for a fish market and a small restaurant, which are both permitted uses in the Marine II Zoning District with Special Exception approval from the Southold Town Zoning Board of -5- Appeals, which in turn requires site plan approval from the Southold Town Planning Board. 11.
