Re: Change of Zone Request of RQA Properties, LLC
Thank you for this second opportunity to review and comment on this proposed Change
of Zone from Residential-40 to General Business for the property referenced above.
After consideration of the surrounding zoning, and the current and potential future uses
of the subject property, the Planning Board recommends that the Town Board deny this
request for the following reasons:
1. The current business on the site does not require a zone change to continue
operating. It is a legal pre-existing non-conforming use, which is permitted by
Town Code to continue indefinitely.
2. Both the subject parcel and all surrounding parcels are also zoned
Residential-40, which generally allows only residential uses.
3. The requested zone change is to the General Business Zoning District which
permits some of the most intense commercial uses (e.g. gas stations,
restaurants, large retail stores).
4. The property is located on the corner of a busy residential street.
5. The purpose of creating pre-existing non-conformities when enacting
sweeping zoning changes, as was done in 1989, is to eventually cause a shift
in uses over time towards conforming ones. While this hasn't happened in this
case, continuing the existing zoning prevents a future use that is even less in
harmony with the neighborhood.
We have attached a zoning map of the area surrounding the subject parcel for your
reference.
