SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... I. , for variance in accordance with Article III, Section 301 and Article III, Section 10.00A of Zoning Ordinance, for permission to set off lot with less than required area., Location of property; Private Road off east side of ruin Road, Mattituck, New York, bounded on the north by Boucher Estate ; east by Private Road; south by L. Lindsay; west by Funder and others. Fee paid : 15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The Board agrees with the reasoning of the applicant that a large majority of the lots in the surrounding area are smaller than the lot in question. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity, of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance . STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because The large majority of lots in the surrounding area aresmaller than the lot in question. A portion of the seller's property fronts on the Main "Road and a house has been erected upon it. The portion offered for sale approximately a half acre can be separated and unless another dwelling is erected upon it, same will become useless. The parcel in question has been in single and seperate ownship. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because when divided the parcel in question will exceed the present requirement for width and have an area greater than a majority of the surrounding lots. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because granting the variance will not adversely affect the public safety, health or w s �p the surrounding property owners buat will, in fact, enhance the value of the surrounding property.
