Notice of Hearings
Pursuant to Section 267 of the Town Law and the provisions
of the Amended Building Zone Ordinance of the Town of Southold,
Suffolk County, New York, public hearings will be held by the
Zoning Board of Appeals of the Town of Southold, at the Fishers
Island Firehouse, Fishers Island, on January 23, 1973 - weather
permitting, storm date January 30, 1973, on the following appe3ls:

Fishers Island Utility Co. is the owner of land off Central Ave.
adjo~ning the land of Henry M. Zabohonski on the south and west. Fishers
Island Uti I ity Co., the successor to Fishers Island Farms, Inc., as the
owner of this property is in no sense a public or private uti lity. The
company is owned by individual stockholders (residents of Fishers Island)
with personal investment in this land.
It is the feel ing of the owners of the company that any variances
permitting buildings or bui Iding to be erected close to the boundary lines
would devalue the adjoining properties and restrict their usuage in the
future.

Re: Variance Application of Zabahonski, Fisher's Island
Dear Mr. Terry
This has to do with the notice of disapproval of Mr. Zabahonski's applica-
tion to erect a building on the west side of Central Avenue in the C-1 zone,
and is intended to clarify the position of your office assuming the variance
were to be granted, the building erected, and a supermarket use put 10
the premises.
I have carefully re-read the ordinance and am persuaded that such a use
does not come within the 46 exceptions listed in ~900 and, therefore, in
view of the permitted use of "retail store, " is a''J.awful purpose," such
that a special exception of the Board of Appeals and site plan approval by
the Planning Board should not be required.
I would be most appreciative if you would reply, indicating either that you
concur with my ana\ysis or take exception to it. If you take exception, please
indicate to me what, in the past, have been the general requirements of the
Planning Board as to parking requirements for retail stores, particularly if
there is any relation by the square foot of floor area. There are many facets
to this Zabahonski application which tend to lead us into a number game, and
I would like to have as many answers as I can in advance of investing a lot
of money.

a. Thi. application must be completely filled in by typewriter or in ink and submitted in triplicate to the Building Inspector. with
3 sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or areas, and
giving a detailed description of layout of property must be drawn on diagram which is part of this application.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such permit shall be kept on
the premises available for inspection throughout the work. '
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy shall have been
granted by the Building Inspector.
